The site visits and records reviews were performed by Chris Hayden, R.E.A., consistent with the proposal submitted to Birch Bayview Plaza U LP (Client). The information contained in this ESA was obtained from personal inspection, from various government agencies, and from sources deemed to be reliable. PHASE 1 ENVIRONMENTAL SITE ASSESSMENT Five Contiguous Residential Properties 20322, 20342 and 20352 S. W. Acacia Street and 20341 and 20351 S. W. W. Acacia Street and 20341 and 20351 S. W. Birch Street in the area of Newport Beach, California (hereinafter collectively referred to as the "Subject Property"). After inspecting the Subject Property; reviewing its past uses; observing surrounding properties; searching through the Federal Environmental Protection Agency, State of California, and Orange i' County records, it can be concluded that there is no. evidence of `recognized environmental conditions", as defined by the ASTM, in connection with the Subject Property. No further action is required at this time. HEI 03-111 Rpt Dt: 127/03 2 INTRODUCTION ' 2.1 Purpose ' The purpose of this ESA is to identify "recognized environmental conditions" in connection with the Subject Property. The ASTM Standard Practice for Environmental Site Assessments defines "recognized environmental condition" as "the • presence or likely presence of any hazardous substance or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of an hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water on the property." ' 2.2 Scope of Work ' As agreed to between Hayden Environmental and Birch Bayview Plaza H LP, the scope of work for this ESA included the following: • Site Inspection • Surrounding Property Observation • Interviews With Individuals Having Knowledge of the Operations on the Subject Property • Inspection of Owner/Operator's Books and Records ' HEI 03-111 • Inspection of City or County Building Permits • Inspection of City or County Fire Department Records • Inspection of County Health Department Files • Inspection of County Public Works Files • State and Federal Regulatory Agency Database Search For Posted Properties Within An ASTM Designated Radius of the Subject Property 2 Rpt Dt: 1/28/03 • Search for Records of Permits for Underground or Aboveground Storage Tanks • Inspection of Historical Aerial Photographs • Preparation and Presentation of Three Reports 2.3 Limitations and Exceptions of -Assessments This ESA is based upon the information available from a variety of sources and on the inspection of the Subject Properly. The ESA was performed in accordance with industry standards and using appropriate methods. It is intended to allow a parry to make an informed decision regarding the Subject Property. Hayden Environmental is not responsible or liable for the accuracy of the information provided by others. This ESA is not a guaranty that there is no subsurface contamination, nor can it be warranted that those areas of environmental concern herein noted are the only areas of potential contamination at the Subjecf Property. There was no sampling or testing for the possible presence or absence of, nor is any definitive statement made in this ESA regarding the possible presence or absence of, any of the following: 1) Asbestos Containing Materials 2) Radon 3) Lead Based Paints 4) Lead in the Drinking Water 2.4 Limiting Conditions There were no limiting conditions with regard to the ability of Hayden Environmental to conduct the property inspection portion of this ESA. Access was made available to all parts of the Subject Property. 2.5 Previous Environmental Site Assessments/investigations Neither the Client nor Hayden Environmental are aware of any previous environmental assessments or investigations. HE103-Ill Rpt Dc 127/03 3 3 SUBJECT PROPERTY DESCRIPTION AND USE HISTORY 3.1 Site and Improvement Description The Subject Property consists of five rectangularly shaped parcels of land. It is located on the northern side of Acacia Street and the southern side of Birch Street. Orchard Drive is to the east and Mesa Drive is to the west. Irvine Avenue is to the north, and Bristol Street to the northeast. It is located to the southwest of State Highway 73 in an area that has recently been incorporated into the City of Newport Beach. The addresses are 20322, 20342 and 20352 S. W. Acacia Street and 20341 and 20351 S. W. Birch Street. The assessor's parcel numbers are 439-392-09, 439-392-08, 439-392-07, 439-381-23 and 439-381-24. The topography for the area of the Subject Property is slightly hilly, with a bluff area to the southwest. To the south is Upper Newport Bay. The elevation is approximately 55 feet above sea level. The Santa Ana Channel is to the southwest and the San Diego Creek is to the southeast. The subsurface in the general area consists of mostly silt in the consolidated Quaternary age marine and alluvial deposits, according to DMG Open -File Report 80-19 by Edward Sprottle, David Fuller, Richard Greenwood and Henry Mumm. Structure The structures on the Subject Property are residential. The majority of the buildings are wood sided with pitched roofs. The building on 20341 S.W. Birch Street is of frame and stucco construction. Landscaping The landscaping consists of trees, shrubs and groundcover, with some areas of the site covered with weedy groundcover. The plants all appeared to be in good condition. No signs of stressed vegetation were observed. No significantly stained soil was observed on the site. Utilities The utility service to the Subject Property is provided by a variety of vendors. Gas is provided by Southern California Gas Corp.; electricity by Southern California Edison, water by Irvine Ranch Water District; and sewer treatment by either septic tank or the Orange County Sanitation District. 3.2 Subject Property - Use History The structures on three of the sites, 20352 S. W. Acacia Street, 20341 and 20351 S. W. Birch Street, are currently occupied with residents, with the remaining buildings being vacant. It appeared that the uses of the vacant structures were also residential. ' HEI 03-111 Rpt Dt: 127103 ' 4 3.2.1 Past Site Uses Past uses for the Subject Property were determined by reviewing an aerial photograph in the Photo Map Book compiled by Aerial Photomaps, Inc.; and by searching building permits at the County of Orange Office of Planning & Development Services in Santa Ana, California. The aerial photograph are discussed in Section 3.4 below. The building permit files showed the following for the Subject Property addresses: 20322 S.W. Acacia Street The earliest document found for this address was dated July 12, 1959. It was issued to O. J. Johnston to connect the front building on the site to the sewer system, and to set up a septic tank for the back building. 20342 S.W. Acacia Street The earliest permit found for this address was December 6, 1957. It was issued to Ray B. Price to demolish a garage on this site. A permit, dated December 6, 1957, was issued to Ray Price to demolish a single family residence. An attached site plan showed an existing duplex and an existing single family residence on this site. 20352 S.W. Acacia Street The earliest document found for this address was dated January 2, 1968. It was a permit issued to Roy K. Walker to add a porch to an existing single family residence. I' 20341 S.W. Birch Street The earliest document found, for this address was dated December 5, 1962. It was a Certificate of Occupancy which was issued to Donald G. Holston for an addition to an existing single family residence. 20351 S.W. Birch Street The earliest document found for this address was dated January 15, 1964. It was a Certificate of Occupancy which was issued to Mr. and Mrs. H. J. Arecht for an addition to an existing single family residence. 3.3 Adjoining Properties - Use History A number of properties adjoin the Subject Property. The current uses are as follows: Northeast To the northeast of the Subject Property is a construction site. Also to the northeast, at 20321 S. W. Birch Street, is an multi -tenant office complex. Southeast To the southeast, at 20320 S.W. Birch Street, is an office building. Also to the southeast, at 20352 S.W. Birch Street, is a single family residential property. Southwest To the southwest, at 20401 and 20411 S. W. Birch, are two three story multi -tenant office buildings. HEI 03-111 RpIDt IM/03 5 Northwest To the,west, at 20351 S.W. Acacia Street, is an office building. Nothing was observed in any of these properties that is of environmental concern to the Subject Property. 3.3.1 Adjoining Properties - Past Uses Prior uses for the properties discussed above were determined by reviewing aerial photographs in the Photo Map Book compiled by Aerial Photomaps, Inc.; and from the Newport Beach, California USGS Topographic Map. The aerial photograph showed the adjoining properties to be residential of undeveloped. The aerial photographs and USGS Map are discussed in more detail in Section 3.4. 3.4 Historical Aerial Photograph and USGS Map Analysis Historic aerial photographs are examined in order to determine what may have existed on a site prior to the construction of the existing buildings. The aerial photographs were examined in the Photo Map Book compiled by Aerial Photomaps, Inc. The photos is described below. A photograph taken in 1964 (Map Page 28 SW) showed the parcels that constitute the Subject Property to be developed with what appeared to be small residential buildings. The adjoining property,to the northwest was undeveloped, with no evidence of recent activity. The adjoining properties are shown to be developed with what appeared to be a single family residential structures. In the area, much of the area to the northeast, east and southeast were developed with residential properties. The area to the north and west, where the golf course is now, was undeveloped. An airport was observed to the northeast. The land around ,the airport was mostly undeveloped, with some industrial buildings to the southeast of the runways. USGS Map Analysis The 7.5 Minute United States Geological Service Topographic Map for the Subject Property is named the Newport Beach, California map. The map, which was laid out in 1965, showed no individual structures on the Subject Property or on the adjoining properties. No industrial buildings were shown in the area. The map was photorevised in 1981. The revised map showed no individual structures on the Subject Property, on any of the adjoining properties or in the general area. Newer industrial buildings were showed to the northeast, to the northeast of Palisades Road (newer buildings are shown in purple in the revised map). A portion of the Newport Beach map is reproduced in Appendix B. HE103-111 Rpt Dt 1/28/03 4 RECORDS SEARCH 4.1 Regulatory Agencies Database Search The following Federal, State of California and local government agency databases and sources were searched for postings within designated radii of the Subject Property: FEDERAL SOURCES • National Priority List (NPL) Within 1.0 Mile • Comprehensive Environmental Response Compensation and Liability Information System (CERCLIS) Within 1/2 Mile • RCRA Treatment Storage and Disposal Facilities (TSD) Within 1.0 Mile • RCRA Corrective Action Sites (CORRACTS) Within 1.0 Mile • RCRA Hazardous Waste Generator (RCRAGN) Within 1/8 Mile • Emergency Response Notification System for Spills (ERNS) Within 1/8 Mile STATE OF CALIFORNIA AND LOCAL GOVERERNMENT SOURCES • California EPA Sites (Cal -Sites) Within 1.0 Mile • Solid Waste Landfills (SWL) Within 1.0 Mile • Leaking Underground Storage Tanks (LUST) Within 1/2 Mile • Hazardous Substance Storage Containers (UST/AST) Within 1/8 Mile • Unique County Databases (Permits/Other) Within 1/4 Mile • State Spills (Spills) Within 1/8 Miles A compilation of the databases is included in Appendix D. SUBJECT PROPERTY The Subject Property is not posted onto databases. HE103.111 Rpt Dt. 1/27/03 7 ADJOINING PROPERTY POSTINGS None of the adjoining properties are posted onto databases. NEARBY PROPERTY POSTINGS No sites within 1/8 of a mile are posted onto databases. OTHER PROPERTY POSTINGS The Subject Property is located in a mixed use area with t residential, office and commercial properties. It is to be expected that few facilities within ASTM designated distances would be posted onto one or more databases. Sites of note include: ' • A site 0.34 miles to the northeast, at 2100 Bristol Street, is posted onto the LUST list. The occupant is shown to be Arco # 192. The posting states that only the soil was affected by an unauthorized release of gasoline. The Status is given as "Leak Being Confirmed". In that only ' the soil was affected and given that this site is not proximal, it is not likely that the unauthorized release on this site would have affected the environmental condition of the Subject Property. • A site 0.36 miles to the northeast, at 2152 Bristol Street, is posted onto the LUST list. The occupant is shown to be Dollar Rent-A-Car. The posting states that only the soil was affected by an unauthorized release of gasoline. The Status is given as "Leak Being Confirmed". In that only the soil was affected and given that this site is not proximal, it is not likely that the unauthorized release on this site would have affected the environmental condition of the Subject Property. • A site 0.37 miles to the northeast, at 3510 Irvine Avenue, is posted onto the LUST list. The occupant is shown to be Alamo Rent -a -Car. The posting states that only the soil was affected by an unauthorized release of gasoline. The Status is given as "Case Closed" as of November 27, 1995. In that the case has been closed, it is not likely that the unauthorized release on this site would have affected the environmental condition of the Subject Property. • A site 0.38 miles to the northeast, at 2222 Bristol Street, is posted onto the LUST list. The occupant is shown to be National Car Rental. The posting indicates that groundwater was affected by an unauthorized release of gasoline. The Status is given as "Case Closed" as of September 8, 1997. In that the case has been closed, it is not.likely that the unauthorized release on this site would have affected the environmental condition of the Subject Property. • A site 0.39 miles to the northeast, at 2122 Bristol Street, is posted onto the LUST list. The occupant is shown to be Exxon Service Station #0769. The posting indicates that groundwater was affected by an unauthorized release of gasoline. The Status is given as "Case Closed" as of March 1, 2001. In that the case has been closed, it is not likely that the unauthorized release on this site would have affected the environmental condition of the Subject Property. • A site 0.46 miles to the northeast, at 2121 Bristol Street, is posted onto the LUST list. The occupant is shown to be Chevron #20-2016. The posting states that only the soil was affected by an unauthorized release of gasoline. The Status is given as "Leak Being Confirmed". In that only the soil was affected and given that this site is not proximal, it is not likely that the HEI 03-I l 1 N Rpt Dt: 127/03 L� unauthorized release on this site would have affected the environmental condition of the Subject Property. There is no indication that any of the posted sites have affected the environmental condition of the Subject Property. There is no know regional groundwater impact in the area. 4.2 Regional Source 4.2.1 Regional Water Quality Control Board The Santa Ana Regional Water Quality Control Board (Water Board) maintains a list of sites with leaking underground storage tanks (LUST) and sites posted onto the Well Investigation Program (WIP). Ms. Annette Subriar, the List Manager with the Regional Board, did not find any of the Subject Property addresses on either of the lists. 4.3 County Sources 4.3.1 Orange County Integrated Waste Management In Orange County, the Integrated Waste Management Department is the agency responsible for citing and monitoring landfills for solid waste management in the county. IWM, along with the Orange County Health Care Agency, assembled a list in 1993 of county, city and privately operated active and inactive landfills and transfer stations throughout the county. There are no landfills within one mile of the Subject Property. The closest is Newport Avenue 41 landfill, which is said to be to the northwest at the Newport Freeway and Bristol Street. 4.3.2 Orange County Planning & Development Services In Orange County, Planning & Development Services is the repository of permits taken out on properties in the unincorporated areas of Orange County. Its records were sought with the assistance of Cindy Ramirez, an Office Specialist. The building permit files showed the following for the Subject Property addresses: 20322 S.W. Acacia Street The earliest document found for this address was dated July 12, 1959. It was issued to O. J. Johnston to connect the front building on the site to the sewer system, and to set up a septic tank for the back building. 20342 S.W. Walker to add a porch to an existing single family ' residence. 20341 S.W. Birch Street The earliest document found for this address was dated December 5, ' 1962. It was a Certificate of Occupancy which was issued to Donald G. Holston for an addition to an existing single family residence. ' 20351 S.W. Birch Street The earliest document found for this address was dated January 15, 1964. It was a Certificate of Occupancy which was issued to Mr. and Mrs. H. J. Arecht for an addition to an existing single family residence. ' Copies of the documents discussed above can be seen in Appendix E. 4.3.3 Orange County Fire Department The unincorporated area uses the Orange County Fire Authority (OCFA) for ,fire protection ' services. According to a spokeswoman for the OCFA, all environmental matters are referred to the Orange County Health Care Agency. The representative stated that the OCFA's only responsibilities in this area are to send an inspector when USTs are being removed and to respond when a hazardous materials spill endangers human health. In both these cases, all reports are submitted to the HCA for inclusion into that agency's files. 4.3.4 Orange County Health Care Agency (HCA) ' In Orange County, the Health Care Agency (HCA) is the repository of many items pertaining to the environment for the Subject Property. DHS is responsible for inspecting facilities that use or store hazardous materials, for supervising remediation of sites in the county and investigating spills, ' releases or illegal dumping of hazardous materials. A request for information was submitted to this agency for 811 North Broadway. William J. Strachan, Custodian of Records for the HCA, has not yet responded to a request for information. 4.3.5 Orange County Sanitation District The Orange County Sanitation District (OCSD) treats sewage generated in a large portion of the county, including the City of Santa Ana. The district also issues and monitors industrial wastewater discharge permits. Jim Benzie, Source Control Supervisor with OCSD, did not find any files for these properties. HEI 03-111 Rpt DC 128/03 10 1 5 SUBJECT PROPERTY INSPECTION The Subject Property was visited on January 21, 2003 by Chris Hayden, R.E.A. The purpose of the site visit is to seek out and to report on visible environmental concerns, or to note use and storage of hazardous materials which could effect the environment condition of the Subject Property. 5.1 Use and Storage of Hazardous Materials at the Subject Property The Subject Property consists of five contiguous residential properties on Acacia Street and Birch Street. All are residential properties. Containers of what appeared to be hazardous wastes were observed on two of the parcels. On 20342 S.W. Acacia Street, several five gallon containers of what appeared to be waste oil were observed in the northwestern portion on this site, as can be seen in Photographs 3 and 4 in Appendix C. On the second property, at 20352 S.W. Acacia Street, two five gallon containers were observed to the east of the garage building on this site. In the southeastern portion of this site, a pile of debris was observed, as can be seen in the lower right portion of Photograph 6. Observed in the pile were construction debris. No containers of hazardous materials or hazardous wastes were observed in this pile. A storage shed was observed on the northeastern portion of 20351 S. W. Birch Street. Observed in this shed were two 2 1/2 gallon containers of hydraulic fluid. 5.2 Indications of PCBs There is no indication that polychlorinated biphenyls (PCBs) were used or stored at the Subject Property. A pole mounted transformer was observed on the 20352 S. W. Acacia Street portion of the site. It was not leaking, and no evidence of past leaks were observed, This transformer would be the property of Southern California Edison. 5.3 Indications of Solid Waste Disposal Solid wastes generated on the residential property with the addresses 20322 S.W. Acacia Street are placed into trash cans and are removed from the site by a private vendor. Solid wastes generated on the two single residential properties with the addresses 20341 and 20351 S.W. Birch Street are placed into trash cans and are removed from the site by a private vendor. There is also a dumpster on 20341 S.W. Birch Street which is provided and serviced by CR &R. HE103.111 Rpt DC 1/27/03 11 5.4 Indications of Hazardous Waste Disposal Containers of hazardous wastes were observed on the 20342 S.W. Acacia Street portion of the Subject Property on the date of the inspection. These included what appeared to be waste oil and other unidentified materials. The hazardous wastes stored on the site should be removed as soon as possible. 5.5 Indications of Asbestos Containing Materials (ACMs) Given the age of the buildings on the Subject Property, it is possible that ACMs were used in their construction. ACM manufacture was phased out in the 1970s, and halted altogether in 1979. Should a remodel or demolition be planned, the materials to be removed should be tested. If ACMs are discovered, the following recommendations should be adhered to: • Notify Contractors and Subcontractors working in the building. • Use a certified and licensed asbestos abatement contractor to perform any removal of ACM prior to any demolition activity that will disturb the materials. • Implement an Asbestos operations and Maintenance (O & M) Program to manage in -place ACM. I HE103-111 12 Rpt Dt: 1/27/03 1 6 INTERVIEW An important part of any Phase 1 is interviews with individuals having knowledge of the facilities and the operations at the property being assessed. For this ESA, Cindy Ramirez, Office Specialist with the County of Orange Planning & Development Services, was questioned regarding the building pennits that have been issued on the addresses that constitute the Subject Property. HE103-I11 13 Rpt Dt 1/27/03 7 FINDINGS AND CONCLUSIONS Prior to arriving at these conclusions, the following tasks were completed: • The Subject Property was inspected • The surrounding properties• were observed • A historical aerial photograph was examined • Information was requested from various governmental and regulatory agencies for environmental information pertaining to the Subject Property • The databases from state and federal regulatory agencies were examined The Environmental Site Assessment on the five contiguous residential properties located at 20322, 20342 and 20352 S. W. Acacia Street and 20341 and 20351 S. W. The SWAT Program began in 1984. In 1984, legislature was passed requiring testing of 'water and air media at all solid waste disposal sites. The law required SWRCB to rank all solid waste disposal sites in groups of 150 each, according to the threat the may pose on water quality. The law required the operators of each of the 150 sites in a given rank to submit a water quality "solid waste 'assessment test" (SWAT) report. Rank groups 1-5 consisted of 750 sites of which 562 submitted a SWAT Report or exemption questionnaire (undetermined leak status). Sites in ranks 1 - 5 contain some detailed information, whereas, sites in ranks 6 and beyond generally do not, therefor per the suggestion of the WRCB sites in ranks 1 - 5 were integrated with the First Search database. The SWAT Program ran from 1985 - 1995. • Notes Regarding TPCA (Formerly referred to as Toxic Pits) From. 1984 - 1991 the State Water Resources Control Board maintained a list of sites referred to as having Toxic Pits containing hazardous substances. Generally these sites were factories and refineries. • Notes Regarding SC 15 (Formerly referred to as Sub Chapter 15) 'Subchapter 15 now referred to as Chapter 15 is the current regulatory program enforced by the Water Resources Control Board regarding landfills, surface impoundment's, and other sites. The WRCB maintains a database Chapter 15 to track these facilities. The Chapter 15 Program is part of the Core Regulatory 'Program for waste treatment, storage, or disposal sites. Statute specifically requires the State Water Resources Control Board to develop regulations to "ensure adequate protection of water quality and statewide uniformity in the siting, operation, and closure of waste discharge sites." These regulations 'are found in California Code of Regulations [CCR) Title 27 [solid waste, including mining waste] and CCR Title 23, Division 3, Chapter 15 [hazardous waste]. The regulations establish a classification system for waste and disposal sites and include requirements for siting, construction, operation, 'monitoring and cleanup, and closure. Program functions include issuance and amendment of waste discharge requirements, inspections to determine compliance, review of dischargers' self -monitoring reports, review of other technical reports, review of closure plans, and informal and formal enforcement actions. There were many outstanding "full service" environmental firms in Southern California. Very few, however, specialized in performing Phase 1 Environmental Site Assessments (ESAs). For many firms, the ESA was and is approached as a way of positioning themselves to get any additional work recommended therein. This has led many to recognize the inherent conflict of interest that this represents. Hayden Environmental eliminates this potential conflict in that no other environmental services are offered. Hayden Environmental recognizes the importance of an ESA. The company was formed with the expressed purpose of providing the best, most complete, most thoroughly researched report available. At Hayden Environmental, our fees are always competitive. Also, because we are not in the business of conducting Site Investigations (Phase 2s), there is no undue incentive to recommend them. Our assessments are grounded in.a solid understanding of the primary function of an ESA. Liability for environmental contamination can be expensive and time consuming in the extreme. While there is no guaranty that it will, an ESA is designed to allow a party coming into possession of real property, either as a tenant, buyer or lender forced to foreclose, to avail themselves of the "innocent landowner" defense. ESAs can also be a very valuable tool for an owner or tenant to establish a baseline condition of a property prior to the commencement of a lease. Hayden Environmental has researched the law and has a complete understanding of the appropriate inquiry needed to utilize this defense. Additionally, Hayden Environmental adheres to the standards for environmental assessments promulgated by the ASTM Designation E 1527-94. All Hayden Environmental Phase I assessments will include these five basic components: • Subject Property Inspection and Surrounding Property Observation • Federal and State Environmental Database Review • County and/or Local Government Record Review • Historical Aerial Photograph Review • Interview With a Party Having Knowledge of the Subject Property As a service to our clients, Hayden Environmental can recommend a competent environmental engineering firm to conduct a Site Investigation. The function of an investigation is to determine first, if there is any soil or groundwater impact from unauthorized releases of hazardous materials. Then, if an impact is discovered, the nature and extent of the impact is determined. Hayden Environmental is fully insured, with a policy coverage of $1,000,000. for Professional Liability and $1,000,000. for General Liability. i� CHRISTOPHER M. HAYDEN Chris Hayden, R.E.A., has been in the environmental field since 1991. He began with a large multinational firm as the regional representative for Western U.S. He dealt primarily with firms in the energy and real estate development fields. Seeking to broaden his "hands on" experience, he began working with a local fern in 1992. While there, he had the opportunity to work on a variety of projects, including environmental site assessments and site investigations. Seeing the need for a firm that specialized in conducting reliable, thorough and professional environmental site assessments while avoiding potential conflicts of interest, he formed Hayden Environmental, Inc. in 1992, In 1993, Hayden earned the designation of Registered Environmental Assessor (R.E.A.) from the California Environmental Protection Agency. Mr. Hayden also served on the ASTM E50 Committee which reviews, revises and enforces the standards for environmental assessments promulgated by the ASTM Designation E 1527-00. Prior to 1991, Hayden had been in the real estate industry for the twelve years. He worked most recently as an industrial real estate broker with Grubb & Ellis in Newport Beach, California. Hayden has a Bachelors of Arts in Biology from Humboldt State University in Arcata, California.
