The Planning Department, on March 13, 1996, approved the application subject to the following conditions: 1. That development shall be in substantial conformance with the approved floor plans except as noted in the following conditions. 2. That the outdoor dining shall be limited to a maximum of 532 sq.ft. (25 percent of the approved net public area of 2,129 sq.ft., Use Permit No. 3095). Any further increase in the outdoor dining area shall be subject to the approval of a use permit. 3. That the perimeter wall shown on the plot plan is not approved in conjunction with this application; and that any perimeter wall around the outdoor dining area shall be subject to the approval of a modification by the Modification Committee for encroachments into the required front yard setback, the approval of the Public Works Department for conformance with City Standard 110-L for sight distance, and shall be subject to the approval of an encroachment agreement and related permit for the placement of such wall within the area for proposed future widening of West Coast E-1iighway. 4. That the improvements specifically relating to this outdoor dining area (i.e.: flatwork, tables, etc.) shall be subject to the approval of an encroachment agreement and related permit for the placement of said improvements within the area for the proposed future widening of West Coast Rghway. 3300 Newport Boulevard, Newport Beach March 15,1996 Page - 2 5. That in the event of the relocation of the existing pole sign, said sign shall be reconstructed in accordance with the provisions of Encroachment Agreement Document No. 88-449446, unless otherwise approved by the Public Works Department. 6. That no outside paging system shall be utilized in conjunction with the use of the outdoor dining patio. 7. That should this business be sold or otherwise come under different ownership, any future owners or assignees shall be notified of the conditions of this approval by either the current owner or the leasing company. S. That the Planning Department may add to or modify conditions of approval to this outdoor dining permit, or recommend to the Planning Commission or City Council the revocation of this permit upon a determination that the operation which is the subject of this approval causes injury, or is detrimental to the health, safety, peace, morals, comfort, or general welfare of the community. 9. That all applicable conditions of approval for Use Permit No. 3095 shall remain in effect. The Planning Department determined in this case that the proposal would not be detrimental to persons, property or improvements in the neighborhood and that the specialty food services permit as approved would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code, and made the following findings: 1. That the proposed outdoor dining is consistent with the Land Use Element and the Local Coastal Program of the General Plan, and is compatible with the surrounding land uses. 2. That the approval of Outdoor Dining Permit No. 6 will not, under the circumstances of this case, be detrimental to the health, safety, peace, morals, comfort, and general welfare of the City. NOTE: This approval shall expire unless exercised within 24 months from the end of the appeal period, and cannot be extended. The decision of the Planning 'Department may be appealed by the applicant to the Planning Commission within 14 days of the date of the decision.
