Having reviewed all of the sections of the Municipal Code pertaining to your problem, I have been able to convince Mr. Hogan that sufficient latitude exists within the Zoning Code to allow you to construct the breeze -way attachment without the need for a Modiffcation Permit from the City. If it is still your desire to construct the garage in this manner, all we require is two copies of the original plans which will be substituted for the plans currently on file. No additional plan check or plan check fees will be required. If you have any questions regarding this matter or if I can be of any further assistance, please let me know. In the course of our lending operations many times the property is older and in doom -zoned areas. There is an insurance available that will help us recapture some of our loss in down -zoned areas. To help us decide when to require this insurance we need to know your city's policy regarding re -building, say for example, 20 units where now only 15 units can be built and what percentage must be destroyed before the building would have to be re -built under the later doom -zoned density. Ny residence is a one story home with a generally flat roof, eleven feet high above the ground slab, on a 35' x 800 lot size(approx) to a 201 paved alley; Powerlines run the length of the alley, about 400 high on the side opposite our property. I plan to install a steel tower, either on top of the flat roof at about the center of the house directly over a vertical bear- ing support, or on the ground level close to the alley as shown on the enclosed sketch. The height of the tower above ground to be 60-65 feet. The reason for this required height is two fold: (1) radio engineering requires that transmitting antennas be not less then 201 higher than the adjacent power lines to prevent substantial absorption of the radiated radio energy; (2) the proximity of the adjoining cliff and hill area of the Banning Oil Leqse with a elevated height of 40-60 feet acts as a shield against radiated radio waves in a northerly and easterly direction for major communication. The steel tower I have in mind is of the crank -up and crank - down type, guyed or fastened at the lower section with the upper part(cranked-up) free standing. The tower is composed of 201 sections, each of which telescopes into each other, During . operation of the station, primarily at night, the tower would be cranked-up':t When not in use, and definitely during Santana wind storms, the tower would be cranked -down to one 2Q' section with appendages extending upward to approximately 25-27' if tower is mounted on the ground or 36-381 if tower is erected on the roof. Any radio interference with TV or broadcast radio in the Newport Shores area would be corrected by me. This requirement is amply covered by POO Regulation 97.131 under which an amateur radio license is granted:, The height of the tower complies with FCC regulation 97.45 Request is made that I be given letter approval to erect this antenna. The enclosed NOTICE OF PUBLIC HEARING is an example. What the Coastal Commission is doing holding a hearing on such a routine matter I cannot imagine. A house on our street burned (3 months or more ago) and there it sits, a hazardous structure to the neighborhood. It should have been and would have been demolished long ago, but instead the homeowner had to go through this nonsense with your agency. I protest heartily, as I do to your hearings on any remodels in an area like Balboa Island. This residential area has its own unique charm, and in fact that uniqueness (including parking on the street) is the reason people buy here. We don't want Balboa Island to look or feel like Lido Island. We think Newport Beach is quite capable of reflecting our needs and a good examole'is t he pressure brought to bear by the Balboa Island Improvement Assn. in changing the zoning concerning duplexes on the Island. Your requirement for three parking spaces on a 30 foot lot is ridiculous, given the nature of the area you are working with. If I have a chance to vote again on the Coastal Commission, this time I would vote NO, despite some of the worthwhile things the reality accomplished. As you know, this type of club is relatively new. Even with all the pre -planning by our staff and consultants, some deficiencies have been pointed out by our new members. The major requests have been for a swimming pool, running track and a food service facility. We have developed schemes for a swimming pool and running track. When we reviewed the schemes it became evident that we needed to create a different environment from these areas in order to produce a truly relaxing transformation from the work atmosphere. We have accomplished this transformation by using many large trees to screen the area from adjoining areas and streets. The plans are in process using suggestions that you forwarded. We hope to have the drawings completed in the near future for your review. The need for food service has been expressed by many members, and after much study, we agree that this is a necessary addition to our club. For members who workout at 6 A.M., there is little time left to drive to another location for breakfast before going to their place of business. The same inconvenience is created during the lunch period from 11 A.M. to 2 P.M. for members who workout and have lunch. After talking to members, we have also come to the conclusion that evening meals are desirable for families and young adults attending the club at that time. Purcell 210 Poinsettia Avenue Corona del Mar, Ca. 92625 RE: 210 Poinsettia Avenue Dear Mrs. Purcell: I appreciate the opportunity to meet with you and review first hand the structures located at 210 Poinsettia. The department has had the opportunity to evaluate the information gathered at this meeting as well as review the plans which were submitted. It is unfortunate that work proceeded•on your project prior to the obtaining -of a building permit or approvals for the work. It appears that a number of problems have been created by this action. As you know, your property is zoned R-1. The setback requirements are 20 ft. from Poinsettia, 5 ft. from the alley on the right side, 5 feet from the alley on the rear, and 4 feet from the property line on the left side. Our calculations reveal that your existing dwelling plus the detached structure contain approximately 2,000 sq. ft. This requires that you provide a minimum of two legal parking spaces (9 ft. by 20 ft.1 One of these spaces must be covered. The other space may be an open space which would be permitted to extend into one sideyard setback. More details of these requirements may be obtained from Mr. Hetivicker of our Planning Division. The plans which were submitted for plan check are not adequate to provide the necessary information to allow the department to perform -a thorough plan check or issue a permit. I am attaching a sheet indicating the department's minimum standards for preparation of plans. If you are not experienced in preparing plans it may be that you will have to obtain help from a profes- sional. Our review of the present plans along with the inspection conducted at the site has revealed some deficiencies which should be,pointed out at this time. If you intend to proceed with your plans of converting your existing garage to habitable area and constructing new parking areas as outlined above, the following corrections must be made: ' Mrs. Janet A. Purcell RE: 210 Poinsettia Avenue Page 2 1. Remove the garage door and frame in a wall with 2x4 studs at 16" o.c. This new wall must have a foundation 15" wide and 18" into natural.grade. A curb should be installed in order that all wood is a minimum of 6 inches above grade (foundation may be existing -,it can be exposed for the inspector's verifi- cation). 2.- Fully dimension all new doors and windows and show header sizes. 3. Provide a minimum 3 sq. ft. window in the bathroom or provide an exhaust fan ducted to the outside. 4. Provide a minimum of 40 sq. ft. in window area in the converted garage space. One-half of this must be openable. 5. Glass doors adjacent to the proposed carport must be sealed shut. 6. Provide new electrical outlets along all walls. Maximum distance between outlets must not exceed 12 feet. 7. Provide a heating unit capable of maintaining 70 degrees at 3 feet above the floor of, all habitable rooms. 8. Specify interior finishes of wall in the converted garage area. 9. Remove fences or other structures from the five foot rear alley setback area.(all new construction must observe the required setbacks). 10. Show the exact square footage of each building on the plans. 11. It will be necessary to pay the plan check fee prior to any additional review of plans. Due to the fact that the proposed carport projects almost two feet into a required sideyard, the department has made no effort to evaluate this structure as proposed. When adequate plans are prepared, additional corrections may become evident. I am sure that you are presently aware that construction without a permit is a violation of the Newport Beach Municipal ordinance with possible penalties of $500 or six months imprisonment, or both. The measurement may be taken from the highest adjoining sidewalk or ground surface within a 5-foot horizontal distance of the exterior wall of the building, when such sidewalk or ground surface is not more than 10 feet above grade. The height of a stepped or terraced building is the maximum height of any segment of the building. HELIPORT. A heliport is an area of land or water or a structural sur- face which is used, or intended for use, for the landing and takeoff of helicopters, and any appurtenant areas which are used, or intended for use, for heliport buildings and other heliport facilities. HF.LISTOP. A helistop is the same as a heliport, except that no refuel- ing, maintenance, repairs or storage of helicopters is permitted. HORIZONTAL EXIT. See Section 3301 (c). HOTEL is any building containing six or more guest rooms intended or designed to be used, or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes by guests. LOADS. See Chapter 23. LODGING HOUSE is any building or portion thereof, containing not more than five guest rooms which are used by not more than five guests 42 1976 EDITION 413-416 where rent is paid in money, goods, labor or otherwise. A lodging house shall comply with all the requirements of this Code for dwellings. M Sec. 414. MARQUEE is a permanent roofed structure attached to and supported by the building and projecting over public property. Marquees are regulated in Chapter 45. MASONRY is that form of construction composed of stone, brick, con- crete, gypsum, hollow clay tile, concrete block or tile, or other similar building units or materials or combination of these materials laid up unit by unit and set in mortar. MASONRY, SOLID, is masonry of solid units built without hollow spaces. CODE is the Uniform MEZZANINE or MEZZANINE FLOOR is an intermediate floor placed in any story or room. When the total area of any such "Mezzanine Floor" exceeds 33'h percent of the total floor area in that room, it shall be considered as constituting an additional "Story." NONCOMBUSTIBLE as applied to building construction material means a material which, in the form in which it is used, is either one of the following: 1. Material of which no part will ignite and burn when subjected to fire. Any material conforming to U.B.C. Standard No. 4-1 shall be considered noncombustible within the meaning of this Section. 2. Material having a structural base of noncombustible material as S defined in Item No. 1 above, with a surfacing material not over % inch thick which has a flame -spread rating of 50 or less. "Noncombustible" does not apply to surface finish materials. Material i required to be noncombustible for reduced clearances to flues, heating ap- pliances, or other sources of high temperature shall refer to material con- forming to Item No. 1. No material shall be classed as noncombustible which is subject to increase in combustibility or flame -spread rating ' beyond the limits herein established, through the effects of age, moisture or other atmospheric condition. I have discussed this ordinance with Mr. Darnell, Mr. O'Neil, and Mr. Hogan as well as independent traffic engineers and lawyers - so that all ques- tions could be addressed by our group.. We are making as many changes as we can to simplify the implementation but still main- tain the basic intent of the ordinance. Now you know where we are - this is what we think: 1. The best way to answer the problem is for a cooperative ef- fort-io—be made on all sides - with all the knowl-CAge that we have recently gained - but with a firm committment by the City to assure that the necessary time will be taken to reach a real solution.. 2. The only way to assure us that t1ais would be so is to enact an "urgency ordinance" or moratorium - and to do so prior to the February General Plan hearings. Without that assurance, we will feel that any implied phasing or density changes are virtually meaningless. 3. An ordinance by initiative is not the best way to answer the problem but, if it is the only way to insure a tangible, real solution, then it is what we feel we must do.
