although there were no prob ms with the resub-

there were concerns in connects n with the pro-
posed redevelopment and interpre tion of the Code
relative to offstreet parking. He eviewed the
proposed redevelopment and advised t t due to the
fact that the building was being expan ed in
excess of 10%, the Planning Commission s ould

Bay Channel and The Cove.

Application
This application is a request to obtain Planning Commission approval
for a 34 foot high flag pole on the Newport Marina Apartment site on
Bayside Drive. In accordance with Section 20.02.060 of the Newport
Beach Municipal Code, flagpoles shall be permitted in excess of height
limits, subject to the approval of the Planning Commission.
Environmental Significance
This project has been reviewed, and it has been determined that it
is categorically exempt under Class II (Accessory Structures) from
the provisions of the California Environmental Quality Act.
Conformance with General Plan
The Land Use and Residential Growth Elements of the General Plan
designate the site for Multiple -Family Residential development. The
apartment use on the site conforms with the land use designation.
The General Plan does not address the question of flag pole heights.
Subject Property and Surrounding Land Use
A sixty-four unit apartment complex has been developed on the site.
To the north, across Bayside Drive is the Bayside Shopping Center
and the Gorda Liz restaurant; to the east is The Cove condominium
project; to the south is the Balboa Island Channel; and to the west
is the Promontory Bay Channel.
Background
The applicant proposes to erect a 34 foot high flag pole on the
Balboa Island Channel side of the apartment complex. The pole would
be located mid -way between the westerly side of the occupied apart-
ments and the easterly side of the project on the sand area behind
the bulkhead. Inasmuch as the sand area is about 4 feet lower than
the rest of the site, the pole will extend approximately 2 feet
above the roof of the existing apartment buildings. A pole which
meets the required height limit would be approximately 4 feet lower
than the adjoining structures.

Recommendation
Staff is of the opinion that the pole will compliment the residential
development and will not be out of proportion to the adjoining struc-
tures. Further, the pole will only be about two feet higher than a
conforming pole if it were located on the same grade as the apartment
structures. The approval of the applicant's request is recommended
subject to the following condition:
1. That development be in substantial conformance with the plans
as submitted.

We recently applied for a building permit to install a 34 foot flag-
pole at the Newport Marina Apartments located at 919 Bayside Drive
in the City of Newport Beach. (see attached plot plan)
The flagpole is intended to be installed between the bulkhead and
the apartments that face the new boat slips which have just been com-
pleted.
We were recently informed that the maximum approved height for a
flagpole in this area is 28 feet. Since this pole would be located
about'4 foot below the ground level of the apartment buildings, the
tip of the pole would be below the second floor roof line.and would
not be a very effective display for the flag.
We would appreciate your review and approval of the installation
of a 34 foot pole at your June 3, 1976 Planning Commission meeting.
The intended pole is the size, type and height of the flagpole in-
stalled in front of the Newport Beach Police Station on Santa Barbara.
