REQUEST FOR PERMIT FOR TEMPORARY USE (TYPE 1)
It is requested that a Temporary Use Permit be granted to Gelson's Market for
the installation of approximately 600 sq. ft. of storage and office for the period
October 15, 1997 through January 10, 1998. Two temporary structures will be
installed in the truck loading area at the rear of the Gelson's Market. One of
these structures will a 8' X 40' standard Gelson's trailer that will' be used to
provide additional storage of dry goods and similar material to be sold during the
holiday season. This trailer is required because of the lack of available storage
space within the market. The other temporary facility will be 10' X 20" field office
that will be used as assembly place and materials storage for the making of gift
baskets to be sold at the market during the holiday season. This field office will
be provided with temporary power installed in a manner consistent with the
requirements of the National Electric Code and City of Newport Beach
construction requirements. Power lines from the existing structure to the field
office will be installed so as not to be a visual detraction.
The locations of the temporary facilities are shown in red on the accompanying
drawing.
Approximately 4 employees will occupy the field office during normal store
working hours. Parking for these additional employees will be in the leased lot
approximately 600 yards from the site. There will be no increased parking
requirements on the Center parking lot.
This request is separate from the submitted request for parking variance to
construct a storage building to replace the existing storage trailer shown on the
drawing.
Assuming this temporary permit and the variance are granted the removal of the
existing trailer and construction of the new storage building will commence within
two weeks following the removal of the temporary facilities requested by this
Application (weather permitting).

Subject: Temporary use of two trailers for commercial use.

Dear Mr. Roulette:
The Planning Commission at its meeting of October 23, 1997, concurred with the
recommendation of staff approving the temporary placement of a 320 sq.ft. storage trailer and a
200 sq.ft. office trailer for a period not to exceed 90 days. The time period will be from the date
of issuance of a certificate of occupancy or final of the building permits by the Building
Department and the Fire Department. The storage trailer will house inventory items which are to
be assembled in the office trailer in conjunction with holiday gift baskets. The placement will be
from approximately October 24, 1997 to January 22, 1998. Said use .shall be subject to the
following conditions of approval:
1. That a building permit shall be obtained from the Building Department and the appropriate
clean-up deposit shall be posted to insure maintenance and clean-up of the subject property
after removal of the temporary trailers. The applicant shall also obtain approval of the site
plan for the location of the trailers from the City Traffic Engineer prior to the issuance of the
building permit and installation of the temporary trailers.
2. That all employees shall park on -site.
3. That all patrons and vendors making deliveries shall be directed to park within the subject
property and not along the public right-of-way on Pacific View Drive.
4. That no temporary A -frame or other similar temporary signs shall be utilized either on -site or
off -site to advertise the subject temporary use.
5. That outdoor storage of inventory or other items will not be permitted at any time.

violation of any of the above conditions of approval or upon receipt of unresolved
complaints.

Background and Analysis
For the past several years, Gelson's Market has utilized vacant tenant space in the shopping
center to accommodate the assembling of holiday gift baskets. However, the shopping center has
no vacant tenant space and the applicant wishes to utilize two temporary trailers. The applicant
has provided the attached letter and plot plan describing the request.
Staff has no objection to the temporary use of the trailers for the following reasons:
• The trailers will house the assembly and storage of inventory for a short term need (holiday
season).
• The finished gift baskets will be placed in Gelson's Market for retail sale.
• Patrons will not enter the trailers but will order from within the market.
• The employees who will assemble the baskets will park in the shopping center parking lot.
• Staff has limited the duration of use of the trailers to 90 days as allowed by the Municipal
Code.

approximately October 24, 1997 to January 22, 1998. Said use will be subject to the following
conditions of approval:
That a building permit shall be obtained from the Building Department and the appropriate
clean-up deposit shall be posted to insure maintenance and clean-up of the subject property
after removal of the temporary trailers. The applicant shall also obtain approval of the site
plan for the location of the trailers from the City Traffic Engineer prior to the issuance of the
building permit and installation of the temporary trailers.
2. That all employees shall park on -site.
3. That all patrons and vendors making deliveries shall be directed to park within the subject
property and not along the public right-of-way on Pacific View Drive.
4. That no temporary A -frame or other similar temporary signs shall be utilized either on -site or
off -site to advertise the subject temporary use.
5. That this temporary use shall terminate upon evidence that the facility is operating in
violation of any of the above conditions of approval or upon receipt of unresolved
complaints.
6. That the trailers shall be allowed for a period not exceed 90 days from the day of installation
(final of the building permit), after which they will be removed. This approval cannot be
extended.

APPENDIX
Background and Analysis
For the past several years, Gelson's Market has utilized vacant tenant space in the shopping
center to accommodate the assembling of holiday gift baskets. However, the shopping center has
no vacant tenant space and the applicant wishes to utilize two temporary trailers. The applicant
has provided the attached letter and plot plan describing the request.
Staff has no objection to the temporary use of the trailers for the following reasons:
• The trailers will house the assembly and storage of inventory for a short term need (holiday
season).
• The finished gift baskets will be placed in Gelson's Market for retail sale.
• Patrons will not enter the trailers but will order from within the market.
• The employees who will assemble the baskets will park in the shopping center parking lot.
• Staff has limited the duration of use of the trailers to 90 days as allowed by the Municipal
Code.

This request is separate from the submitted request for parking variance to

Assuming this temporary permit and the variance are granted the removal of the
existing trailer and construction of the new storage building will commence within
two weeks following the removal of the temporary facilities requested by this
Application (weather permitting).
