SUBJECT: #7 Upper Newport Plaza (SJHTC Fee)
DATE: February 25, 1986
Departmental investigation reveals that Permit No. 4986 for #7 Upper
Newport Plaza was issued on, January 6, 1986 without collecting the
San Joaquin Hills Transportation Corridor Fee of $17,212.00.
Collection was missed because plans were approved and ready to be
issued on November 26, 1985; SJHTC Fee became effective December
12, 7985 and the Building Permit was subsequently issued January
6, 1986 without noticing that an additional _fee was due. By the
attached chronology you can see�that permit issuance on this project
was an extensive and laborious process spanning over a ten month
period (February 28, 1985 to January 6,I 1986),
It is my opinion that this Fee is due and payable whether we collected
it or not at the time of permit issuance. With your concurrence I
would like to write a letter to Mr. Davis informing him that his permit
is suspended until the $17,212.00 for the Transportation Corridor Fee
is paid. Please advise. Thank you.

Re: San Joaquin Hills Transportation Corridor Fees
Dear Mr. Hewicker:
I am writing in answer to your letter to Myers-O. Hill Ltd.
dated January 15, 1986, a copy of which is enclosed for your
convenience. I contacted Mr. Garcia by telephone after
receiving the letter to explain that we intended to detail in
writing what we believe are'special circumstances regarding the
delays in our permit and the hardship of the Corridor Fees
being imposed at this time.
In October we received notice by mail that our plans were
permit ready. The notice requested that we pay our fees and
receive our stamped plans.
On October 24, 1985, I obtained the necessary checks payable to
the City for the grading permit. Please find enclosed copies
of the checks dated October 24, 1985. I picked up the Grading
Permit on November 5, 1985.
By November 8, 1985, I had obtained the remaining checks for
fees, permits and deposits payable to the City of Newport Beach
for our Building Permit. Please find enclosed copies of these
checks dated November 7, 1985.
On November 112 19850 I tried to pick up the Building Permit;
however, the clerk at the front counter stated that the
landscape plans had not been signed off. I contacted Steve
Male£yt, our Landscape Architect. He stated that he was
informed by the City that they had been signed off. He
contacted Jack Brook, who stated that they were signed off by
him and that he had sent the plans over to the front desk;
however, his approved landscape plans had been lost or
misplaced. We once again submitted landscaping plans and
received approval from Jack Brook. Steve Malefyt and myself
picked them up and hand -carried them over to the front desk.

Around November 20, 1985, I attempted to pay our Building
Permit fees, but again was denied. This time I was informed
that several signatures from the Building Department were
missing. I contacted Brian Dougherty, our architect. He sent
his representative to the City to correct the problem and
obtained the signatures needed.
Around November 29, 1985, I again went to the City and was
again told that I still didn't have all the signatures needed.
I contacted Brian Dougherty's office again. He called the City
Building Department and was told there must have been a mistake
at the front desk, and in fact the plans were permit ready.
On December 10, 19852 I again went to obtain our building
permit, and again I was told that not every Department Head had
signed our plans. The girl at the front desk contacted the
Department Heads in the Building Department while I was
present. Each man who came out had signed the plans and showed
the staff at the front desk. One of the gentlemen stated that
he had signed several times. After having received the
signatures, I was told we needed to pay an additional $1,109.97
because the plan check fee had expired. I put in a check
request for the fee the next day.,
On December 12th I left on my Christmas through New Years
vacation. Upon returning, I was finally able to obtain the
Building Permit.
Please find the enclosed copy of the Memorandum from our
architect, Brian Paul Dougherty of Dougherty & Dougherty, and
the copy of the letter from Stephen J. Malefyt, our landscape
architect collaborating my recollection.
Paying the Transportation Corridor Fees is a severe financial
hardship. I believe that under the unique and very special
circumstances which I have outlined above, that in fairness we
should not be required to pay this fee. We would very much
appreciate your understanding in this matter.

Dear John:
As per our conversation about processing of our landscape plans thru the
City of Newport Beach, we are enclosing the following delivery receipt.
This receipt shows that Jack Brooks, of the City of Newport Beach, received
our plans on June 12, 1985. After a period of two weeks, I contacted him
and he stated that the landscape plans were approved and he was keeping
an approval set.
In mid -November, when you contacted me that you were going to pull
building permits, I called Jack Brooks. He said that he would take them
over to the front desk. When you went down there the front desk said that
they couldn't find them. We were told we had to resubmit them thru Jack
Brooks, which we did. He resigned them but we lost considerable amount
of time and thus pushed us over the December 12th date.

Pursuant to the provisio s of Section 15.60 of the Newport Beach Municipal Code, as condition prdeeder
to the issuance of a building permit, the undersigned person makes the below listed deposit. This deposit she
guarantee the proper cleanup and removal of construction and demolition debris from the construction sit
including public property, and shall guarantee that inspections are requested at the proper time including fin
inspection, thereby providing the proper protection to the health, safety, and welfare of the citizens
Newport Beach.
Failure of the contractor to satisfactorily clean up the construction site shall cause the City of Newport Beac
or its agents or employees, to enter upon the construction site and remove the debris therefrom. The cost c
such removal shall be deducted from the cash deposit and summarily forfeited and paid over to the City, an

A. February 25, 1985: First Submittal for Building Permit Plan Check
to the City. We were informed that plans would be internally
distributed to the Building Department, Planning Department and
Fire Department for review and content.
B. March 17, 1985: First Submittal of Title 24 documentation to the
State Plan Checking Agency in Santa Ana.
C. March 8, 1985: Plans submitted to the City of Newport Beach Public
Works Department for courtesy review. No work associated with

At the end of November the owner attempted to "pull" the project permits
and was informed by the Building Department that some of the departmental
signatures were not in place in the city's project file. After repeated
attempts to clarify this issue the architect was requested to assist the

Around November 20, 19859 I attempted to pay our Building
Permit fees, but again was denied. This time I was informed
that several signatures from the Building Department were
missing. I contacted Brian Dougherty, our architect. He sent
his representative to the City to correct the problem and
obtained the signatures needed.
Around November 29, 1985, I again went to the City and was
again told that I still didn't have all the signatures needed.
I contacted Brian Dougherty's office again. He called the City
Building Department and was told there must have been a mistake
at the front desk, and in fact the plans were permit ready.

On December 10, 1985, I again went to obtain our building
permit, and again I was told that not every Department Head had
signed our plans. The girl at the front desk contacted the
Department Heads in the Building Department while I was
present. Each man who came out had gigned the plans and showed
the staff at the front desk. One of the gentlemen stated that
he had signed several times. After having received the
signatures, I was told we needed to pay an additional $1,109.97

architect, Brian Paul Dougherty of Dougherty & Dougherty, and
the copy of the letter from Stephen J. Malefyt, our landscape
architect collaborating my recollection.
Paying the Transportation Corridor Fees is a severe financial
hardship. I believe that under the unique and very special
circumstances which I have outlined above, that in fairness we
should not be required to pay this fee. We would very much
appreciate your understanding in this matter.

Letter sent to Myer-O.Hill and Dougherty and
Dougherty, Architect, certified mail by Jay
Garcia, Bill Laycock advised of letter and
situation.
4. January 20, 1986 -
Phone conversation with John Davis, Project
Manager, 7 Upper Newport Plaza, assuring Jay
Garcia of action in 72 hours towards
resolution of situation. Informed of
Department heads to contact for meeting

5. January 24, 1986 -
Still no response from John Davis and Don
Webb indicates not having spoken with Mr.
Davis or anyone else regarding 7 Upper

Please be advised that on' December 12, 1985, the imposition of fees
required to construct the San Joaquin Hills Transportation Corridor
became effective on new construction. The date of issuance of your
permit (PC 287-85) was January 6, 1986, and is, therefore, subject to
assessment of the above fee.
Staff failed to collect the above mentioned fee at the time your
building permit was issued; however, this error does not relieve you
from payment of Corridor fees. The attached document indicates that
based on a proposed 13,240 square foot office building the San Joaquin
Hills Transportation Corridor Fees would require a contribution in the
amount of -On' —2 06A7(212,00
We apologize for the staff's error; however, we would appreciate a
prompt response. Please submit a check to the building department
for fees due. Please include address (7 Upper Newport Plaza) and plan
check number on check (PC 287-85).
Please contact me at the above number or make the required payment
within five (5) days of the date of this letter. Should you fail to
do as requested, the permit could be void and the matter referred to
the Office of the City Attorney. Thank you for your cooperation in
resolving this matter.
