Background
Section 34090 of the Government Code provides that with the approval
of the legislative body by resolution, and the written consent of the
City Attorney, the head of a City Department, with certain limitations,
may destroy any City record, document, instrument, book, or paper
under his charge, without making a copy thereof, after the same is'
no longer required.
It is the desire of the Department of Community Development to erase
the tapes from Planning Commission meetings in excess of two years
of age in order that these tapes may be reused and new tapes will not
have to be purchased. The City Council has already authorized the
City Clerk to follow this procedure.

RESOLUTION NO. 9188
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING AND AUTHORIZING
THE DESTRUCTION OF CERTAIN RECORDS OF THE PLANNING
COMMISSION MEETINGS MAINTAINED BY THE COMMUNITY
DEVELOPMENT DEPARTMENT
WHEREAS, there are certain records of Planning
Commission Meetings maintained by the Community Development
Department which are no longer required for any City business
and are therefore ready for destruction; and
WHEREAS, Section 34090 of the California Government
Code provides that the head of a city department, with the
approval of the legislative body by resolution, and the written
consent of the City Attorney, may destroy certain records
without making a copy thereof;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the Community Development
Director is hereby authorized to destroy, and the City Council
approves the destruction of, certain taped records from
Planning Commission meetings in excess of two years of age
in order that these tapes may be reused and new tapes will not
have to be purchased.

CHAPTER 356
ASSEMBLY BILL NO. 1002
An act to amend Section 34090 of the Government Code, relating to destruction of
city records.
LEGISLATIVE COUNSEL'S DIGEST
The existing law prohibits a city from destruction of records
that are less than five years old and other enumerated types of rec-
ords.
This bill would, Instead, authorize the destruction of city rec-
ords that are at lea9t two years old if -certain conditions under the
existing late are satisfied and they are not within the other enumer-
ated types of records which may not be destroyed.•
The people of the State of California do enact' as follows:
SECTION 1. Section 34090 of the Government Code is amended to read:
34090.
Unless otherwise provided by law, with the approval of the legislative body by
resolution and the written consent of the city attorney the head of a city depart-
ment may destroy any city record, document, instrument, book or paper, under his
charge, without making a copy thereof, after the same is no longer required.
This section does not authorize the destruction of:
(a) Records affecting the title to real property or liens thereon.
(b) Court records.
(c) Records required to be kept by statute.
(d) Accords less than ' * * * two years old.
(e) The minutes, ordinances, or resolutions of the legislative body or of a city
board or commission. `
This section shall not be construed as limiting or qualifying In any manner the
authority provided in Section 34090.5 for the destruction of records, documents, In-
struments, books and papers in accordance with the procedure therein prescribed.
