The increased building height results in a more desirable architectural treatment of the building and a stronger and more appealing visual character of the area within the general theme of a marine environment since the open space plaza integrates the project with the visual amenity of Newport Bay, and the variation of the facade minimizes the visual impact of the structures. 4. The increased building height does not result in undesirable or abrupt scale relationships between the structure and existing developments or public spaces. 6 4 5. That incentive uses are provided by the development which allow the establishment of general office and commercial uses. 7. Conditions: 1. That the proposed development shall be in substantial compliance with the approved plot plan, floor plans and elevations. 2. That the characteristics of the open space plaza be maintained, including the 120 foot dimension on Newport Boulevard, the minimum 100 foot clear width at ground level, and the minimum 50 foot clear width at the second and third levels. 3. That any fences or protective rails required for parking structure stairwells within the open space plaza be visually open. 4. That the building shall be no higher than 35 feet, subject to the provisions of the Cannery Village/McFadden Square Specific Plan in regards to the ground floor elevation and in accordance with the definitions contained in Section 20.87.205 of the Newport Beach Municipal Code. 5. That incentive uses shall be provided if general commercial or office uses are provided on site. The split between incentive uses and uses which can be developed only upon the provision of incentive uses is 40% incentive use and 60% use which requires incentive. Prior to the issuance of any grading or building permits for the project, the applicant shall record a covenant, the form and content of which is acceptable to the City Attorney, agreeing to the provision of required incentive uses. 6. Should the final design of the project result in the loss of on -site, parking, the commercial component of the project may be reduced, but may not be less than 20,000 sq.ft. 7. That the Planning Commission may add to or.modify conditions of approval to this Use Permit or recommend to the City Council the revocation of this Use Permit, 0 0 upon a determination that the operation which is the subject of this Use Permit, causes injury, or is detrimental to the health, safety, peace, morals, comfort, or general welfare of the community. g, That this Use Permit shall expire unless exercised within 24 months from the date of approval as specified in Section 20.80.090A of the Newport Beach Municipal Code. 9. Traffic Study No. 59. Findings: 1. That a Traffic Study has been prepared which analyzes the impact of the proposed project on the morning and afternoon peak hour traffic and circulation system in accordance with Chapter 15.40 of the Newport Beach Municipal Code and City Council Policy S-1. 2. That the traffic study indicates that the project will neither cause nor make worse an unsatisfactory level of service on any major, primary -modified, or primary street. E. Tentative Map of Tract No. 14025. Findings 1. That the design of the subdivision improvements will not conflict with any easements acquired by the public at large for access through or use of property within the proposed subdivision. 2. That public improvements may be required of a developer per Section 19.08.020 of the Municipal Code and Section 66415 of the Subdivision Map Act. 3. That Section 13.05.010 of the Newport Beach Municipal Code requires that public improvements be completed in commercial areas prior to the issuance of building permits for a new structure. & (10 4. That the existing utility easement crossing the existing property be abandoned after removal of utilities. 10. That a hydrology and hydraulic study be prepared by the applicant and approved by the Public Works Department, along with a master plan of water, sewer and storm drain facilities for the on -site improvements prior to recording of the tract map. Any modifications or extensions to the existing storm drain, water and sewer systems shown to be required by the study shall be the responsibility of the developer. 11. That a condition survey of the existing bulkhead along the bay side of the property be made by a civil or structural engineer, and that the bulkhead be repaired in conformance with the recommendations of the condition survey and to the satisfaction of the Building Department and Marine Department. The top of the bulkhead is to be a minimum elevation of 9.00 above M.L.L.W. (6.27 MSL). That the existing bulkhead tiebacks be maintained until an approved alternate is in place or other provisions made to insure the integrity of the bulkhead. 12. That County Sanitation District fees be paid prior to issuance of any building permits. 13. That the Public Works Department plan check and inspection fee be paid. 14. That the Edison transformer serving the site be located outside the sight distance planes as described in City Standard 110-L. 15. Disruption caused by construction work along roadways and by movement of construction vehicles shall be minimized by proper use of traffic control equipment and flagmen. Traffic control and transportation of equipment and materials shall be conducted in accordance with state and local requirements. A traffic control plan shall be reviewed and approved by the Public Works Department. No construction, storage or delivery of materials shall be allowed within the Newport Boulevard right-of-way. Prior to issuance of any grading permits, a parking plan showing how workers will be able to park without using on -street parking must be submitted and approved by the Public Works Department. 15. That no earthwork hauling operations, major concrete placement and other construction operations requiring more than 32 trips per day or 4 trips/hour by trucks with more than 3 axles be scheduled to occur between June 1 and September 15, and one week before and after Easter. 16. That any proposed underground building construction shall be setback from the sidewalk a sufficient distance to allow the sidewalk to remain in service during construction and that no tie backs or foundations be, constructed in the public right- of-way. 17. That a hydrology and hydraulic study be prepared by the applicant and approved by the Public Works Department, along with a master plan of water, sewer and storm drain facilities for the on -site improvements prior to recording of the parcel map. Any modifications or extensions to the existing storm drain, water and sewer systems shown to be required by the study shall be the responsibility of the developer. TO: Planning Commission - 11. 18. That an agreement for maintenance of non-standard improvements be executed by the developer if special textured sidewalk or other non-standard improvements are proposed to be constructed within the public right-of-way around the development. The design of all non-standard improvements shall be approved by the Public Works Department. 19. That a maximum of two driveways shall be permitted on each of the northbound and southbound frontages of Newport Boulevard and no driveways shall be permitted on 28th Street. 20. That all access and parking for the proposed development shall be subject to further review of the City Traffic Engineer. 21. Calif( corporation ("City"), and is made on the basis of facts, intentions and understandings: A. Developer is the owner of the real property 2600 Newport Boulevard, in Newport Beach, California, and described in attached Exhibit A ("Property A") upon which Developer intends to construct a mixed. use project consisting of thirty-five (35) residential condominiums and twenty-two thousand (22,000)'square feet of commercial/retail area, (hereinafter referred to as the "Project" or "The 28th Street Marina Project"). B. On October 5, 1989, the City Council approved Traffic Study No. 59 (the "Traffic Study"), Use Permit No. 3361 (the "Use Permit"), Tentative Tract Map No. 14025 (the "Tentative Tract Map"), Site Plan Review No. 52 (the "Site Plan Review"), and Coastal Residential Development Permit No. 18 (the "Coastal Permit"). The City's approval was conditioned, among other things, 1 on City and Developer entering into an affordable housing agreement ("Agreement") which guarantees to provide within the City four (4) units on -site or off -site as "affordable units" (the "Affordable Units"). Developer has agreed to provide the four (4) Affordable Units under the terms and conditions contained in this Agreement to satisfy that requirement, and to enter into this Agreement with the City in consideration for approval of the Project. All four (4) of the Affordable Units will be two-bedroom/one bath rental units. C. Developer proposes to provide the Affordable Units off - site. Developer proposes to provide the Affordable Units at property located at 2809 and 2811 Newport Boulevard in Newport Beach, California, as described in the attached Exhibit "B" ("Property B"). This Agreement shall initially encumber title to Property A and City agrees to sign documents necessary to remove this Agreement as a matter affecting title to Property A concurrently with the recording of this Agreement against Property B. D. This Agreement shall encumber title to Property A and thereafter Property B or other property providing the Affordable Units and all rights, duties and obligations of this Agreement shall be binding on all successors and assigns of the property on which this Agreement is recorded. NOW, THEREFORE, in consideration of the above recitals and in full satisfaction of all conditions to the approval of the Traffic Study, the Use Permit, the Tentative Map, the Site Plan Review, and the Coastal Permit (the "Approvals") relating to the provision of E 1 J • the Affordable Units, it is agreed as follows: 1. This Agreement shall be recorded against title to Property A concurrent with the recording of the Final Tract Map on Property A. 2. Developer has committed to provide the Affordable Units on Property B. Since Developer cannot take title to Property B until such time as remedial work has been accomplished to remove abandoned storage tanks on Property B, Developer agrees that this Agreement shall remain recorded against title to Property A until such time as Developer obtains fee simple title to Property B and this Agreement is recorded against Property B. As such time as this Agreement is recorded affecting title to Property B, the City shall deliver to Developer a quit claim or other instrument in recordable form sufficient to remove this Agreement as a matter affecting title to Property A. 3. It is anticipated that the Affordable Units will not be constructed on Property B and ready for occupancy until after the 28th Street Marina Project is completed. Prior to the issuance of the certificates of occupancy or other approval for occupancy of the residential units of the 28th Street Marina Project, the Developer agrees to: 1) post a $400,000 faithful performance bond with the City, in a form acceptable to the City Attorney to insure the completion of the Affordable Units within twenty-four (24) months of posting the bond; and 2) Record this Agreement against Property B. Certificates of occupancy for the Residential Units in the 28th Street Marina Project shall not be granted until the 3 bond is given to the City and this Agreement is recorded against Property B, or at another off -site location within City limits acceptable to the City of Newport Beach. 5. The Affordable Units shall be subject to the following affordability and eligibility criteria and requirements: 5.1 All four (4) Affordable Units shall be rented to persons or families earning eighty percent (80%) or less of the County annualized median family income as then currently calculated by the United States Department of Housing and Urban Development ("HUD") and published by the State of California under Health and Safety Code Section 50093 for the County based on family size using the HUD Section 8 income table, as the same may be adjusted from time to time. If either the State or HUD no longer publishes the data referred to above, then such equivalent source as the parties may agree upon shall be substituted. 5.2 The annualized rents chargeable for the Affordable Units shall be in accordance with the Section 8 Fair Market Rent (FMR) for two -bedroom units. 6. Each Affordable Unit shall be maintained as an Affordable Unit as provided in the Agreement for thirty (30) years from the date that each unit was first occupied. 7. At least thirty (30) days before offering the Affordable Units for lease/rent to the general public, Developer shall provide the City and the Orange County Housing Authority ("OCHA") with written notice of its intent to lease the Affordable Units, specifying the location of the Affordable Units, the proposed 4 rental, together with a proposed form of lease or rental agreement ("a Lease"). 8. Developer will be responsible for ensuring that persons or families who rent the Affordable Units properly qualify to occupy the units under the terms of this Agreement. Selection of the tenants of the Affordable Units shall be made on the basis of criteria that are neutral as to age, race, religion, sex, creed and ethnic origin or any other constitutionally impermissible standard. Developer shall discharge its responsibility under this Paragraph 8 as follows: 8.1 Developer shall advertise the availability of the Affordable Units on at least two (2) separate occasions in a newspaper of general circulation within the County, each advertisement being for one week. Newspapers such as the Los Angeles Times, Orange County Edition and the Orange County Register are acceptable. A waiting list of qualified prospective tenants shall be established. The Waiting List shall also show the date the qualified prospective tenant's name was placed on the Waiting List. On each Recertification Date (as defined in Paragraph 9 below), and from time to time as requested by the City, Developer shall make a copy of the Waiting List available to the City. 8.2 Developer shall accept applications for occupancy for a period of not less than ten (10) days after the last date on which the availability of the Affordable Units is advertised. 8.3 Developer shall require each applicant for occupancy of an Affordable Unit ("Applicant") to certify that the gross 5 income of the occupants of the Affordable Units does not exceed the qualifying income limits specified in this Agreement and Developer may rely upon such certification in qualifying the Applicant. In certifying the Applicant, qualified income shall be determined by the sworn statement(s) of the applicant'•s federal income tax returns for the two (2) preceding years and income vertification from applicants current employment. 8.4 At the initial occupancy and as the Affordable Units become available for lease from time to time, Developer shall make those Affordable Units available for lease to those qualified prospective tenants on the Waiting List. Preference shall be given to HUD Section 8 Certificate and Voucher holders in the rental of the Affordable Units even if their names are not on the Waiting List. OCHA shall be notified as Affordable Units become available for rent after initial occupancy. At the initial occupancy, qualified, acceptable prospective tenants for units not occupied by Section 8 tenants shall be selected by a random method. 8.5 Developer shall reserve the right under the Lease for each Affordable Unit to terminate the tenancy for the Affordable Unit upon thirty (30) days' written notice upon the occurrence of any or all of the following: (i) the discovery of any misrepresentation as to income available to the tenant; (ii) the discovery by Developer that a material change in a tenant"s income results in that tenant no longer qualifies for occupancy of the Affordable Unit ("material" shall mean gross income which exceeds the qualifying limits by ten percent (10%); or (iii) the 2 tenant is otherwise in default under the terms of the Lease. 9. Once a tenant is qualified for occupancy of an Affordable Unit as provided above, that tenant shall be deemed to have qualified for occupancy until the tenant's annual anniversary date (the "Recertification Date"). Thereafter, each tenant must be annually recertified by Developer certifying as to the tenant's income(s) as provided above. Information regarding initial qualification and recertification shall be provided to the City as soon as practicable following occupancy and recertification. Developer shall provide City with a schedule of the rents for each Affordable Unit once every twelve (12) months. 10. Upon termination of this Agreement and within ten (10) days after written notice from Developer, City shall deliver to Developer an instrument in recordable form sufficient to remove this Agreement as a matter affecting title to Property B. The obligations of Developer described in this paragraph and in this Agreement are subordinate to the rights of bona fide secured lenders providing construction or permanent financing for Property B in the ordinary course of business, and City agrees to execute any agreement or document that may be reasonably required by such lender to evidence such subordination. 11. Developer acknowledges and agrees that it has received full and adequate consideration for its assumption of the obligation to provide affordable housing required by City as a condition to the Approvals. Developer acknowledges that Approvals could not have been granted without an affordable housing 7 requirement. Developer specifically waives and gives up any right to contend, for any reason, including, but not limited to, its lack of any property interest in the parcel covered by the Tentative Map or the lack of any relationship between Developer and the Approvals that: 11.1 Developer is not legally required to comply with the provisions of this Agreement; or 11.2 The remedy contemplated by this Agreement, such as specific performance, or interim or injunctive relief, should not be made applicable to Developer, its successors and assigns or property against which this Agreement has been duly recorded. 12. The parties agree that any breach of this Agreement by Developer will irreparably injure the City and that monetary damages, or any other legal remedy, would be inadequate to remedy such a breach. The parties further agree that the City, in the event of a breach of this Agreement by Developer, may obtain an Order of the Superior Court, requiring developer to specifically perform in accordance with this Agreement, and that the City may seek interim injunctive relief pending the issuance of such an Order. 13. If either party is required to initiate litigation to enforce the terms and conditions of this Agreement or to seek damages by reason of the'breach of the terms and conditions of this Agreement, the prevailing party in that litigation shall be entitled to recover reasonable attorneys' fees and costs incurred in conjunction with such litigation. 91 t 14. Notices required or permitted under this Agreement shall be sufficiently given if made in writing and delivered either personally or by registered or certified mail, postage prepaid, to the following addresses, or to such other address and may be designated for formal notice.
