Bill Dietrich appeared before the Commission on
behalf of California First Bank and concurred with
the staff report and recommended condition.
There being no others desiring to appear and be
heard, the public hearing was closed.
Motion was made that Planning Commission make the
following findings:
1. The proposed development is in conformance
with the General Plan, and is compatible with
the surrounding land uses.
2. Adequate offstreet parking spaces are being
provided for the proposed development.

Dear Mr. and Ms. Perlmutter:
This office has been informed that trash has been allowed to accumulate within the trash enclosure of your
property that is not within the provided trash dumpster. The doors for the trash enclosure are left open such
that the trash is blown outside of the enclosure. Also, since the doors are left open, at least one of the doors
obstructs and interferes with the free passage of the public over the public right-of-way contiguous to the
enclosure.
On February 17, 1998 this condition was verified. Additionally, there was a discarded stuffed chair next to the
enclosure.
These conditions would be considered a nuisance according to Newport Beach Municipal Code Sections
10.50.020C and 20.50.020F. These sections, respectively, prohibit the accumulation or storage of ...rubbish,
trash, debris ... and the existence ,of any unlawful encroachment ... which obstructs or interferes with the free
passage or use by the public, of any public sidewalk, street....
Therefore, would you please clean and maintain the trash enclosure for this property and the area surrounding
the enclosure in a neat and orderly fashion free of debris, trash, etc. that is not within the provided dumpster
and ensure that the doors for this enclosure and continually maintained in a closed position once the dumpster
has been emptied by the refuse company.
