Dear Mr. West:
This letter is written as a follow-up to our telephone conversation of May 11, 1992,
regarding the storage of rental cars at 2912 West Coast Highway (Enterprise Rent -A
Car/Leasing). I have reviewed our files for the property located at the address noted above
and find that the only use for which we have any record is the off -site parking lot for the
adjoining Jaguar Diner. In addition, as an accommodation to you we allowed Enterprise
Rent-A-Car to relocate and open a, business on this site only so long as the cars to be rented
were stored on the Jaguar lot. In other words, Enterprise Rent-A-Car was to have only an
office at the 2912 West Coast Highway address.
If it is your desire to display or store rental cars on the 2912 West Coast Highway address
it will be necessary to either incorporate both sites under the existing use permit (Use
Permit No. 3229 Amended) or secure a separate use permit for the rental car business. Ms.
Galonsky of Enterprise Rent-A-Car has been aware of this requirement since early January
of this year.
I hope this clarifies the matter for you. If you have further questions you may contact Jim
Sinasek between 7:30 and 8:30 a.m. or 4:00 and 4:30 p.m. at 644-3215. If we do not hear
anything from either you or Ms. Galonsky by Friday, May 22, 1992, we will ask the City
Attorney to take whatever action is appropriate.

for the City of Newport Beach, this letter will confirm your mutual understanding and your
intention to apply for a use permit for any further storage of rental/leasing vehicles on the
subject property at 2912 West Coast Highway. _ '
As you discussed, any further storage of vehicles on the subject property, without your
applying for a use permit for the storage of those vehicles, will result in this matter being
immediately referred to the Office of the City Attorney for appropriate action.
We would like to take this opportunity to sincerely thank you for your cooperation and
prompt attention in helping us to resolve this matter.

Municipal Code so as to add the construction of chimneys and vents
in excess of permitted height limits to the power and duties of the

Request to amend a previously approved use permit which permitted
the establishment of an automobile sales and service facility on
property located in the "Retail and Service Commercial" area of the
Mariner's Mile Specific Plan Area and which also exceeds the 26 foot
basic height limit in the 26/35 Foot Height Limitation District. Said
approval also included the establishment of a restaurant with on -sale
beer and wine within the automobile sales facility and the addition of
an outdoor seating area to the existing restaurant; a request to conduct
special charitable/promotional events; and a request to permit the
additional required parking to be provided on an adjoining parcel
which is in the same ownership as the subject property. The proposed
amendment involves a request to allow said restaurant facility to
remain open on a 24 hours basis where the permitted hours of
operation are from 7:00 a.m. to 10:00 p.m daily. Also included in the
application is a request to permit the establishment of an automobile
rental facility on the adjoining parcel from the automobile sales and
service facility, located in the "Retail and Service Commercial" area of
the Mariners Mile Specific Plan Area.
