The City had asked your office to change the numbering system to be consistent with our city numbering system regarding odd and even numbers on the north and south side of the street. You were kind enough to provide us with a new numbering plan that is consistent with our City numbering system. This letter is to clarify the established addressing system for the Colony project. Buildings 1 and 2 are located on the north side of the Colony Plaza street. Buildings 3 and 4 are located on the south side of the Colony Plaza street. The address for the leasing office is 5100 Colony Plaza. The address for the guard house is 5102 Colony Plaza. The address for the pool building is 5104 Colony Plaza Buildings 1, 2, 3, 4 are addressed using: 1 st number of the address represents the Building number 2nd number of the address represents the floor level 3rd and 4th number of the address represents the unit number with even numbers on the north side of Colony Plaza in Buildings 1 and 2, and odd numbers on the south side of Colony Plaza in Buildings3 and 4. Please be advised that the Newport Beach Fire Department must approve the final signs for the building numbering prior to the completion of the project. The rational for this decision is that the unit closest to Dahlia has no direct access off of Dahlia. In fact, the main entrance to the residence and the garage is accessed off of Seaview Avenue. The second residence main entrance is also off of Seaview Avenue and therefore should also have a Seaview Avenue address. It is my opinion that addressing both residence with Seaview Avenue address will help reduce confusion if emergency personnel should ever need to respond to either of the condominiums. Please allow me to explain: I am a long time home owner at 400 & 4001/2 Heliotrope, in Corona del Mar, California. During the past few months I have been able, with the assistance of the city, to upgrade the 4001/2 Heliotrope property from a separate dwelling status into a `Condo' rated property. My purpose for requesting this address change for 4001/2 Heliotrope is due to the fact that the home faces Bayside Drive. During the time since I have owned these two properties there has always been a problem. When any deliveries are to be sent to me at 4001/2 Heliotrope, there is always a delay because the property sits directly behind the 400 Heliotrope home and clearly cannot be recognized as an extension of that home. The backyard fence of the front house ends at the side of the 4001/2 Heliotrope property that is facing Bayside Drive. There is not a sidewalk to follow to the rear unit therefore when friends come to visit, they must use the alley to find my home at 4001/2 Heliotrope.. This has always caused problems. Enclosed are pictures showing the confusion with the street address for the Condo which is facing Bayside Drive. I am requesting nothing more than what other properties along Bayside Drive in Corona del Mar already have. During my thirty-two years with the Pomona Fire Department, twenty-five years of which I spent as an engineer, I have been on a number of emergency calls where an apparent address confusion such as the one at 4001/2 Heliotrope could mean the difference between life and death. I believe that once the enclosed photos are'examined, you will agree that the property truly does appear to be located on Bayside Drive. Please note that five other homes located at 2700-2706-2710-2720 and 2730 all have `Bayside Drive' residence addresses. No, 9r-12 and 96.13 Page 2 Points and Authority Environmental Compliance (California Environmental Quality Act) It has been determined that the project is categorically exempt under Class 5 of the CEQA statutes and guidelines (Government Code Section 15305), which consists of minor alterations in land use limitations in areas with an average slope of less than 20% which do not result in any changes in land use or density, including but not limited to: (a) Minor lot line adjustments, side yard, and set back variances not resulting in the creation of any new parcel; (b) Issuance of minor encroachmentpermits; (c) Reversion to acreage in accordance with the SubdivisionMap Act. Conformance with the General Plan The Land Use Element of the General Plan designates the site for "Single -Family Detached" residential use. The Land Use Element statistical information reflects the number of dwelling units based on the underlying Lido Isle subdivision, Tract No. 907. The proposed lot line adjustment will alter the configuration of three existing parcels of land for ,single-family residential development, a permitted use within this designation. The project will not result in an increase in the number of dwelling units otherwise allowed by the underlying subdivision. • Lot Line Adjustment Requirements and Procedures are set forth in Chapter 19.08 [Section 19.08.050 (D)] and Chapter 20.81 of the Municipal Code and compliance is addressed in detail in the body of this report. Relevant Definition and Regulations The following definition and regulations are presented for the Commission's information and are related to the issues raised in regard to the lot line adjustment 20.87.090 BUILDING SITE. The term "building site" shall mean a subdivided lot, parcel of land or contiguous combinations thereof which is occupied or intended to be occupied by a main building or buildings and their accessory buildings, together with such yards and open space as are required by the terms of this Title and the Uniform Building Code, and which fronts directly upon or has permanent access to a street as defined under Section 20.87.090 of this Title and required by the Uniform Building Code. R-1 District Regulations Minimum site area and lot width in the R-1 District are set forth in Section 20.13.030 of the NewportBeach Municipal Code as follows: N.B.L.L.A. No. 96.12 and 96-13 Page 20.13.030 SITE AREA AND LOT WIDTH. For each dwelling there shall be a minimum of 5,000 square feet of area and a minimum width of 50 feet on interior lots, a minimum of 6,000 square feet of area and a minimum width of 60 feet on corner lots. In no case shall there be more than one single family dwelling on any one building site. Any lot or parcel of land under one ownership and of record on August 2, 1943 may be used as a building site even when of less area or width than that required by the provisions of this section. Analysis The project area is comprised of Lots No. 432, 433 and 434 of Tract No. 907 (Lido Isle) and are currently occupied by a single family residenceconstructed in November 1962. The underlying lot configuration has been maintained since no map combining or altering the parcels has been recorded Section 20.81.060 of the Newport Beach Municipal Code set forth the findings which must be made in conjunction with the approval of a lot line adjustment. Each required finding is stated belowwithan analysis of the project's conformancewith each. 1. The project site described in the proposal consists of legal building sites. This finding can be made since the property is comprised of three legal parcels established by Tract No. 907 recorded in 1928. 2. Any land taken from one parcel will be added to an adjacentparcel and no additional parcels will result from the lot line adjustment. This finding can be made since in each case the relocation of the interior lot lines take land from one parcel and add land to an adjacent parcel. Also, the lot line adjustment will not result in the creation of any additional parcels since three parcels are currently present. 3. The parcelsproposed to be created by the lot line adjustment comply with all applicable zoning regulations, and that there will be no change in, the land use, density, or intensity on the property. This finding can be made for the following reasons. The existing three lots were established by the original Tract No. 907 in 1928. Since the lots were legally established prior to August 2, 1943, they are legal building sites between which lot lines may be adjusted, even though the minimum site area and lot width criteria are not met. In addition, although the proposed lot line adjustment has been requestedby the applicant in association with a plan to construct three single family dwellings where one dwelling unit currently exists, the use of the land is for single family residential development as specified by the General Plan and Zoning Code. The density specified in the Land Use Element of the General Plan for Lido Isle (copy attached for the Commission's information) is based on the underlying Lido Isle TractNo. 907, with one dwelling unit counted for each single family lot. Also, use of the land for three separate homes could result in a decrease in building intensity, since there will be required setback areas between each of the new dwellings. The construction of a single dwelling on the three lots would not require these setbacks, which could result in a larger building. NRL.L.A. No. 96.12 and 96-13 Page4 4. The lot line adjustment, in and of itself, will not result in the need for additional improvements andlor facilities. This finding can be made because the proposal does not create a need for additional improvements or facilities since the area is fully improved in terms of streets, storm drains, water and sewer facilities, etc. Based upon the above analysis, staff is of ,the opinion that the legislative intent of Title 20 is satisfied and, therefore, the proposal is excepted from the requirement of filing a parcel map to adjust lot lines between the three lots. Issues Identified in the Appeal Staff has received a letter of appeal, other letters and petitions which raise various concerns with regard to the proposed lot line adjustment application. Staff has provided the following responses to those comments: That a single lot is being split into three parcels which will increase the density in the neighborhood. As stated previously, the proposal is consistent with the Land Use Element of the General Plan which specifies density in accordance with the underlying Tract No. 907. Tract No. 907 permits three dwelling units on the three lots in question. It is important to note that three dwelling units could be built without the lot line adjustment, since each of the underlying lots is a legal building site. • That the proposed lot sizes are substandard. The proposed lot sizes are within the range of lot sizes found in the Lido Isle Subdivision established in 1928, which vary from f1,400 sq.ft. to t14,000 sq.ft. • That the adverse impacts of the increased density must be addressed under CEQA requirements of an environmental document. The project is categorically exempt under Class 5 of CEQA statutes and guidelines (Government Code Section 15305), which includes, among other items, minor lot line adjustments, as described earlier in this report (page 3). • That the proposed development is contrary to deed restrictions recorded against the property. The deed restrictions mentioned in the correspondence (similar to Covenants, Conditions and Restrictions (CC&Ws) of homeowners associations) are a civil matter and not subject to enforcement or review by the City. • That the width of Zurich Circle is substandard and the proposed development will not be adequately accessible to emergency personnel or equipment. The streets mentioned are the streets approved in conjunction with original Tract No. 907 and the construction of one building or three buildings will not have an effect on the width of the street or the ability of emergency personnel to navigate the area. Via Zurich is a 24 foot wide right-of-way and would be the emergency equipment access point for this block in any case. N.B.L.L.A. No. 96-12 and 96-13 Page 5 • That the proposal may set a precedentfor future developments This approval does not set a precedent for future development unless the future applicationhas identical physical constraints or circumstances as this project and, if not, would be evaluated on its own merits. • That there will be increased traffic congestion resultingfrom the development of three dwelling units. The two additional dwelling units will increase traffic on Lido Isle by 26 daily trips (one way). The additional traffic will not result in traffic congestion because the streets on Lido Isle function well within their design capacity. • That there will be additional demand for parking in the area, The development will be required to provide parking based on the current Municipal Code requirement of two parking spaces for each dwelling unit, which is considered adequate for single-family development. Applicant's Statement of Support The attached letter has been submitted on the applicant's behalf which describes the proposal and also provides additional information with regard to issues raised by neighbors in regard to a deed restriction (beginning on handwrittenpage 14 of this report). Conclusion and Recommendation In order to approve this application, the Planning Commission must find that the establishment, maintenance or operation of the use of the property or building will not, under the circumstances of the particular case, be detrimental to the health, safety, peace, comfort and general welfare of persons residing or working in the neighborhood of such proposed use or be detrimental or injurious to property and improvements in the neighborhoodor the general welfare of the City, and further that the proposed modification is consistent with the legislative intent of Title 20 of this Code. In addition the Commission must make the four findings specified in Section 20.81.06013 of the Municipal Code as described in this report. Staff is of the opinion that the requisite findings can be made in this case for the following reasons. The project consists of legal building sites. The land taken from one parcel will be added to an adjacent parcel and no additional parcels will result from the lot line adjustment. The parcels proposed to be created by the lot line adjustment comply with all applicable zoning regulations, since they are consistent with the size of R-1 Pots established in the original Lido Isle subdivision and there will be no change in the land use, density, or intensity on the property. Finally, the lot line adjustment, in and of itself, will not result in the need for additional improvements and/or facilities. Staff cannot reasonably conceive of findings for denial since the proposed lot line adjustment is consistent with the requirements set forth in Title 20 of the Municipal Code as described in this report and it does not appear that there will be any detrimental effect on the surrounding neighborhood. However, should information be presented at the public hearing which would warrant the denial of this application, the Planning Commission may wish to take such action. N.B.L.L.A. No. 96-12 and 96-13] Dear Commissioners: This firm is counsel to a group of residents owning homes in the immediate vicinity of the above -mentioned property. The subject property currently consists of three legal lots improved with one single family residence. Despite the fact that the property consists of three lots, it currently is improved with only one single family residence due to deed restrictions and other covenants, conditions and restrictions governing density of development placed on the property by its developers. These restrictions preclude the development of more than one single family residence on the three legal lots in order to facilitate a common plan or scheme of development for Lido Ilse. On January 21, 1997, the Modifications Committee approved a lot line adjustment for the subject property that will result in the demolition of the current residence on the subject property, and the construction of three single family residences in its place. Our clients oppose this development and therefore, by this letter and upon -delivery of the enclosed check in the amount of the appeal fee set by the Newport Beach City Counsel, appeal the approval of the lot line adjustment. The Committee's approval of the lot line adjustment and the resulting development of three single family residences on the subject property should be overturned for at least four reasons: (1) the lot line adjustment impermissibly will result in an increase in the existing residential density of subject property and will set a precedent for approval of increased densities for the property in its vicinity (referred to as Zones I and M in the Declaration of Covenants Conditions and Restrictions, as amended, encumbering Lido Isle); (2) the lot line adjustment impermissibly will result in the creation of a lot that is both smaller than the lot size required by the Newport Beach City Code and the smallest lot in Zones I and M, (3) the approval of the lot line adjustment and the adverse impacts of the increased density resulting from that approval must be addressed under CEQA; and (4) the approval of the lot 10 • BRYAN CAVE LLP 0 Newport Beach City Counsel February 3,1997 Page 2 line adjustment and the increased density resulting from that approval must be considered in light of the common scheme of development for Zones I and M. With respect to the Committee's first error, according to Newport Beach City Code Section 20.81.060.B(3), the Modifications Committee must make a finding that proposed lot line adjustments will not result in a change in density of development in order to grant a modification. The written findings of the Modification Committee regarding the proposed lot line adjustment, dated January 23,1997 and prepared by Genia Garcia, do not contain such a finding because, as a factual matter, approval of the lot line adjustment will result in an increase in current density levels. With respect to the Committee's second error, according to Newport Beach City Code Section 19.08.050 no parcel or building site shall be created which has a smaller area that the lot size required by Title 20 of the Newport Beach City Code, or, if a smaller parcel or building site is created, the area of such parcel or site shall not be smaller than that of the smallest lot of the subdivision. In light of this Code section, the written findings of the Committee assert that the proposed lot widths and lot sizes are consistent with the surrounding area. In fact, that finding is not entirely true. At least one of the lots resulting from the proposed lot line adjustment will be smaller than any other lots in Zones I and M of the subdivision. While the Iots may be consistent in size with smaller lots found in other areas of Lido Isle, development of lots in Zones I and M has been limited historically pursuant to the plan for development of the community in a way that results in the de facto creation of larger lots by precludsion of development of more than one single family residence per every two or three lots throughout those Zones. Approval of the lot line adjustment therefore as a practical matter creates smaller lots than those surrounding the subject property. With respect to the Committee's third and fourth errors, the original developer of Lido Isle created density restrictions applicable to Zones I and M to ensure that development of the Lido Isle community occurred in a way that most benefited its existing and future residents. These development restrictions, which have been enforced since at least 1945, are intended to guide, and have guided the development of Lido Isle in accordance with the development plan prepared by its original subdividers. Approval of the lot line adjustment and the resulting construction of three single family residences on the subject property will directly violate the development density restrictions on the property. hi turn, increased density will result in significant negative impacts that will particularly affect Zones I and M residents, whom this firm represents. Approval of the lot line adjustment increasing density on the subject property without properly evaluating resulting negative impacts under the California Environmental Quality Act, and the City of Newport Beach General Plan, as it has been supplemented by the Lido Isle development restrictions since at least 1945, constitutes error by the Modifications Committee. The Planning Department has a duty to address potential adverse impacts of the approval of the proposed lot line adjustment under CEQA. Increased density due to the lot line adjustment will directly result in many potential significant adverse impacts, including adverse BRYAN CAVE LLP Newport Beach City Counsel February 3,1997 Page 3 impacts on traffic congestion, parking, and emergency access for Lido Isle, and noise levels for Zones I and M. The streets servicing the subject property are Via Zurich and Zurich Circle. Via Zurich is only 24 feet wide, and has extremely limited parking. Zurich Circle, the primary access for this property and many of the Zone I and Zone M homeowners, is only 20 feet wide with little or no parking. Lido Isle is currently developed to maximum density, both in practical terms and in terms of the development originally envisioned by its subdividers. Increasing the density in this area in accordance with the lot line adjustment will overburden the streets that serve the property, resulting in increased congestion and parking problems for the entire tiny island community. The increased congestion in addition to the very narrow primary access street will result in significantly impaired emergency access, especially for the Zone I residents, but for other residents of Lido Isle as well. Finally, the increased density will result in increased noise levels for Zone I residents impairing their quality of life, It is the duty of the City of Newport Beach, in its capacity as a lead agency, to address these impacts under CEQA. While the City has taken the position that it has no obligation to enforce the development restrictions encumbering the property, CEQA mandates that the City at a minimum conduct an environmental impact assessment to determine whether approving the lot line adjustment and the resulting density increase will have an adverse environmental impact on the Lido Isle community, including, without limitation with respect to traffic congestion, parking, emergency access, and noise. In fact, the City of Newport Beach, as opposed to a group of residents or the Lido Isle Community Association, is statutorily empowered and uniquely able to evaluate and consider such impacts. As stated above, development in accordance with the dot line adjustment approved by the Modifications Committee will result in negative impacts. The City failed to conduct any analysis of those negative impacts under CEQA. Further, although we are not yet sure whether the proposed. development complies with the City of Newport Beach General Plan and the Specific Plan for Lido Isle (if any) as those plans are written, it is clear that those plans have only been applied in the context of restrictions further limiting residential densities on Lido Isle. These restrictions have, as a practical matter, supplemented the General Plan as applied since at least 1945. Consequently, the restrictions have been relied upon by emergency agencies, utilities, agencies improving and maintaining streets and access, and other community service providers in determining how best to serve the Lido Isle Community. In approving the lot line adjustment, the City did not consider the impacts of its failure to require development to continue to comply with the General Plan as modified by these long-standing density restrictions. These four errors, among others, constitute the basis for appeal of the decision approving a lot line adjustment for the subject property that will result in the construction of three single family residences on the subject property. We request that the approval be overturned because it increases residential density, and it creates lots that are too small. I have not received a postcard notice and, given that, as well as that the "posted" sign was down, wonder whether all of the neighbors have received proper notice of this proposal. I have contacted LICA and obtained a copy of the Planning Department's January 10,1997 memo/map to find out what is being proposed since the "posted" notice was not clear. I oppose the proposed adjustment to the lot lines in question. I strongly encourage the Planning Department to deny this proposal. In the first place, the parcels have existed as single family lots for such an extended period of time, and, the community has developed around them in reliance upon their long-standing unified usage, that the right to revert to so-called original lot lines has been lost ant waived, and any multiple usage is estopped given the adverse impact such a dramatic change (increased noise, car traffic, density, etc.) would entail. Secondly, there is no hardship or special circumstance related to the lots that warrants modifying the existing lot lines. The existing lot lines provide for three parcels �q Newport Beach Planning Ot. January 16, 1997 Page 2 somewhat equal in size. If the owner or developer is bound and determined to demolish the existing single family dwelling and develop three single family dwellings in its place, this can be done without the requested modification. The proposed, revision to the lot lines would materially shrink the lot size of the middle lot (Parcel 2). The consequence will be to cram a house in-between the other two, larger lots (Parcels 1 and 3). This approach will make the development less visually appealing, with minimum set-backs/open space. In addition, the ultimate otupants of the proposed smaller lot (Parcel 2) will end up parking their vehicle(s) in front of their neighbors' home(s) as the proposed minimum size for the middle lot (Parcel 2) allows for no curb space appurtenant to that lot (presuming a two -car garage). Parking is already a serious problem on Lido and this will exacerbate the problem. Retaining the existing lot lines provides for a more aesthetically pleasing development, with balanced space allocations that are best calculated to encourage scale, symmetry and open space. The proposed adjustment to the lot lines is ill- advised and will create an excessively dense, box -like development with a "walled -in" middle lot (Parcel 2). While it may be in the best interest of the developer to so dramatically decrease the size of the middle lot, it is not in the best interest of the neighborhood. In any event, the requested modification is not required by reason -of any hardship or circumstance related to the land itself which, as originally laid out, permits development of three single family dwellings (one on each lot). The personal enrichment of the applicant/developer is not a recognized justification for a modification and does not justify changing lot lines that were originally laid -out as part of a comprehensive plan that has been in place for many, many years. Approving of lot line modifications in the absence of compelling changes related to the land itself is a dangerous precedent, a disservice to the community, and contrary to the finality approved master plans should enjoy. Thom, which was executed on July 2, 1945, recorded in the Official Records of Orange County, California on July 25, 1945, and conveyed the subject properties, contains a power of termination, which reads as follows: "Upon breach of either or any of the foregoing conditions, title to said property hereby conveyed, and the whole thereof, shall become at once divested from the grantee herein, or her assigns, and then revert to and revert in grantor, its successors or assigns; provided, however, that any breach thereof, or reversion of titled [sic] thereunder shall not defeat or render invalid any lien of any mortgage or deed of trust made in good faith and for value." Enclosed is the best (and most legible) copy of the Deed I could find. Generally speaking, a power of termination expires thirty years after it is granted or preserved. Civil Code Section 885.030 addresses the expiration of powers of termination, as follows: "(a) A power of termination of record expires at the later of the following times: "(1) Thirty years after the date the instrument reserving, transferring or otherwise evidencing the power of termination is recorded. The title company has reported that no such notice was ever recorded. As mentioned above, the Deed was recorded on July 25, 1945. Based on information provided to me, no notice of intent to preserve the power was ever recorded. Accordingly, it is my opinion that, pursuant to Civil Code Section 885.030, the power of termination expired on or before July 25, 1975 and, therefore, the deed restrictions are no longer in force or effect. In addition, for your information, a power of termination expires if it becomes obsolete. Civil Code Section 885.040 provides in relevant part as follows: "(a) If a power of termination becomes obsolete, the power expires. "(b) As used in this section, a power of termination is obsolete if any of the following circumstances applies: "(1) The restriction to which the fee simple estate is subject is of no actual or substantial benefit to the holder of the power. Slopes, landscape, walls and other obstruction shall be considered in the sight distance requirements. Landscaping within the sight line shall not exceed twenty-four inches in height. 8. The when the drive approach is relocated, the existing drive approach shall be removed and replaced with curb, gutter and sidewalk along the'Irvine Avenue frontage. All work within the Irvine Avenue right-of-way shall be completed under an Encroachment Permit issued by the Public Works Department. 9. That prior to the issuance of any grading or building permits on Parcel 1, that a drainage plan be provided by the applicant and approved by the Building Department and Public Works Department showing how the drainage on this parcel will be handled. 10. That a minimum twenty foot (20') wide easement be provided across the northerly side of parcel 2 for the benefit of Parcel 1 for ingress, egress, drainage and public utility purposes. The easement shall be thirty feet (30') wide from Irvine Avenue to a minimum of ten feet (10') westerly of the Irvine Avenue right-of-way and then taper back to a twenty feet (20') wide easement about twenty feet (20') westerly of the Irvine Avenue right-of-way. The easement must be thirty feet (30') wide at Irvine Avenue in order to clear an existing fire hydrant. Commissioner Gifford asked for clarification of the responsibility of the Approved applicant to pay the costs related to the change in the signage. Staff answered that it has been the standard practice that if a street name change occurred, it would be the applicant's responsibility to pay for the signage. This practice is not worded as a condition. Chairperson Ridgeway clarified that this is a Newport Boulevard address and there are no signs currently posted for Hoag, it is in internal street that is being created. Staff affirmed this is correct and further clarified that typically once streets are named, they have street signs associated with them. This is for both private and public streets. This will become a named private street that typically would have signage in points where it connects to other streets. Chairperson Ridgeway stated in other similar situations, there were conditions pertaining to the installation of signs being the financial responsibility of the applicant, and asked if the sign locations had been established. Staff responded that there are no specific plans as yet, but reiterated that every time there has been a named private street, there have been signs installed. Based on that precedence it is assumed that the Hospital would desire signs for the private street. There would be some cost for this sign implementation. Commissioner Gifford noted that it is stated in the staff report that the purpose is to make it easier for patients and visitors to locate the entrances to the hospital and their destination buildings, and stated it is appropriate to have- signs. Public Hearing was opened. Mr. Lief Thompson, Vice President of Facilities Design for Hoag Hospital, 301 Newport Boulevard - spoke in answer to the questions raised by Commission. Regarding the names of the streets and entries off of Pacific Coast Highway and Hospital Road, Hoag Hospital would be willing to work with City staff to resolve the signage issue. Currently, there is a Hoag Hospital sign off Pacific Coast Highway and suggests that is a suitable sign to address the hospital. At the corner of Hospital Road and Placentia there are new Hoag Hospital signs on both comers of that intersection announcing that you have arrived at Hoag Hospital. They are willing to sponsor or pay for a sign at that intersection with the Placentia Street sign if it can be done so as not to cause confusion and is helpful to the public. Chairperson Ridgeway asked staff if this was acceptable, and staff agreed that it was. He also inquired of the two roads that are named Hoag, East and West. One is for the ambulance entrance and one for the main entrance, would there be required some sort of designation for an East and West Hoag Drive? Staff answered, typically yes, at those intersections where the Hoag Roads with different names intersect. The signage would be limited, particularly if there are no buildings addressed off one of the other streets. Mr. Thompson stated that the primary road will be Hoag Drive, and the consecutive addresses they propose would primarily reference that Drive. In the past, the Planning Commission has approved a street name change if the Police and Fire Departments, and a substantial' number of affected property owners, agree to said street name change. As this is an internal street, within the Hoag property boundaries, it is staffs opinion, that other property owners in the general vicinity, will not be affected by the proposed street name change.
