The agenda will be posted at least seventy-two (72) hours in advance of each regular meeting and the public will be allowed to comment on agenda items before the Zoning Administrator, as well as items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments to a reasonable amount of time, generally three (3) minutes per person. Project Summary A request for a modification permit to allow an addition to an existing single -unit dwelling with a garage that is considered legal nonconforming due to its interior dimensions. The modification permit is required because the applicant proposes an addition greater than 10 percent of the existing square footage of the dwelling without altering the garage for compliance. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Modification Permit No. PA2024-0007 (Attachment No. ZA 1). Haag Residence Coastal Development Permit (PA2023-0214) Site Location: 4003 and 4003 ½ Marcus Avenue 3. Project Summary A coastal development permit for the demolition of an existing duplex and the construction of a new 3-story, 2,629-square-foot, single-family residence with an attached 353-square-foot junior accessory dwelling unit (JADU) and a 449-square-foot attached 2-car garage. The project also includes the raising and reinforcing of an existing bulkhead for protection against coastal hazards. All improvements are located on private property. The project also included appurtenances such as walls, hardscape, and landscaping. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. PA2023-0214 (Attachment No. ZA 1). March 14, 2024 Page 3 Zoning Administrator Meeting Anderson Residence Modification Permit (PA2023-0216) Site Location: 2616 Clay Street 4. Project Summary A modification permit to allow a 738-square-foot addition to an existing 1,960 square foot single-unit residence where the Newport Beach Municipal Code (NBMC) only allows up to a 10% addition for properties with non-conforming parking. The project will involve remodeling of the single-unit residence and the construction of a 738 square foot, two-story addition. The existing garage is considered non-conforming due to width, as one of the parking spaces in the garage has an interior clear dimension of approximately 9 feet 3 and 1/2 inches instead of the 10-foot width required. The other parking space within the garage complies with the NBMC. The total square footage of the proposed residence (including garage) would be 2,699 square feet. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Modification Permit No. PA2023-0216 (Attachment No. ZA 1). CDM Properties LLC Residential Condominiums Coastal Development Permit and Tentative Parcel Map (PA2023-0235) Site Location: 303 Goldenrod Avenue 5. Project Summary A tentative parcel map and coastal development permit (CDP) for condominium purposes. The property owner proposes to demolish an existing residential duplex and build a new two-unit residential condominium building. The tentative parcel map would allow each unit to be sold individually. No waivers of Title 19 (Subdivisions) are proposed for this project. A CDP is required because the project site is located within the coastal zone. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315 under Class 15 (Minor Land Divisions) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, March 14, 2024 Page 4 Zoning Administrator Meeting because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving the Tentative Parcel Map and Coastal Development Permit (Attachment No. ZA 1). V.PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers’ time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
