CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator Daniel Kopshever, Assistant Planner Jerry Arregui, Planning Technician II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF MARCH 14, 2024 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 McGinnis Residence Coastal Development Permit (PA2023-0169) Site Location: 4901 Seashore Drive, Units A & B Council District 1 Jerry Arregui, Planning Technician, provided a brief project description stating that the Applicant proposes to demolish an existing duplex within the R-1 coastal zoning district to construct a new three-story, 2,403-square- foot, single-unit residence with a 182- square-foot junior accessory dwelling unit (JADU) and a 387-square-foot attached two-car garage. Zoning Administrator Murillo stated that the property is located at the corner adjacent to the 49th Street street- end which provides a public viewshed towards the beach. Zoning Administrator Murillo directed staff to include an additional condition of approval to state that the proposed landscaping shall be maintained within the private property and not encroach over or into the public right-of-way. Applicant Eric Trabert of Eric Trabert and Associates, on behalf of the Lisa McGinnis, stated that he had reviewed the draft resolution and agrees with all the required conditions as modified. Zoning Administrator Murillo opened the public hearing. A member of the public, Ryan Selewicz, inquired if there were any proposed changes to the existing wall abutting their property. He also expressed concerns of visibility when pulling out of the garage onto the bike path. Another member of the public, Jim Mosher, spoke and thanked Zoning Administrator Murillo for his attention to the public view sheds. Zoning Administrator Murillo closed the public hearing. Applicant Eric Trabert confirmed that property line wall abutting Mr. Selewicz’s property would remain in place. Action: Approved as amended MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 03/28/2024 Page 2 of 3 ITEM NO. 3 Baja Sharkeez Limited Term Permit and Coastal Development Permit (PA2023-0247) Site Location: 110 and 114 Mc Fadden Place Council District 1 Daniel Kopshever, Assistant Planner, provided a brief presentation stating that the project is for a limited term permit and coastal development permit to maintain an existing 765 square foot outdoor patio for the duration of one year. Mr. Kopshever stated that the outdoor dining area was first permitted through an Emergency Temporary Use Permit and Emergency Coastal Development Permit on June 5, 2020, and has since been extended each year with subsequent limited term permit and coastal development permit applications. Mr. Kopshever stated that code enforcement had reported no issues with the outdoor patio and then described the conditions of approval imposed by the Planning, Building, Fire and Public Works departments. Applicant Eric Levitt of Baja Sharkeez, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all the required conditions. Zoning Administrator Murillo opened the public hearing. One member of the public, Jim Mosher, spoke and stated that recent aerial photos of the parking lot for the proposed outdoor patio use has been occupied by vehicles parking in tandem, and by trash or recycling dumpsters. Zoning Administrator Murillo closed the public hearing. Applicant Eric Levitt stated that the satellite images are likely taken in the morning, since the parking lot is used for deliveries and staging in the morning before the business is open to the public. Zoning Administrator Murillo responded to Mr. Levitt and added that he makes sure there is sufficient parking during operational hours per the approved plan. He also added that there would be no further extension of the limited term permit and coastal development permit for the project, and they will expire at the end of this year. Should the applicant wish to make the outdoor patio use a permanent part of the business, then an amendment would be needed for a use permit. Action: Approved as amended V. PUBLIC COMMENTS ON NON-AGENDA ITEMS One member of the public, Jim Mosher, complimented staff for including electronic bookmarks to the staff reports and attachment pages. VI.
