It appears the city is considering charging a fee to the disabled which will be an additional barrier to those the lift is intended to help gain access to Newport Harbor. Please remove these new fees from consideration (they are #27 and #28 below). As a city, we can afford to provide this service at no fee. Let's do the right thing here. Dear Newport Beach City Council: By copy of this email to Supervisor Katrina Foley, I would like to take this opportunity to remind you that the County required a human lift at the new public dock at Balboa Marina. Many ADA advocates worked very hard to get this lift installed at 1901 Bayside Drive where ADA access had been blocked by OCSD for several years. The CCC Enforcement and Permitting staff intervened and had many of the problems at Bayside Drive corrected, but it feels like deja vu here at the Balboa Marina. Based on the CCC's EJ Policy, ADA access is very important AND required- -it's just as important as public access for those that do not have mobility issues. It would appear as though the City is not aware of the CCC's EJ Policy and has chosen to ignore the County's directive to provide ADA access. It's rather impossible to believe that the City would even consider charging for ADA access. With this in mind, I ask that you remove the fees that are listed in the rate sheet attached - items 27 and 28. The City is ready to pat themselves on the back for this "newest, largest pier that will offer more opportunities for public recreation" but never mention that it comes at a cost - at least to the ADA community. How unfair is this? Please, do the right thing - please don't force the CCC to once again have to step in or the County. The right thing, the fair thing, is to provide FREE public access to the ADA community. Have a heart for goodness sakes! Take the initiative for a change and do what is right and what is fair. I can't reiterate this enough. I reviewed the City Council Agenda #14 Staff Report and wish to express my concerns with the $200 charge for assisting visiting boaters to get on or off of a mooring. Avalon Harbor charges nothing and is quite diligent in ensuring that boaters are safely moored. They maintain the tackle necessary to pick up or leave a mooring. Newport Harbor does none of that. I have a boat in mooring field C and have helped visiting boaters to the C field trying to pick up a mooring without mooring lines or a spreader line. Unless a visiting boater has a dinghy in the water, it is impossible to pick up a mooring alone, especially if the crew is just one other person, often the spouse of the captain. Another concern is, the staff report couches this fee as the cost of maintaining crew in the evening. Regardless of whether the crew is needed to assist boaters at night or not, they are still on duty, so why the extra charge. The staff report also does not make clear if the $200 will be charged only to boaters requiring assistance after hours. Finally, who determines "after hours." Are we talking bankers' hours, office hours, or boaters' hours (i.e., 24/7). In my view the charge runs counter to the culture of boating - All for one and one for all. Richard A. Dear City Council, Upon reviewing attachment A for Agenda item #14 for the April 23 City Council meeting, I noticed many of the proposed fee increases are moderate and reasonable. I understand that operating costs continue to rise, and it is refreshing to see moderate increases for items such as parking permits either staying the same or increasing by only a few dollars. I would also like to commend the current simple rate structure for the on and off -shore mooring rates, which are increasing a reasonable 2%. However, I was startled when I saw some of the other proposed harbor fees. The current impound fee for a dinghy is $iio, and that is now jumping over i00% to $243? This increase doesn't seem in line with the way other fees are increasing around the city and in the harbor. I have to wonder what the motivation is for this fee increase, considering it would mostly target a specific group- mooring holders. Mooring holders are already under stress when it comes to limited dinghy access. I hope the city will reconsider this extreme increase. It seems unfair to charge such a high fee, especially to mooring holders who already tend to be of low, moderate, or fixed income. There are many other options, such as a graduated fee scale ( ist time, $5o fee, end time $too fee, etc) or improved dinghy access. Thank you, Anne Stenton Public Comment — Newport Beach City Council Meeting - 04/23/2024, Agenda Item #14, "...Revising Certain Fees Within the Schedule of Rents, Fines and Fees...": Received after Agenda Printed Mayor and Council, April 23, 2024 Item No. 14 As related to the City's "ATTACHMENT A", under "BEFORE AND AFTER ILLUSTRATION - HARBOR DEPARTMENT SERVICE FEES", line item 17 c), "Guest Moorings - Offshore - Per Lineal Foot (LF)/Per Night", please refer to the excerpt page, attached hereto. The "Proposed" and current "Fee" of $1.42 per LF Per Night, applied to one of the most of common mooring lengths in Newport Harbor, a 40-footer, pencils out to $56.80 a night, which would equate to $1,727 per month. This is only about $300 less per month, than rates for a well-appointed slip at the City's Balboa Yacht Basin Marina. The setting of such an extraordinarily high offshore mooring guest rate, dissuades boaters. This, in conjunction with the City prohibiting mooring permitees from subletting their own permitted moorings, are primary contributors to the fact that approximately 100 moorings here, sit unoccupied on any given day (Note that the City does allow pier permittees to rent out their docks). The level of mooring vacancy, is more a product of a managerial approach of over -pricing, and restricting availability, than it is a scarcity of supply. Inaccurate data, and artificially inflated rent/fee prices result. Pricing under The City's new "Mooring License Program", likewise suffers from an artificially high demand. Under the program, a great number of applicants, sought a very limited number of moorings. Near 20 applicants each, for a single 30', and single 40' mooring. Logically, those interested in a mooring, would rather obtain a License at a lower fee cost, than rent as a "Guest", for a much higher fee cost. Many people seeking something in very limited supply, creates inflationary pressure. Here again, the City has played a part in creating limited supply, with the pricing and restrictions it applies to the 100 or so vacant moorings. Moreover, it makes little sense for the City to charge less in fees for Mooring Licenses, where the tackle/hardware is maintained at public expense, and charge much more in fees for "Guest" use of a Permit holder's vacant mooring, where the City does not incur the expense of maintenance. And important to note, is that reference to CPI based adjustments for Line Items 17 (j and (k "Note [b]" for onshore and offshore mooring Fees in the schedule before you tonight, would instead be swapped out under Harbor Commission recommendation, for increases based upon a higher than realistic comparison percentage of well- appointed Marina slips to moorings. A scenario of much higher fees going forward is the likely result, especially considering City plans to rebuild Balboa Yacht Basin. (Please see the attached "Mooring Rental Rates Phased -in", and Documents showing 3 years of price increases at the City's Balboa Yacht Basin Marina) Dispensing with the use of customary, and broadly accepted and applied CPI adjustments, and/or established, and regularly reviewed State Benchmarks, will lead to substantial Fee increases. The transformation of bay/ocean access from a diverse group, of lesser means, to a more exclusive and affluent group, is in actuality, a Phasing -out of the former. Claiming to spread the Phase -out over "almost 6 years", does little to quell the broken hearts, and stolen dreams of the boaters and their families who will be detrimentally affected. (The Transfer Fee of $1,181.40 1 paid in October 2023, will increase to $4,327.20, best case scenario, after phase -in) 3) It would be helpful to review Pier Permit Fees at the same time as Mooring Permit Fees, so that the disparity of the affluent paying near to State Benchmark Rates, while the less affluent pay multitudes more, and over a greater calculated square footage, can be addressed in tandem. The city wins when it sublets (rents out) a permitted mooring because the underlying permit holder pays for the amenity/tackle. It costs the city nothing. All revenues go to the city. 2. The existing sublet rate is too high as evidenced by the number of vacant moorings through the harbor (roughly 100 each day). The sublet rate for a 40ft boat is $1,727 per month. 3. The city should lower the sublet rate until to make these sublet (guest moorings) more affordable and available to the average boater. 4. Many sublet moorings are available every summer when the mooring holder sets out for Long voyages. They are also available in the winter when boats are at shipyards for overhaul. 5. The city is creating a false scarcity of moorings in Newport Harbor by setting these sublet rates way too high. 6. It is concerning that the Harbor Commission has used interest levels in the recently rolled out mooring license program (16 moorings) as justification to raise permit rates when, in fact, roughly 100 moorings are available but unrented each day due to the high sublet rate set by the city. Notes: No increase in rates until January 1, 2025. Six Proportionate increases over almost 6 years. BYB (Balboa Yacht Basin) rates are based on the City adopted Marina Index of 5 marinas in Newport Harbor per the Netzer appraisal. January 1, 2025 and July 1, 2025 increases are about one -tenth the difference between current rates and the adjusted FMV. Each fiscal year beginning July 1, the annual adjustment is about one -fifth the difference between current rates and the adiuqted FMV. In addition to the rate increases shown in this spreadsheet, Each year the increase will be adjusted based on 24% of the annual adjustment percentage per the City Marina Index for slip rentals. In otherwords, what you see on this matrix is not what you get. The rate increases will exponentially compounded by the annual rate increases of the Balboa Yacht Basin (BYB) slip fees, which irrationally serve as the index for the unrelated "water only" mooring permit fees. Over the last few years, slips rates at BYB have gone up ;t;15% at the BYB. With this in mind, we have applied 15% slip increases on the 40ft column to illustrate what the mooring rate increases may really look like under this plan. This ADA accessible human lift is designed to provide disabled users of the public dock with affordable access to the facilities, which are located on public tidelands. Unfortunately, these proposed fee increases defeat this purpose by creating significant financial barriers for persons who already face physical barriers to dock access and may be in potential violation of the ADA. The proposed fee of $117 for the use of the ADA accessible human lift at the Balboa Marina Public Dock presents an unnecessary barrier for low-income users of the facility. The justification for this fee does not take into account medical or personal emergencies that may be beyond a users' control. Public facilities, especially those that serve physically disabled residents, should not have barriers to their use by the governing authority. In addition, the inclusion of this ADA accessible lift in this public dock system on public tidelands is a requirement of Section 25 of the lease agreement between the County of Orange and the City of Newport Beach, dated March 19, 2024, which reads in relevant part: "In addition to the foregoing ADA compliance required of [City], [City] shall provide an accessibility lift to facilitate access and use of the public docks and vessels tied thereto for disabled and handicapped boat users, including those in wheelchairs. Tenant shall also provide a means for the public to reserve use of the wheelchair lift. The wheelchair lift shall be operated by Tenant at Tenant's sole cost and expense." While this lease section does not speak directly to the ability to charge a fee, the implication is that the lift should be open and available to "disabled and handicapped boat users, including those in wheelchairs." Creating an onerous fee structure that would impair the access to the lift could be contrary to this lease provision Proudly serving the cities of Aliso Viejo, Costa Mesa, Dana Point, Irvine, Laguna Beach, Laguna Hills, Laguna Niguel, Laguna Woods, Newport Beach, San Clemente, San Juan Capistrano and the unincorporated areas of Coto de Caza, Emerald Bay, Ladera Ranch, Las Flores, Rancho Mission Viejo, Stonecliffe, and Wagon Wheel Mayor O'Neill and Members of the City Council April 23, 2024 Page 2 of 2 and the very idea of creating ADA accessible accommodation. Hello Adam Lever, First of all, thank you for providing detailed information. We all appreciate your hard work and dedication in this important and crucial matter for the mooring permittee and live -bearers. Second, I sold my boat on Monday (yesterday) as the result of unprecedented mooring rate hikes. I am in the process/debate of selling my mooring if the discriminatory and unjustified hikes are passed by the city. Last, our moorings practically will be worthless after couple years (rate hikes). We are not looking for miracles or handouts but I wish we had someone to listen and look at our provided documents. The conflict of interest in provided appraisal by harbor commission (the back and forth email and tights). and why they are not looking at independent/3rd party appraisal. So many things to be aware of.
