Commission to express support of the subject application. He
stated that the sign would identify Calty Design off of Bison
Avenue.
Mr. Kelly O'Gorman appeared before the Planning Commission
on behalf of the applicant, and he concurred with the findings and
conditions in Exhibit "A".

contrary to the purpose of Chapter 20.06 of the Municipal.
Code, or the North Ford Planned Community Development
Standards, and will not be materially detrimental to the
health, safety, comfort or general welfare of persons
residing in the neighborhood, or detrimental or injurious to
property or improvements in the neighborhood, or to the
general welfare of the City.
CONDITIONS:
1. That development shall be in substantial conformance with
the approved plot plan and elevations, except as noted
below.
2. That the applicant shall obtain a building permit for the
proposed sign prior to installation.
3. That the light source shall be shielded from the view of
neighboring residential properties to prevent glare and light
spillage to neighboring properties.
4. That all improvements be constructed as required by
Ordinance and the Public Works Department.
5. That the proposed sign be placed at the intersection of the
private drive and Bison Avenue so that it conforms to the
City's Sight Distance Standard 110-L and that the existing
tree branches be trimmed back to provide sight distance in
conformance with City sight distance standards. Slopes,
landscape, walls and other obstructions shall be considered
in the sight distance requirements. Landscaping within the
sight line shall not exceed twenty-four inches in height.

Application
This is a request to permit the construction of an off -site ground identification sign for Calty
Design, on property owned by Mariner's Church, in Area 1 of the North Ford/San Diego
Creek Planned Community. The proposed sign will be located at the entrance of an access
drive which the Mariner's Church shares with Calty Design. The construction of any off -site
signs are subject to securing the approval of an exception permit as outlined in Section
20.06.060 of the Newport Beach Municipal Code.
Environmental Significance
The proposed sign has been reviewed and it has been determined that it is categorically
exempt from the requirements of the California Environmental Quality Act under Class 11
(Accessory Structures).

Conformance with the General Plan
The subject property is designated for "Government, Educational & Institutional Facilities"
use by the Land Use Element of the General Plan. The proposed sign is located off -site
on property owned by Mariners Church, a permitted use within this designation. The
proposal is consistent with the Land Use Element policies and guidelines and the North
Ford/San Diego Creek Planned Community Development Standards.
Mi ject Property and Surrounding Land Uses
The subject property is located on the northeasterly corner of Bison Avenue and Jamboree
Road in the North Ford/San Diego Creek Planned Community. To the north, is the Calty
Design Center, the subject of the proposed identification sign; to the east, is the United
States Post Office and an Edison utility yard; to the south, across Bison Avenue is attached
and detached residential property; and to the west, across Jamboree Road are detached
single-family residential uses.
Analysis
As shown in the attached plans the proposed off -site sign, located on Bison Avenue, is
located at the northeasterly corner of a signalized intersection which serves as the entrance
for both Mariners Church and the Calty Design Center. The applicant intends to replace
an existing freestanding wood sign located at the same location which stands approximately
7± feet high and 5± feet long and which has copy identifying Mariners Church and Calty
Design. No building permits have been found for the original construction of the existing
sign.
A monument sign located on Bison Avenue is permitted by the North Ford/San Diego
Creek Planned Community Development Standards to identify an on -site facility; however,
an off -site identification sign is subject to review of an exception permit. The total square
footage of copy face on the proposed monument sign is 56± square feet and measures 3
feet 6 inches high. The signage for the most part is oriented toward Bison Avenue and
poses no adverse impact to the residential uses in the vicinity of the project.
The Public Works Department has indicated that the proposed monument sign and any
landscaping located at the intersection be limited so as not to impair sight distance of
vehicles exiting the subject property. The appropriate condition of approval has been
incorporated into the attached Exhibit "A".
Applicant's Statement of Support
In accordance with Section 20.06.090B of the Newport Beach Municipal Code, in order to
grant an exception permit, the Planning Commission must hind that the granting of such
permit is necessary to protect a substantial property right, will not be contrary to the

purpose of Chapter 20.06, and will not be materially detrimental to the health, safety,
comfort or general welfare of persons residing in the neighborhood, or detrimental or
injurious to property or improvements in the neighborhood, or to the general welfare of the
City.
In response to the above requirements, the applicant has submitted the following statements
in support of his application:

on their property to show the Catty location.
4. Why will the proposal not be detrimental to the neighborhood? "No, because there
is an existing wood sign now and Catty would like their sign to match Mariners
Church sign."
,Specific Findings and Recommendations
It is staffs opinion that the proposed signage is reasonable in location and square footage
and is necessary for informational as well as directional purposes. It is staffs further
opinion that inasmuch as the sign is oriented toward the intersection of Bison Avenue and
the entrance to the subject property, the proposed sign will not have an impact on the
residential uses directly across Bison Avenue. Should the Planning Commission wish to
approve this application the findings and conditions set forth in the attached Exhibit "A" are
suggested. Staff cannot reasonably make any findings for denial, and therefore, no exhibit
is provided.

This letter is an authorization to permit Toyota Motor Sales, USA, Inc. through
its agent Czysz Construction, Inc., to:
1. Apply for Sign Approvals and Permits on the access easement..
2. Construct and install signs once approvals and
permits have been obtained.
Although this work will occur on Mariners Church property, it is located within
the access easement to Calty Design. A license is being granted by Mariners to
Calty to include signage.
