FINDINGS FOR DENIAL
EXCEPTION PERMIT NO. 32
1. That the granting of this exception permit is not
necessary to protect 'a substantial property right
of the property owner or the applicants inasmuch as
the existing use of the property. Gould continue and
all uses provided for the "Retail. and Service
Commercial." portion of the. SP-6District would
continue to be permitted. Further, the hair salon
at 2817 Villa Way is permitted on -site signs
consistent with the requirements of Chapter 20.06
of the Municipal Code.
2. That the proposed off -site sign will be contrary to
the purpose of the Sign Ordinance.
3. That the proposed off -site sign will be detrimental
to the health, safety, peace, morals, comfort, and
general welfare of persons residing and working in

The Land Use Element of the General Plan designates the,site for a mixture
of "General Industry" and "Retail and Service Commercial", uses. The.iocal
Coastal Program, Land Use Plan designates the site for "Retail and Service
Commercial" uses ;only. These documents do not Address, the use of signs in
such areas; therefore, no conflict appears to exist.
Subject Property and guir2unding Land Uses
The lot on which the subject sign is located functions as one ,property.with
the. adjacent lot on, the west. The two lot .parcel is occupied by an
industrial building and by a parking lot previously uttlized for.,parking by
the restaurant' at -2813 Villa sway,, across Villa Way from the subject
property. To thw north, across a 14-foot wide alley, is a marine industrial
use and a'yacht broker;" to the east, across Lafayette Avenue are office and
retail uses; to the south, across the Lafayette Avenue/ Villa Way junction
is the Bay and a boat storage area; and to the west, across Villa Way, is a
mixture of offices and light industrial uses.
Background
On November 20, 1975, the Planning Commission approved Use Permit No. 1775,
which permitted the establishment, of an outdoor restaurant facility on the
property at 2813 Villa Way. Conditions of approval of Use Permit No. 1775
required that the restaurant proprietor obtain an:o£f-site parking agreement
providing for a minimum of 6 parking spaces .at an approved location. An
off. -site ' parking agreement for use ' of 6' parking spaces at 2800 Villa, Way,
directly across the 40,foot wide -Villa Way right of way from the restaurant
was approved by'the Planning Commission on November 20, 1975 and by the City
Council on 0acei tuber 22, 1975.
On November 171 1977, the Planning `Commissi"ran approved an amendment, to Use

On July S, 1982, the Planning Commission denied Exception Patmit No, 11,
which was a request to install an off -site advertising.�gn on vacant
property located at 332 North, Newport Boulevard' in the 0-1•11 District,
Thus, no exception: permits providing for !-.he establishment of any permanent
off -site signs have been approved by the Planning Commission,`
Analysis
The applicant proposes to maintain.a 7 foot 6 inch high, 3.5 x 5 foot (17.5
-sq.ft.),`sign on property located at 2860 VillaLay in:, order to give
directions and advertise a hair salon at 2817 Villa Way, The hair salon is
located"55t feet from the subject property and 170± feet 4rom the sign
itself.
Ap$licant's Statement of Su22ort
In response to the requirements of the City's Sign Ordinance cited in detail
below, the applicants have submitted the following statements in support of
their application:

The public hearing was opened in connection with this
item, and Mr, Richard Ramos appeared before the Planning
Commission on behalf of the applicants, Mr,. Ramos
stated that thee beauty salon, Hair West, in beneficial
to Cannery Village; that the 3 1/2 foot by 5 foot
subject: sign is used as a parking designation for six
off -site parking spaces; that the sign assists customers
to the beauty salon's location which causes less traffic
confusion on Newport Boulevard; and at the location of
the beauty salon is isolated, unique, and the sign would
not set a precedent.
Ms., Linda: Lee, applicant, appeared before tale Planning
Commission, and in response to numerous qudutions'posed
to her by Commissioner Winburn, Ma. Leo replied that,the
subject Hair West sign has boon on the site for 2 1/2
months; that Hair West has been in business in ''Cannery
Villago for two years; and that, the artist drew `a seep on
the sign that the business owners had not requested.'"
Ms, Lee explained that she, has a verbal agreement with
the property owner to use five off -site parking spaces,
and the applicants are requesting the sign`try -identify
the parking spaces,; Ms. Lee .further explained that.`the
applicants intended to modify the sign by removing. the
map and drawing an arrow to the. assigned parking, area,

Koppelman, Ms. Lee .replied that the parking `arrangement

In response -. to 'questions _posed by : Commissioner Debay,
Ms. Lee concurred that it is difficult to read the sign
because of the design and the one-way street; that she
had not been informed by the property owners that the
sign would be in violation to the Sign Ordinance; that
the, cost incurred is $700.00; and that a redesigned nQn
would be aesthetically pleasing to the area.
In response to.a question posed by Commissioner Debay if
the Gabiano Restaurant's sign was_in violation, :Mr,
1°:wicker replied that the restaurant was required to
haveparking and a sign identifying the parking .lot. He
stated that the subject sign on the corner and ,the
manner in which it is displayed does not identify any

automobile height which states that. the parking spaces

Koppelman.Mr. Hewicker replied that if. the ;applicant
modified 'a sign as suggested by staff thtit:the Exception
Permit could be allowed; that the off -site parking`
spaces are not required spaces; that the 'parking ;area be
identified with.a. amall, sign across the parking spaces;
and display a sign.,in the :beauty ,salon that Hair West
has made `arrangements for additional parking.
In response to questions. posed by Commissioner Winburn,
Ms. Lee replied that, the parking agreement has not been
formalized; that the property owner agreed' to the sign;
and that a contractual agreement with the property owner
would not: be to: anyone's advantage.
In response ,to questions .posed .-by, Acting ..Chairman
Pomeroy, Ms. Lee replied.; that the applicants have an
agreement with the.property`owner that the; parking area
can be used by, Nair West': until the' building on . the
subject property has been leased for, ,anothor use; thati
the applicants. have;not commenced payment for .fire sign
awaiting the Plannir:g Commission's decision; and that.,
the applicants ;paid $300.00 to:,, the property owner for
the sign plus the cos.t.of the subject,applint►Lion.

In response to a question posed by Commissioner Debay
regarding the Sign Ordinance, Mr. Hewicker replied that
the Sign Code requires that an off•site,directional sign
is subject to the approval of an Exception Permit.
In response to questions posed by Commissioner Winburn,
Ms. Lee replied that if the parking spaces would not be
available is the future and the applicants had 'entered`
into a, formal parking agreement with the property owner,
the ,applicants would have to search elsewhere` for
additional parking spaces, Mr.,Hewicker explained that
the City does not require the beauty salon to provide
parking spaces for its business other than the existing
on -site parking spaces.
Commissioner Koppelman stated that the sign in the
present location is an advertisement and does not
ident!.fy a parking lot. Commissioner Kc,-ppalman stated
that she does not want to authorize off -site signs for
advertising. She said that she would consider
authorizing smaller signs in an appropriate place that
would direct people coming to the beauty salon .to the
parking spaces. that would be available to them. In
response 'to , a suggestion by 'Commias.ioner Winburn
regarding a continuation of the Exception Permit to July
7, 1988, Commissioner Koppelman..replied that she would
not approve an advertising sign,
There ,being' no `others desiring to appear and be heard,
the public hearing was closed at this time,,; '
Commissioner Di Sano. stated that he.concurred with
tVmfoiiiasioner.Koppelman's,foregoing statement, He::stated
be ''may. be 'supportive of,a sign ;for the off-si,ta
perking spaces if it would be a much smaller sign, and
if there would be a written agreement with the, property
owner that there is parking available.
