I. CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Benjamin M. Zdeba, AICP, Zoning Administrator Laurel Reimer, Consultant Planner Jerry Arregui, Planning Technician Laura Rodriguez, Planning Technician II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF APRIL 11, 2024 Zoning Administrator Zdeba acknowledged receiving written comments from Jim Mosher, a resident, suggesting updates to the minutes from April 11, 2024. He agreed that the suggestions were appropriate. In response to his asking, no one from the public wished to add further comments. Action: Approved as amended IV. PUBLIC HEARING ITEMS ITEM NO. 2 McBride Residential Condominiums Tentative Parcel Map and Coastal Development Permit (PA2024-0044) Site Location: 318 & 318 ½ Iris Avenue Council District 6 Jerry Arregui, Planning Technician, provided a brief project description stating that this item is a tentative parcel map and coastal development permit application for a two-unit condominium. A duplex has been demolished and a duplex is currently under construction. The Tentative Parcel Map will allow the development to be condominiums so the units can be sold individually. The property is located in the Coastal Zone, so a coastal development permit is also required. The duplex under construction has been reviewed through the plan check process and complies with all applicable development standards of the Local Coastal Program Implementation Plan. This project does not result in a net increase of residential units. Staff acknowledged that written correspondence was received from Mr. Mosher regarding the Tentative Parcel Map and why it shows the footprint of the existing building at the property, and about the property not being within the California Coastal Commission appeal area. Staff responded that the Tentative Parcel Map is only intended for the lot itself and not necessarily for the structure. The structure existed at the time the survey was conducted. On the recorded Parcel Map, no structures will be shown, just the parcel itself. Staff also responded that the public notice for this item included the proper appeal language, which will be carried over to the final resolution. Applicant Matthew Watson of Watson Legal Group, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all the required conditions. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved as amended ITEM NO. 3 Pirozzi Corona Del Mar (Foretti’s) Limited Term Permit and Coastal Development Permit (PA2023-0231) Site Location: 2929 East Coast Highway Council District 6 Laurel Reimer, Consultant Planner, provided a brief project description stating that the subject application is a request for a coastal development permit and limited term permit to allow a temporary outdoor patio area. Foretti’s has operated on site since 2014, and includes a permanent 323-square-foot outdoor patio area. The current request is to allow a 375 square foot expanded patio area until December 31, 2024. An expanded patio area was originally authorized on June 12, 2020, through an Emergency Temporary Use Permit and Emergency Coastal Development Permit and was extended in 2021 and 2022 through a Limited Term Permit and Coastal Development Permit, which expired on December 31, 2023. The patio will displace three onsite parking spaces and one accessible space will remain available at all times. Consultant Planner Reimer stated two public comments were received – one comment in support and one comment from an adjacent business owner who voiced concerns with extending the patio an additional year. Applicant Edmond Bourke, partner at Foretti’s, on behalf of the Pirozzi Corona Del Mar, stated that he had reviewed the draft resolution and agrees with all the required conditions. Zoning Administrator Zdeba confirmed for the record that Mr. Bourke is aware there is a Condition of Approval that states the Limited Term Permit cannot be extended past December 31, 2024, and they will have to pursue a permanent patio if they wish to keep the patio beyond that date. Mr. Bourke acknowledged the condition and said they may seek a permanent patio in the future since the community has really responded to the temporary patio. Zoning Administrator Zdeba opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Zoning Administrator Zdeba stated he reviewed the staff report and has been to the site and is familiar with the location. He acknowledged that parking in general is at a premium in Corona del Mar. He noted that he confirmed with Code Enforcement that no complaints have been received regarding the patio’s operation. He emphasized this is a limited term permit authorization and will only be valid through the end of the calendar year, at which time the patio will need to be removed. Action: Approved ITEM NO. 4 Beane Residence Coastal Development Permit (PA2023-0234) Site Location: 2632 Circle Drive Council District 2 Laura Rodriguez, Planning Technician, provided a brief project description stating that the item is for a coastal development permit application for the demolition of an existing single-unit residence and construction a new 3,784-square-foot single-unit residence and an attached 627 square-foot two-car garage. Ms. Rodriguez stated that the project complies with all zoning standards and is located within the Coastal Zone. She also stated that Condition of Approval No. 15 will be stricken, as it was a duplicate. Applicant Craig Hampton, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all the required conditions. Zoning Administrator Zdeba opened the public hearing. Planning Technician Rodriguez responded that the floor area for the purpose of determining required parking is only considering livable floor area. This would exclude the garage. Seeing that no one else from the public wished to comment, Zoning Administrator Zdeba closed the public hearing. Action: Approved as amended V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI. ADJOURNMENT The hearing was adjourned at 10:18 a.m. The agenda for the Zoning Administrator Hearing was posted on April 17, 2024, at 3:20 p.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on April 17, 2024, at 3:15 p.m. Benjamin M.
