TITLE: Balboa Pier Maintenance (Project No. 24H09) — Notice of Completion
for Contract No. 9323-1
ABSTRACT:
On September 12, 2023, the City Council awarded Contract No. 9323-1 for the Balboa
Pier Maintenance Project to Jilk Heavy Construction, Inc. of Brea. The total contract
award was $182,780 plus a $27,220 allowance for contingencies. The required work is
now complete, and staff requests that the City Council accept the completed work and
close out of the contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The Balboa Pier Maintenance project included replacing one damaged pier pile,
six damaged cross braces and their associated hardware. Contract No. 9323-1, for the
subject project, has now been completed to the satisfaction of the Public Works
Department. A summary of the contract construction costs are as follows:
Original bid amount: $182,780.00
Actual Cost of Bid Items Constructed: $182,780.00
Total Change Orders: $ 15,386.10
Final contract cost: $198,166.10
There were two change orders totaling $15,386.10. This amounted to 8.4% of the original
contract amount and was within the contingency allowance. The change orders covered
the unforeseen replacement of an additional cross brace and pile strap not included in
the original scope of work that had been damaged by storms after the bidding process
was complete.

Tidelands revenue is generated from the operation of the City's tidelands including rents
from moorings, piers and leases, as well as income from parking lots. Currently, the
operating expenditures of the Tidelands exceeds the revenues and is subsidized by the
General Fund.

ENVIRONMENTAL REVIEW:
On September 12, 2023, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Class 1 Section 15301 (rehabilitation of
deteriorated facilities involving no expansion of existing use) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
