TITLE: Balboa Boulevard, Newport Boulevard, and 32nd Street Pavement
Rehabilitation — Award of Contract No. 8833-2 (22R11)
The City of Newport Beach has received construction bids for the Balboa Boulevard,
Newport Boulevard, and 32nd Street Pavement Rehabilitation project and requests City
Council approval to award the construction contract to R.J. Noble Company of Orange.
This project will reconstruct deteriorated concrete improvements and rehabilitate the
existing pavement on Balboa Boulevard, Newport Boulevard, and 32nd Street. This project
also includes pedestrian safety and traffic signal enhancements at the intersections of
Balboa Boulevard and 14t" Street and 13t" Street.
RECOMMENDATIONS:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301(c), Class 1 (maintenance of existing public facilities
involving negligible or no expansion of use) of the CEQA Guidelines, because this
project has no potential to have a significant effect on the environment;
b) Approve the project plans and specifications;
c) Approve Budget Amendment No. 24-078 appropriating $42,000 in new revenue and
expenditures from Orange County Sanitation District to Account No. 13501-980000-
22R11;
d) Award Contract No. 8833-2 to R.J. Noble Company for the total bid price of $5,119,060
for the Balboa Boulevard, Newport Boulevard, and 32nd Street Pavement
Rehabilitation project, and authorize the Mayor and City Clerk to execute the contract;
and
e) Establish a contingency of $512,000 (approximately 10 percent of total bid) to cover
the cost of unforeseen work not included in the original contract.

DISCUSSION:
The City of Newport Beach has a Pavement Management Plan (PMP) that identifies
residential and arterial streets needing rehabilitation throughout the city. Both Balboa
Boulevard and Newport Boulevard are heavily used arterials and are in need of
rehabilitation. Additionally, a portion of 32nd Street, not previously improved with the
Newport Boulevard and 32nd Street intersection improvements, will be rehabilitated.
These improvements will complete the approximate 15- to 20-year arterial pavement
rehabilitation cycle efforts for the majority of the Balboa Peninsula.
At 10 a.m. on May 2, 2024, the City Clerk opened and read the following bids for this
project:

The City received five bids for this project. The low bidder, R.J. Noble Company,
possesses a California State Contractor's License Classification "A" and its electrical
subcontractor, California Professional Engineering, Inc., possesses a California State
Contractor's License Classification "C-10", as required by the project specifications. A
review of references for R.J. Noble Company shows satisfactory completion of similar
contracts for the City and other agencies. R.J. Noble Company is also currently working
on two separate contracts for the City and the California Department of Transportation
(Caltrans) within the city limits.
The low bid was 1.6% percent above the Engineer's Estimate of $5,039,000.00. This
minor difference was primarily attributed to the increased cost for construction surveying.
All five bids were relatively close to the Engineer's Estimate.
This project includes cold milling and overlaying the existing asphalt concrete pavement
with new rubberized asphalt concrete pavement; reconstructing deteriorated concrete
driveways, sidewalks, curb and gutters, curb access ramps, and cross -gutters; adjusting
utility boxes and manholes to grade; installing new traffic signs; installing new pedestrian
safety enhancements at the intersections of Balboa Boulevard and 13t" and 14t" Streets;
restriping pavement; and other appurtenant items of work. Refer to the attached location
map for limits of proposed improvements.
Pursuant to the contract specifications, the contractor will have 90 consecutive working
days to complete the work. Work is scheduled to start in July (or sooner) in order to
complete the improvements adjacent to Newport Elementary School prior to the start of
the 2024-25 school year.

This project is part of the state's CalRecycle Rubberized Grant Program. This program
promotes the use of rubberized asphalt concrete made from recycled waste tires
generated in California. The program aims to decrease the adverse environmental
impacts created by disposing and stockpiling of waste tires. Through CalRecycle, the City
will be reimbursed up to $7 per ton of rubberized asphalt concrete used on the project.
The project plans and specifications will be available for review at the May 28, 2024 City
Council meeting or upon request.
FISCAL IMPACT:
Upon approval of the proposed Budget Amendment, sufficient funding is available from
the current Capital Improvement Program (CIP) budget for the award of this contract.
Although this project is included in the FY 2023-24 CIP, funds from the proposed
FY 2024-25 CIP will also be required.

Gas Tax revenue is received through State imposed taxes on fuel and motor vehicle
registration dedicated to transportation purposes. The Orange County Transportation
Authority provides Measure M funding, generated through a'/z cent sales tax, to the City
for transportation improvements projects. The Neighborhood Enhancement Fund is used
for projects that enhance neighborhood aesthetics and functionality and is funded via
surplus general funds. The Water Capital and Wastewater Enterprise funds generate
revenue primarily through water and sewer rates collected by service users. The Orange
County Sanitation District will reimburse the City for improvements to its facilities.

Staff recommends establishing $512,000 (approximately 10 percent of total bid) for
contingency purposes and unforeseen conditions associated with construction.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance
of existing public facilities involving negligible or no expansion of use) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has
no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
