Zdeba, AICP, Zoning Administrator The City of Newport Beach will conduct the Zoning Administrator meeting via Zoom. The agenda will be posted at least seventy-two (72) hours in advance of each regular meeting and the public will be allowed to comment on agenda items before the Zoning Administrator, as well as items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments to a reasonable amount of time, generally three (3) minutes per person. Recommended Action Approve and File June 13, 2024 Page 2 Zoning Administrator Meeting IV.PUBLIC HEARING ITEM(S) Gelatissimo Gelato Minor Use Permit (PA2024-0062) Site Location: 304 Marine Avenue 2. Project Summary A minor use permit to allow a gelato shop (take-out service, fast casual) within an existing single-story commercial building. The applicant is proposing minor modifications to the façade and interior of the building. No late hours (after 11:00 p.m.) or alcohol service are proposed as a part of this application. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit filed as PA2024-0062 (Attachment No. ZA 1). 1331 Antigua Newport Beach LLC Residence Lot Merger (PA2024-0018) Site Location: 600 Seaward Road 3. Project Summary A lot merger application for two parcels under common ownership by removing the lot line that separates the front and rear lots, to allow for future improvements across the existing interior property line. The front lot is developed with a single -family home, while the rear lot is undeveloped with the exception of accessory structures such as planters and fencing. This undeveloped area currently acts as a backyard for the home. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315, under Class 15 (Minor Land Divisions) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving a Lot Merger filed as PA2024-0018 (Attachment No. ZA 1). June 13, 2024 Page 3 Zoning Administrator Meeting Doan Residential Condominiums Tentative Parcel Map and Coastal Development Permit (PA2024-0033) Site Location: 2501 Seaview Avenue 4. Project Summary A tentative parcel map and a coastal development permit (CDP) for two-unit condominium purposes. A duplex has been demolished and a new duplex is under construction. No waivers of Title 19 (Subdivisions) of the Newport Beach Municipal Code are proposed. The tentative parcel map will allow each unit to be sold individually. A coastal development permit is required because the property is in the coastal zone. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315 under Class 15 (Minor Land Divisions) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Tentative Parcel Map and Coastal Development Permit filed as PA2024-0033. (Attachment No. ZA 1). Aflatoon Residence Coastal Development Permit (PA2024-0051) Site Location: 434 Harbor Island Drive 5. Project Summary A coastal development permit (CDP) to allow the demolition of an existing one-story, single-unit residential dwelling and the construction of a new 4,148 square foot two-story residential dwelling unit and a 613 square-foot attached garage, and a 337 square foot attached accessory dwelling unit. The project includes raising the existing bulkhead. The project complies with all applicable development standards and no deviations are requested. The proposed development includes additional appurtenances such as walls, fences, patios, hardscape, drainage devices, and landscaping. All improvements authorized by this CDP will be located on private property. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect June 13, 2024 Page 4 Zoning Administrator Meeting on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit filed as PA2024-0051 (Attachment No. ZA 1). Allen Residence Coastal Development Permit (PA2024-0063) Site Location: 503 and 503 ½ 36th Street 6. Project Summary A coastal development permit (CDP) to allow the demolition of an existing two-story duplex and the construction of a new 2,208 square foot three-story residential dwelling unit with a 450 square-foot attached garage, and a 291 square foot junior accessory dwelling unit. The project includes raising the existing bulkhead. The project complies with all applicable development standards and no deviations are requested. The proposed development includes additional appurtenances such as walls, fences, patios, hardscape, drainage devices, and landscaping. All improvements authorized by this CDP will be located on private property. V.PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers’ time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
