The Building Code Board of Appeals met as the Re- habilitation Commission and conducted a public hearing regarding 3001 Cliff Drive in accordance with Chapter 15.28 of the Newport Beach Muni- cipal Code. Meeting was called to order at 4:02 p.m. at the Newport Beach Council Chambers by Chairman Brion Jeannette. B. Pledge of Allegiance C. Schuller, Building Director Donald Hunsicker, Sr. Building Inspector Carol Korade, Asst. City Attorney Julia Klein, Building Department Secretary Public Present: Peter S. Rodgers, Owner Frank Yokopec, Former Employee of Owner Jim Clarkson, Neighbor (arrived at 4:20) Roland E. Bye, Owner's Attorney (arrived at 4: 08) D. Minutes of the Rehabilitation Commission Minutes of November 78, 7987 were unanimously approved (Motion by Ray Cranston; second by John Wikle). E. Selection of Rehabilitation Commission The five Board Members attending were chosen to be on the Rehabi- litation Commission, which are: George Crall Ray Cranston Robert Fish Brion Jeannette John Wikle 3300 Newport Boulevard, Newport Beach F. Public Hearing 1. Staff Report Mr. Schuller stated that after the November 18th hearing, the Building Department sent a letter to Mr. Rodgers listing the sub- standard conditions at 3001 Cliff Drive. Peter Rodgers and his attorney met with City Staff on Friday, December 4, 7987 at the City Attorney's office. This meeting was attended by Assistant City Attorney Carol Korade, Peter Rodgers as Owner/Contractor of 3007 Cliff Drive, Roland E. Bye, Attorney for Mr. Rodgers, Don Hunsicker, Senior Building Inspector and Ray Schuller, Building Director. All those present agreed with the contents now shown in the Staff Report. Mr. Schuller reiterated that the City is mainly concerned with the exterior look which affects the immediate neighborhood and triggers the many complaints. Carol Korade stated that Mr. Rodgers will receive all interest which accrues on the Certificate of Deposit. When questioned by the Commission, Mr. Schuller stated that the latest plans have been approved and clean-up to City speci- fications will include removal of weeds, vegetation, junk, debris, combustible and similar material which constitute health and safety hazards. Completing the landscaping would not be nec- essary. Mr. Rodgers stated that he felt comfortable with and could agree to the bond amount and the work schedule which were discussed in the December 4th meeting. Chairman Jeannette expressed his appreciation to Staff and Mr. Rodgers working closely to come to a resolution on this issue. Chairman Jeannette suggested to the Commission advancing the due date of the progress reports by Mrs. Rosemary Rodgers one week, therefore being due on January 8, February 26, March 25 and April 29 in order to give the City advance notice if there is a problem meeting any deadlines. Mr. Jeannette also requested that the City be provided with certification letters from the architect and engineer confirming adherance to the plans. At this point, Mr. Clarkson arrived and was given a brief recap by Chairman Jeannette. Mr. Clarkson expressed concern about the reduction of the bond and noncompliance with deadlines based on past performance by Mr. Rodgers. Chairman Jeannette closed the public hearing and the Commission voted unanimously to set the following conditions: 1. Mr. Peter Rodgers will as soon as possible post a $40, 000 faithful performance bond in the form of a certificate of de- posit, agreeable in form to the City Attorney's office. 2. Mr. Peter Rodgers will have framing completed, inspected and approved by January 75, 1988. Thereafter, he will be permitted to reduce the bond to $30, 000. -2- 3. Mr. Peter Rodgers will have all interior drywall completed, inspected and approved by March 4, 7988. He will then be permitted to reduce the bond to $20, 000. 4. Mr. Peter Rodgers will have the exterior of the structure completely stuccoed and color coated by April 1, 1988. Up- on completion, he will be permitted to reduce the bond to $10, 000. 5. Mr. Peter Rodgers will complete the entire roof and clean up the outside of the property to City specifications in accord- ance with the Newport Beach Municipal Code by May 6, 7988. He will then be permitted to eliminate the faithful performance bond. 6. Mrs. Rosemary Rodgers will provide the Building Director with construction progress status reports on January 8, February 26, March 25 and April 29, 1988. Chairman Jeannette asked for a motion to continue the hearing as called. A motion was made by John Wikle and seconded by George Crall. G. There being no further business, the meeting was adjourned at 4: 25 p.m. The hearing stands adjourned until called. -3-
