TITLE: FY 2022-23 Playground Refurbishment — Notice of Completion for
Contract No. 8953-1 (23P01)
ABSTRACT:
On June 27, 2023, the City Council awarded Contract No. 8953-1 for the Fiscal Year
2022-23 Playground Refurbishment Project to R.E. Schultz Construction, Inc.
(R.E. Schultz) of Orange. The total contract award was $293,315 plus a $29,340
allowance for contingencies. The required work is now complete and staff requests the
City Council accept the work and close out the contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The FY 2022-23 Playground Refurbishment project included reusing the existing swing
set and Geoplex climber along with the installation of new play equipment and rubber
surfacing. The new play equipment is accessible from the ground level. Elevated
components meet the City of Newport Beach's desired safety levels and accessibility
compliance. Contract No. 8953-1 has now been completed to the satisfaction of the Public
Works Department.

There were three change orders totaling $7,753.76. This amounted to 2.6% of the original
contract amount and was within the contingency allowance. The change orders covered
the addition of a concrete pad for park benches, replacement parts to reinstall the existing
climber play equipment, and the replacement of a steering wheel on the rescue boat play
equipment.

Twenty-seven additional working days were granted to allow for the procurement of the
additional materials and hardware necessary to reassemble the existing climber in a new

The BET fund is used to account for property development taxes imposed on construction
and occupancy of all residential, commercial, industrial units, and mobile home parks for
which a building or construction permit is issued. BET funds can be used for acquiring,
improving, expanding and equipping City fire stations, City libraries and City parks as
provided by Chapter 3.12 of Newport Beach Municipal Code.
The General Fund is used to account for fiscal resources that are dedicated to
government operations of the City and are not required to be accounted for in another
fund.

ENVIRONMENTAL REVIEW:
On June 27, 2023, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Class 1 Section 15301 (rehabilitation of
deteriorated facilities involving no expansion of existing use) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
