HomeMy WebLinkAbout07 - Approval of PSA for Safety Program and Training Consulting ServicesQ EwPpRT c 9C/FOR TO: FROM: CITY OF NEWPORT BEACH City Council Staff Report June 25, 2024 Agenda Item No. 7 HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL Mark Vukojevic, Utilities Director - 949-644-3011, mvukojevic@newportbeachca.gov PREPARED BY: Casey Parks, Utilities Superintendent - 949-718-3477, cparks@newportbeachca.gov TITLE: Approval of Professional Services Agreement with EHS International, Inc. for Safety Program and Training Consulting Services ABSTRACT: The Utilities Department oversees and maintains the water, wastewater, storm drain, tidal valve systems, street sweeping, and streetlight operations for the City of Newport Beach. To ensure a safe working environment for all employees and maintain compliance with laws and regulations, various safety and training programs are managed by department staff. With the near constant change in regulations, the department proposes hiring a consulting firm to perform department specific employee training, audit current procedures, and update the department's safety programs. Staff conducted a request for bids and recommends City Council approval of a three-year agreement with EHS International, Inc. (EHS), for safety program and training consulting services. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Approve a Professional Services Agreement with EHS International, Inc., for safety program and training consulting services for a three-year contract term and a total amount of $330,000, and authorize the Mayor and City Clerk to execute the Agreement. DISCUSSION: The Utilities Department operates and maintains a wide variety of infrastructure and facilities for its six divisions. Utilities field staff are exposed to risks and occupational hazards on a daily basis. To ensure employee safety and maintain compliance with local, state and federal regulations, safety programs and standard operating procedures are in place. The Utilities Department management staff uses a combination of in-house staff and consultants to provide training for all field staff through approximately 20 unique programs. 7-1 Approval of Professional Services Agreement with EHS International, Inc. for Safety Program and Training Consulting Services June 25, 2024 Page 2 Training typically occurs annually or triennially, depending on current regulations and the department's needs. Examples of topics include the safe handling and storage of chemicals, electrical hazards, respiratory protection, confined space, crane operation, and spill prevention and response. With the wide range of training requirements, constant updates in regulations, personnel changes, and the significant time allocation for each of these critical items, especially when using multiple consultants, the Utilities Department is requesting an agreement with one consulting firm that can update existing safety programs, provide proper and ongoing training, and ensure compliance with future regulations. The one -stop -shop consultant service will allow the department to be more efficient and ensure the best possible compliance with safety regulations. The Utilities and Finance Departments issued a request for proposals (RFP) for safety program and training consulting services through the City's electronic bidding portal. The City received seven proposals. Of these seven, three highly qualified firms demonstrated their ability to perform all of the services listed in the scope of work. The three qualified firms are outlined below: Ranking BIDDER Combined Technical and Cost Ratio Score Out of 100 1St EHS International, Inc. 96.21 2nd A -Tech Consulting, Inc. 93.28 3rd Rizikon, Inc. 90.00 The cost file components included hourly rates for safety training, plans/programs, hazard assessment, inspections, meetings, industrial hygiene, and additional services listed by each vendor. The overall cost was competitive among the top three firms. EHS was the proposer with the highest combined technical and cost ratio score. EHS also comes highly recommended by several cities and water agencies in Orange County. Utilities staff met with EHS to discuss the expectations and responsibilities under the agreement. Based on these discussions and the consultant's references, Utilities staff believes that EHS's work plan, staffing, experience and use of technology demonstrate an exceptional understanding of what is necessary for the Utilities Department safety program. The Utilities Department recommends approval of a contract with EHS International, Inc. for a three-year term and a total contract amount of $330,000. FISCAL IMPACT: The budget includes sufficient funding for these training programs and consulting services. The one -stop -shop service will consolidate several different consulting contracts, staff programs, and department processes. Some internal budgets will also be consolidated so that the services will be expensed to the specific training account budgets across multiple Utilities Department programs in the Water, Wastewater, and General Funds. In the Water Fund, the training services will be expensed to 7019052-861003 - Training; in the Wastewater Fund, to 7119061-861003 - Training; and in the General Fund, to 0109062-861003 - Training (Storm Drain program) and 0109063-861003 - Training (Electrical Program) of the Utilities Department. 7-2 Approval of Professional Services Agreement with EHS International, Inc. for Safety Program and Training Consulting Services June 25, 2024 Page 3 ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
