I appreciate your assistance with our request to use a BBQ on our
outside patio area (Lanai). As I understand it, the Temporary Use
Permit is good for only ninety (90) days which should be sufficient
for our summer business.
I have enclosed the application along with a site plan indicating
the location of the BBQ and tables. Also enclosed is a copy of our
proposed menu. We only plan on operating Monday - Friday from
11:00 am to 5:00 pm.
A check for $200.00 for our filing fee is enclosed. Hopefully,
this application process won't take too long. If you need anything
further, just give me a call at (949)261-9013.

RE: Temporary use of outdoor dining area to allow
the use of a BBQ for the service of grilled food items
Applicant - David Salisbury, on behalf of the Newport Landing Restaurant
LOCATION: 503 East Edgewater, Newport Landing Restaurant
ACTION: Approval of a temporary use to allow the use of a charcoal BBQ for the service of
grilled food items. The duration shall be for a period of no more than 90 days. The
BBQ will be placed in an area of the approved outdoor dining located along the
boardwalk overlooking Newport Bay. The use will be from July 10, 1998 to October
10, 1998. Said use will be subject to the following:
Conditions:
1. That the applicant shall obtain approval of the site plan/BBQ location from the Fire
Department prior to the implementation of this approval. The Fire Department shall also
approve the storage of any flammable liquids associated with the BBQ use.
2. That the site and adjacent boardwalk area shall be maintained in a clean and orderly
manner. The applicant shall ensure that grease or debris (i.e., ashes, etc.) associated with
the BBQ use shall not enter the Bay. The Planning Director may require steam cleaning of
the boardwalk area, if necessary. The BBQ shall be stored indoors when not in use.
3. That this temporary use shall terminate upon evidence that the facility is operating in
violation of any of the above conditions of approval or upon receipt of unresolved
complaints.
4. This temporary use shall be allowed for a period not to exceed 90 days (October 10,
1998), after which it shall be removed. This approval cannot be extended.

APPENDIX
Background and Anala
The Municipal Code (Section 20.60.015B) requires that temporary uses or structures are subject
to the approval of a use permit prior to placement. The proposed BBQ use will serve patrons
during the summer months and will provide a limited menu of grilled items (copy of sample
menu is attached). The applicant has provided the attached plot plan describing the location. Staff
has also reviewed the existing Coastal Development Permit to determine compliance with that
approval. Staff has determined that the temporary use does not conflict with any specific
conditions of approval which apply to the subject outdoor dining area.
Staff has no objection to the temporary use of the BBQ for the following reasons:
• The BBQ will be utilized only Monday through Friday which will eliminate any adverse
impact on weekend tourist use of the outdoor dining area.
• The BBQ will not be utilized by or for the restaurant after 5:00 p.m..
• Staff has limited the duration of the BBQ use to 90 days from the date of this approval,
whichever is less.
• The proposed use does not conflict with the Coastal Permit which was approved for the
Restaurant and the adjacent outdoor dining area.
