COO, A--3 PACIFIC LIFE A Pacific Mutual ConVarry July 23, 1998 Ms. Patty Temple City of Newport Beach 3300 Newport Boulevard Newport Beach, CA 92658 Subject: Pacific Life 700 Newport Center Drive Temporary Tent Dear Ms. Temple: The design of our corporate office building, located at 700 Newport Center Drive, allows for a patio/plaza open air seating area adjacent to our employee dining room. During last years winter months and especially the rainy ones, we contracted with a local temporary tent manufacturer and had a tent installed for several months to allow for the outdoor dining to continue. This year and in future years, we would like to contim:e this. However, to help cut down on our costs and to let us more tightly control the maintenance of the tent, we would like to purchase our own tent and put it up and down as we like. Thus, we are submitting this letter as a request for a one time permit to allow us to put up and take down the tent at our convienece. We have attached a lowing indicating all of the pertinent information regarding surrounding areas, exiting, etc.. The tent will be used for outdoor dining as an extension to our main dining room. The approximate square foorage is 10,580 square fern. Pacific Life will have a maximum of 300 occupants and -provide a sign indicating that. These occupants would be employees from the building. The tent will be completely self supportive and not hung from or be supported by the existing building. Additionally, there will be exits from the tent at each of the ends to allow for proper exiting. We are proposing this to be a temporary tent since it will not be up all of the time. The tent would be up at any one time anywhere from 1 month to a maximum of 6 months. Jack, on behalf of Pacific Life Approval of a temporary use permit to allow the erection of a 10,580 sq. ft. tent -like structure to be utilized in conjunction with an adjacent office building cafeteria for a period of 90 days. The tent will serve as an extension of the dining area of the cafeteria and not as additional office space. The cafeteria serves tenants and employees of the subject office building and is not open to the general public. The approval will allow 90-day use while the applicant processes a general plan amendment to allow permanent use of the tent structure. Said use is subject to the following conditions of approval: Conditions: 1. That a building permit shall be obtained from the Building Department and the appropriate clean-up deposit shall be posted to insure maintenance and clean up of the subject property after removal of the tent structure. 2. That the tent shall be utilized only as an extension of the adjacent cafeteria use and not an independent use. 3. That the tent shall be utilized only during regular business hours of the facility and/or between the hours of 7:00 a.m. and 6:00 p.m., daily. Any use of the tent beyond those hours shall be subject to the approval of a special event permit issued by the Community Services Department. 4. That all employees shall park on -site. 5. That this temporary use shall terminate upon evidence that the facility is operating in violation of any of the above conditions of approval or upon receipt of unresolved complaints. 6. That the placement of the tent shall be allowed for a period not to exceed 90 days from the date of approval of the certificate of occupancy issued in conjunction with the building permit. Once the tent is removed, the applicant shall schedule an appointment with the Code Enforcement Division for an inspection to determine compliance with clean-up requirements. 7. This approval cannot be extended. Temporary uses in excess of 90 days shall be subject to the approval of a use permit approved by the Planning Commission. Temple, Planning Director Attachments: Appendix Letter from Applicant dated July 23, 1998 with photo Plot Plan and Elevations 2 APPENDIX Background Information submitted by the applicant indicates that the use of a rented tent structure has been approved in the past in conjunction with special event permits issued by the Community Services Department. The applicant however, will purchase the tent structure in order to have better quality control of the structure. Anal sis The tent will provide an area protected from inclimate weather during the winter months for cafeteria diners. Staff has conditioned the approval to prohibit the use of the tent after business hours, except in conjunction with the approval of a special event permit issued by the Community Services Department. The applicant will utilize the tent -like structure for a period of 90 days and is concurrently processing a general plan amendment to provide the additional entitlement required to retain the structure on a permanent basis. Recommendation Staff has no objection to the temporary use of the tent for the following reasons: • The tent will be utilized as an extension of an existing cafeteria use that serves the office building. • The hours of operation of the use of the tent should not adversely affect any neighboring uses since there are no residential uses or facilities providing overnight accommodations in close proximity to the subject property. • Staff has limited the duration for placement of the tent to 90 days from the date of the issuance of the certificate of occupancy.
