TITLE: Fiscal Year 2022-2023 Restroom Rehabilitation — Notice of
Completion for Contract No. 8905-2 (23F02)
ABSTRACT -
On November 28, 2023, the City Council awarded Contract No. 8905-2 for the Fiscal Year
2022-2023 Restroom Rehabilitation project to iBuild Spectrum, Inc. of Santa Ana. The
total contract award was $1,200,000 plus a $180,000 (15%) contingency allowance. The
required work is now complete, and staff requests the City Council accept the work and
close out the contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The Fiscal Year 2022-23 Restroom Rehabilitation project included various levels of repair
work at the Orange Street, 58t" Street, Port Carney Place, and Port Westbourne Place
restroom facilities. Work included the installation of new roof systems to better protect the
buildings, upgrades to new light emitting diode (LED) fixtures, updates to all plumbing
fixtures to meet American with Disabilities Act (ADA) standards, and installation of new
doors and gates at all entrances with automatic locking systems. Contract No. 8905-2
has now been completed to the satisfaction of the Public Works Department.
There were 18 change orders totaling $133,877.78. This amounted to 11.2% of the
original contract amount and was within the approved contingency allowance of
$180,000.00. The added work was primarily due to unknown conditions encountered
throughout the project during demolition and installation of the new roofs, as well as
adding ADA-accessible portable restrooms for the public. Removal of the existing roofing
systems exposed additional roofing members in need of replacement due to rot.
Additional exterior LED light fixtures were added to the Port Carney and Port Westbourne
restroom locations at the request of the community.

Due to contract change orders for unforeseen items as well as weather delays, the
contractor was granted 34 additional days to complete the project.

Funds for the construction contract were expensed from the Facilities Maintenance

On November 28, 2023, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Class 1 Section 15301(d) (rehabilitation of
deteriorated facilities involving no expansion of existing use) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
