HomeMy WebLinkAbout06 - Approving Side Letter Agreements with Labor Groups Representing City EmployeesTO: FROM: CITY OF NEWPORT BEACH City Council Staff Report September 24, 2024 Agenda Item No. 6 HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL Barbara J. Salvini, Human Resources Director - 949-644-3300, bsalvini@newportbeachca.gov PREPARED BY: Barbara J. Salvini, Human Resources Director TITLE: Resolution No. 2024-70: Approving Side Letter Agreements with Labor Groups Representing City Employees ABSTRACT: The City Council wishes to address the continued inflationary pressures City of Newport Beach employees are experiencing by extending prior side letters of agreement which provided a reduced employee retirement benefit contribution. If approved, this extension will impact employees who are members of the Newport Beach City Employees Association, Newport Beach Professional and Technical Association and Newport Beach Employees League. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly-, b) Adopt Resolution No. 2024-70, A Resolution of the City of Newport Beach, California, Approving Side Letter Agreements with Labor Groups Representing City Employees; and c) Approve Budget Amendment No. 25-018 appropriating $220,750 to various salary and benefit accounts. DISCUSSION: The City is currently in multi -year labor agreements with the Newport Beach City Employees Association, Newport Beach Professional and Technical Association and Newport Beach Employees League. The three agreements have an effective date of January 1, 2022, and expire in December 2025. The current Memoranda of Understanding (MOUs) cover wages, benefits and other terms and conditions of employment for these represented employees. Since entering the MOUs, the City Council has approved side letters of agreement to provide economic relief to these association members, however, inflationary pressures continue and affect recruitment and retention efforts. As a result, the City Council wishes to extend its offer of temporary relief to City employees who are members of the Newport Beach City Employees Association, Newport Beach Professional and Technical Association and Newport Beach Employees League. 6-1 Resolution No. 2024-70: Approving Side Letter Agreements with Labor Groups Representing City Employees September 24, 2024 Page 2 Side Letter Agreements have been executed which temporarily reduce the employee retirement contribution through the last full pay period in December 2025, thereby adding a one-year extension to the prior side letters of agreement for these groups which provided for the reduction through December 2024. If the City Council adopts Resolution No. 2024-70, City staff will work to implement the provisions as soon as practicable. FISCAL IMPACT: As a result of approving the side letters of agreement for the above -referenced labor groups, the attached budget amendment will add approximately $220,000 for the remainder of the fiscal year. Funding will come from the Fiscal Year 2023-24 General Fund year-end surplus. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
