Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Chris Miller, Administrative Manager - 949-644-3043, cmiller@newportbeachca.gov TITLE: 291h Street Public Pier- Notice of Completion for Contract No. 8821- 2 (19H02) ABSTRACT - On January 23, 2024, the City Council awarded Contract No. 8821-2 for the construction of the 29th Street Public Pier to Swift Slip Dock & Pier Builders, Inc. of Westminster. The total contract award was $244,890 plus a $24,500 contingency allowance. The required work is complete, and staff requests the City Council accept the work and close out the contract. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. Contract No. 8821-2 has now been completed to the satisfaction of the Public Works Department. There were four change orders totaling $17,758.90. This amounted to 7.3% of the original contract amount and was within the contingency allowance. The added work/cost included constructing access stairs to get over the seawall, removing the top portion of a concrete platform pile and modifications to the aluminum gangway landing plate and railing. A summary of the project schedule milestones is as follows: Actual Start of Construction Per Notice to Proceed March 19, 2024 Contract Completion Date with Approved Extensions September 6, 2024 Actual Substantial Construction Completion Date September 4, 2024 Due to contract change orders for unforeseen items as well as requests by City staff, the contractor was granted 21 additional days to complete the project. FISCAL IMPACT: Funds for the construction contract were expensed from the Tidelands Capital Fund (Tidelands Fund) in the following account. Account Description Tidelands Capital Fund Account Number 10101-980000-19H02 Total: Amount $ 262,648.90 $ 262,648.90 The Tidelands Capital Fund was created to allow for the sequestration of incremental increases from tidelands rent adjustments solely to finance critical in -harbor capital improvements, like sea walls repair, dredging, piers and important amenities. ENVIRONMENTAL REVIEW: On January 23, 2024, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) and Section 15302 (Replacement or Reconstruction) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
