Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Chris Miller, Public Works Administrative Manager - 949-644- 3043, cmiller@newportbeachca.gov TITLE: Citywide Public Dock Rehabilitation — Award of Contract No. 9557- 1 (24H02) ABSTRACT: The City of Newport Beach has received construction bids for the Citywide Public Dock Rehabilitation Project as part of the Fiscal Year 2023-24 Harbor and Beaches Master Plan (HBMP). Staff requests City Council approval to award the construction contract to Jilk Heavy Construction, Inc. of Brea. This project involves replacing the floating docks, piles and some gangways at 10 of the City's public docks. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) and Section 15302 (Replacement or Reconstruction) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3 because this project has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Approve Budget Amendment No. 25-017 appropriating $430,893 in increased expenditures in Account No. 10101-980000-24H02 from the Tidelands Capital Fund unappropriated fund balance; d) Award Contract No. 9557-1 to Jilk Heavy Construction, Inc. for the total bid price of $1,296,000 for the Citywide Public Dock Rehabilitation Project, and authorize the Mayor and City Clerk to execute the contract; and e) Establish a contingency of $129,600 (10% of total bid) to cover the cost of unforeseen work not included in the original contract. DISCUSSION: The HBMP identifies harbor -focused capital improvement projects that are projected in the next 50 years as either ongoing repair and maintenance or new projects. Staff prioritizes these projects with an emphasis on keeping the facilities in service and functioning for the boating public. The Harbor Commission annually reviews the HBMP and recommends the plan be forwarded to the City Council and Finance Committee for review and approval. 10-1 Citywide Public Dock Rehabilitation — Award of Contract No. 9557-1 (24H02) September 24, 2024 Page 2 This project addresses the floats at 10 of the City's oldest yet most popular public docks in the harbor. Five of the public docks are located on the Balboa Peninsula, and five are equally positioned around the perimeter of Balboa Island. These floats were last replaced between 2000 and 2003, and they have reached the end of their service life because of their heavy use. This project also includes replacing and relocating the float guide piles from the outside float face to an inboard position within the float's footprint. This small yet important detail will greatly improve access, provide increased usage, and prevent damage to dinghies. In addition, three gangways will be replaced with code -compliant gangways. Lastly, the floats at 19t" Street and Emerald Avenue will be enhanced with a minor configuration change which will improve efficiency, access and quantity of the dinghies at these docks. At 11 a.m. on August 26, 2024, the City Clerk opened and read the following bids for this project: BIDDER TOTAL BID AMOUNT Low Jilk Heavy Construction, Inc. $ 1,296,000 2nd Swift Slip Dock & Pier Builders, Inc. $ 1,379,825 3rd Bellingham Marine Industries, Inc. $ 1,449,634 4th Sol Construction, Inc. $ 1,825,860 5th Cushman Contracting Corporation $ 2,531,000 A pre -bid job walk was not required because all the public docks are publicly accessible and spread throughout the harbor. A substantial number of detailed pre -bid questions were submitted which indicated a higher level of marine contractor interest and possibly contributed to a competitive bidding environment. The bid amount submitted by Jilk Heavy Construction, Inc. is substantially less than the Engineer's Estimate of $1,603,000. Staff met with the owner of Jilk Heavy Construction, Inc. (low bidder) to ensure they understood what is expected to be completed, verified that their bid is complete and that they are able to perform all the work at the price being proposed. Reference checks conducted by staff indicate Jilk Heavy Construction, Inc. has satisfactorily completed similar marine projects. Jilk Heavy Construction, Inc. submitted all the necessary forms and possesses a Class A (including a Class B and HAZ) Contractor License as required by the project specifications. Pursuant to the contract specifications, the contractor will have 200 consecutive working days to complete the project. Due to the longer lead time for procuring the guide piles, on -site construction is anticipated to begin in early 2025, during the non -peak boating season. FISCAL IMPACT: When the project was identified for the HBMP, a placeholder dollar amount was allocated until the details could be more fully developed. Upon approval of the proposed Budget Amendment and with the adopted FY 2024-25 Capital Improvement Program budget, sufficient funding is available for this contract. 10-2 Citywide Public Dock Rehabilitation — Award of Contract No. 9557-1 (24H02) September 24, 2024 Page 3 Tidelands revenue is generated from the operation of the City's tidelands including rents from moorings, piers, and leases, as well as income from parking lots. Currently, the operating expenditures of the Tidelands exceeds the revenues and is subsidized by the General Fund. The Tidelands Capital Fund was created to allow for the sequestration of incremental increases from tidelands rent adjustments solely to finance critical in -harbor capital improvements, like sea walls repair, dredging, piers and important amenities. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 1 Section 15301 (maintenance or minor alteration of existing public structures involving negligible or no expansion of existing use) and Class 2 Section 15302 (replacement or reconstruction of existing structures and facilities on the same site with substantially the same purpose and capacity as the structure replaced) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
