TITLE: Police Department Parking Lot Maintenance Project — Reject All Bids
for Contract No. 7901-1 (25F02)
ABSTRACT:
The City of Newport Beach recently received two bids for the Police Department Parking
Lot Maintenance project. Staff recommends that the City Council find both bids
non -responsive and reject all bids, and direct staff to re -advertise the project to provide
an opportunity to receive more responsive and competitive bids.
RECOMMENDATIONS:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA guidelines, because
this action will not result in a physical change to the environment, directly or indirectly;
b) Reject all bids received for Contract No. 7901-1; and
c) Direct staff to re -advertise the Police Department Parking Lot Maintenance project.
DISCUSSION:
As part of the Fiscal Year 2024-25 Facilities Maintenance Master Plan (FMMP) Program,
maintenance and site modifications are needed at the Police Department facility, located
at 870 Santa Barbara Drive. Particularly, the Police Department lacks adequate parking
for employees and the public. The project includes slurry sealing the back parking lot,
adding additional public parking to the front lot and making upgrades to provide required
Americans with Disabilities Act (ADA) access from the public sidewalk.
On September 17, 2024, at 2 p.m., the City Clerk opened and read the following bids for
this project:

The low bid received from Elegant Construction, Inc. was approximately 46% over the
engineer's estimate of $400,000. Oppenheimer National's bid came in at approximately
70% over the engineer's estimate.
Neither Elegant Construction, Inc. nor Oppenheimer National provided technical ability
and experience references which involved paving for a project which is primarily paving,
as required by the contract documents. Additionally, technical ability and experience
references provided by both groups were almost entirely for projects of less than half the
dollar value of the bids presented. Staff believes that both companies are insufficiently
qualified to perform paving work on projects of this size.
Rejecting all bids and re -advertising will provide a better opportunity to receive more
complete and responsive bids. In addition, staff will contact contractors who have
provided similar type work in the past, allowing for a more competitive bidding
environment.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
