My daughter was killed in your city by a drunk driver. My family and I strongly feel that many factors could have prevented Rosenda's death. One of those would have been if Balboa Peninsula had safer streets. Every single resident I have spoken to there has either been hit (by a vehicle) in a crosswalk, knows someone who has been hit in a crosswalk, or has seen someone get hit in a crosswalk. I am sure that you would agree that this is highly alarming. The council can look forward to my regular visits to your meetings. I will consistently and persistently have important information to provide for you in my 3 minutes of allocated time. I also hope that one of you will step forward and offer to collaborate with me in developing and executing plans to modernize your street safety devices. I am working with my local assemblyman who is in the process of writing "Rosenda's Law" to reform drunk driving laws at the state level. I hold four academic degrees and substance abuse is one of my areas of expertise. That being said, state grant funding is available right now, and I will be speaking about this tomorrow evening. Below is some initial information I would like you to have regarding crosswalks that blink. Tomorrow, I will bring information on the available grants and the cost of elevated crosswalks to you. The city is installing a permanent illuminated sign that can provide traffic messages at the corner of 29th Street / Newport Blvd. I'm writing this email because locating this sign is a safety concern and that the city planners failed to provide us residents with the requisite notice of its installation. During busy summer months cars going south on Newport Blvd. often make quick and erratic right hand turns onto 29th Street looking for parking in the city lot or down 29th street in hopes of avoiding backed up traffic. I also see drivers going south in the left lane of Newport Blvd. make similarly quick and erratic turns into the Burr White or Sessions Sandwiches parking lots to avoid traffic. For years, I have seen countless incidents where these distracted drivers have nearly run over beach goers making these erratic turns to avoid traffic or find a parking spot. This sign is designed to provide drivers with messages about traffic and parking conditions (as an example, it will provide messages when parking lots down the street are full). Installing this sign at 29th Street / Newport Blvd. will certainly increase the number of incidents of drivers making erratic left and right hand turns at this corner as they read traffic messages and seek to either avoid traffic or make snap decisions on parking. This corner is simply unsafe as it is, and this sign only increases the well known dangers. As a member of the Orange County Trial Lawyers Association, I can tell you, these are the types of negligent acts by cities that routinely end up in plaintiff's suits. And after an avoidable accident occurs, and the victim files suit, cities try to disparage the plaintiff's bar when the danger was easily avoidable. Last Thursday, I went to city hall and spoke with Eric Loke and Brad Sommers and I raised the following concerns. (1) No Notice - I advised Erik and Brad that none of the surrounding residents received notice that the city was going to locate this sign at the corner of 29th Street / Newport Blvd. Had we residents received notice, many of us would have relayed the numerous concerns we have with installing a sign here — including the safety concerns. Both Eric and Brad confirmed that the city planners did not send notice to the residents. This is a clear violation of the Brown Act. (2) Safety Concerns - as described above, these safety concerns are well known to the residents and we would have relayed them to the planners and council if only we had notice and an opportunity to be heard. (3) Ineffective Location - why isn't this sign located somewhere safer and more effective? Why isn't this sign located somewhere further up on Newport Blvd. so that drivers can safely reroute and adjust their parking plans before coming onto the Peninsula? Why isn't this sign located somewhere more safe, like an area where drivers cannot take immediate and erratic turns in response to the sign's messaging? I asked both Eric and Brad if they visited the site's location before they decided to locate it at this dangerous corner. Both Eric and Brad were evasive when pressed on this issue and neither confirmed if they actually did visit the site. Had they visited the site, it would have been immediately clear that this location is a bad idea. The issues on the Peninsula are well known (e.g., massive amount of summer time pedestrians, children, traffic, congestion, etc.). It seems patently negligent to install signage like this that which is meant to reroute the flow of traffic without actually seeing how it would impact such flow of that traffic. (4) Cost — during the busy season, the city already uses a mobile traffic messaging sign located across the street from the Lido Shopping center. What does this new permanent traffic sign offer that the mobile sign is failing to provide? So why did the city feel it necessary to incur this additional cost? Couldn't these funds have been better spent elsewhere and on different projects? (5) Property Views — several of us neighbors in the direct vicinity of the sign now have a permanent lit traffic sign to look at. This obviously has a negative impact on our quality of life and right to enjoy our properties. Why weren't we given notice and an opportunity to be heard on its placement, size, etc.? Clearly there was a breakdown in process that skipped over resident participation in this decision. I am asking the city council to intervene by either: * Reversing the decision to install the permanent lit sign at this corner and avoid the expense of this sign altogether or relocate the sign to somewhere more effective and safe; or * Pausing the completion of the installation to give the residents an opportunity to comment. I woke up today to find out the city is installing a permanent electric sign in front of my house. I don't recall receiving any notice of this installation project. My chief concern is that this sign is going to increase traffic accidents in an area that has a high concentration of families (we live right next to the parking lot where families park for beach access). Further, the city has a mobile electric sign it uses during the busy season that works perfectly fine. Why does the city need to pay this high cost to install a permanent sign. You have three blocks (30th, 29th and 28th) who are irate about this project. Can you please give me a call to explain why the city is doing this? Please requested you read the sub-reddits on criminal activity at this property there is this woman pretending to be IHSS care giver and getting paid by IHSS but is mentally unhinged and causing problems for neighbors walking around with rocks about to throw them at neighbors scaring little kids grabbing kids in the pool and harassing neighbors. Investigation by IHSS is taking a very long time, no resolution yet despite multiple residents complaining to IHSS and saying this woman spends all day at pool not caregiving just harassing everyone and stealing from pool area and laundry So the IHSS thing was a front so she could be on her boyfriend's lease because he has a Section 8 housing voucher, and can't have a cohabitant so they signed her up with IHSS pretending to be caregiving for hom when she is not. She is very dangerous. He is not disabled enough to need a live in care giver, so it's HUD fraud and Medicaid fraud.
