Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Bob Stein, Assistant City Engineer- 949-644-3322, rstein@newportbeachca.gov TITLE: Resolution No. 2024-79: Collins Island Bridge Replacement — Adoption of Mitigated Negative Declaration and Intent to Prepare Final Construction Documents (22R13) ABSTRACT: The Mitigated Negative Declaration (MND), and associated Mitigation Monitoring and Reporting Program (MMRP), for the Collins Island Bridge Replacement are ready for adoption in accordance with the California Environmental Quality Act (CEQA). Additionally, the design consultant, Michael Baker International (MBI), has prepared a design concept for the bridge replacement and construction of new seawalls adjacent to the proposed bridge. Staff recommends that the City Council authorize MBI to prepare the final construction documents. RECOMMENDATIONS: a) Adopt Resolution No. 2024-79, A Resolution of the City Council of the City of Newport Beach, California, Adopting Mitigated Negative Declaration No. ND2018-002 (SCH#2024070802) for the Collins Island Bridge Replacement (PA2018-153), pursuant to the California Environmental Quality Act, State CEQA Guidelines and City Council Policy K-3; and b) Authorize Michael Baker International to prepare the final construction documents for the Collins Island Bridge Replacement including adjacent new seawalls. DISCUSSION: The Initial MND for the Collins Island Bridge Replacement was prepared and circulated for public review in summer 2024 and the final MND is now ready for the City Council's review and approval. MBI also prepared a detailed concept -level design for the bridge replacement and adjacent seawalls which is ready for the Council's review. Staff recommends that the City Council authorize MBI to prepare the final construction documents. 20-1 Collins Island Bridge Replacement — Adoption of Mitigated Negative Declaration and Intent to Prepare Final Construction Documents (22R13) October 22, 2024 Page 2 Mitigated Negative Declaration Review and Adoption The MND was prepared in accordance with CEQA requirements, State CEQA Guidelines, and City Council Policy K-3. Based upon the analysis of the MND, there were no environmental categories with potentially significant impacts. Specific mitigation measures are included in the MND to reduce potential minor impacts to Biological Resources, Cultural Resources, Geology/Soils, Hazards and Hazardous Materials, Noise, Public Services, Transportation. The Public Review Draft of the MND was available for public review for a 30-day comment period from July 23, 2024, to August 21, 2024. Two comment letters were received for consideration. Although not required pursuant to CEQA, written responses were prepared for each of the comment letters and are included in the Final Initial Study/MND. A MMRP has been prepared and is included as Chapter 4 in the Final Initial Study/MND. (See Exhibit A of the attached draft resolution (Attachment A)). No new significant information was presented to warrant recirculation of the MND. The final MND can be referenced at https://www.newportbeachca.gov/cega. Staff recommends adoption of Resolution No. 2024-_ (Attachment A) adopting the MND and associated MMRP. Bridge and Seawall Design Concept and Preparation of Final Construction Documents The City Council approved the Professional Services Agreement (PSA) with MBI on July 26, 2022, to design the replacement for the Collins Island Bridge and design new seawalls on the perimeter of Balboa Island that would extend approximately 100 feet on each side of the new bridge. See Attachment B for project limits. As a first step, MBI was directed to prepare a design concept for the bridge replacement and adjacent seawalls to be presented to the City Council for review. The proposed Collins Island Bridge Replacement Project has two major components: 1) bridge replacement and 2) construction of new seawalls adjacent to the bridge. 1. Bridge Replacement The Collins Island Bridge, built in 1953, is still serviceable but is approaching the end of its useful life. The proposed replacement bridge (Attachment C) will increase the bridge width from 19 feet to 20.5 feet to accommodate a 13.75-foot travel lane, 4-foot-wide sidewalk, and concrete barriers on each side of the roadway to provide protection from projected sea level rise. The bridge will be 31 feet in length, spanning between the existing concrete sheet pile bulkheads. Park Avenue, from Bay Front Alley, will be improved and transitioned appropriately to the new bridge. The roadway transition onto Collins Island will also be improved. Existing sewer, water and dry utility lines will be replaced within the new bridge. 20-2 Collins Island Bridge Replacement — Adoption of Mitigated Negative Declaration and Intent to Prepare Final Construction Documents (22R13) October 22, 2024 Page 3 To facilitate the construction of a future storm water pump station in Park Avenue near the Collins Island Bridge, storm water collection and distribution pipelines may be installed in Park Avenue and the Bay Front sidewalk as part of the bridge replacement project (Attachment D). Note that the pump station project is being designed concurrently under a separate City contract, however, the pump station project is not a part of the bridge replacement project and would be approved separately. 2. Seawall Improvements Seawalls are designed to protect properties from water levels associated with high tides and storm surges. Future water surface elevations are projected to rise. Therefore, the project proposes to construct a new seawall on the bay side of the existing seawalls adjacent to the bridge. Currently, most seawalls along the Bay Front sidewalk near the Collins Island Bridge consist of concrete sheet pile bulkheads with a concrete cap (coping) with a top elevation of approximately 9 feet (based on the land -based vertical datum NAVD88). Some of the existing concrete sheet piles are structurally deficient where existing tie back anchors have corroded and no longer provide adequate support at the upper part of the walls. The proposed seawall improvements would be installed on the bay side of the existing seawalls (Attachment E) with a top of wall coping elevation between 9 and potentially 11 feet NAVD88. The new seawalls would be able to accommodate a future cap extension elevation up to 14 feet NAVD88. The construction of these new seawalls on each side of the new Collins Island Bridge will be the start of a longer -term program to eventually construct a new and potentially higher replacement seawall around the entire perimeter of Balboa Island. FISCAL IMPACT: On July 26, 2022, the City Council approved the PSA for MBI for planning and entitlement services and the preparation of the final construction documents. The consultant's fee for this service is $1,081,297. The adopted budget includes sufficient funding for design of the Collins Island Bridge Replacement project. It will be expensed to the CIP Expense account in the Public Works Department, 01201927-980000-22R13. ENVIRONMENTAL REVIEW: A MND was prepared by MBI, in accordance with CEQA requirements, State CEQA Guidelines, and City Council Policy K-3. A copy of the MND was made available on the City's website, at each Newport Beach Public Library location, and at the Community Development Department at City Hall. 15 hardcopies and one electronic copy were mailed to the State Clearinghouse (SCH#2024070802); one hard copy and one electronic copy were hand delivered to the Orange County Clerk; and one hard copy and one electronic copy were mailed to 28 agency contacts and local interested parties. A Notice of Intent to Adopt a Mitigated Negative Declaration was mailed to property owners and to residents within a 300-foot radius of the proposed project. 20-3 Collins Island Bridge Replacement — Adoption of Mitigated Negative Declaration and Intent to Prepare Final Construction Documents (22R13) October 22, 2024 Page 4 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: Attachment A — Resolution No. 2024-79 Attachment B — Project Limits Attachment C — Conceptual Bridge Design Attachment D — Overall Project Improvements Attachment E — Proposed Bridge and Seawall Improvements 20-4 ATTACHMENT A RESOLUTION NO. 2024- 79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTING A MITIGATED NEGATIVE DECLARATION (SCH#2024070802) FOR THE COLLINS ISLAND BRIDGE REPLACEMENT PROJECT (PA2018-153) WHEREAS, Section 200 of the City of Newport Beach ("City") Charter vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges or procedures granted or prescribed by any law of the State of California; WHEREAS, the Collins Island Bridge is located on the western portion of Balboa Island at the intersection of Park Avenue and the Bay Front sidewalk and connects the Collins Island community with greater Balboa Island ("Property"); WHEREAS, the Collins Island Bridge was constructed in 1953 and is approaching the end of its useful life; WHEREAS, with the planned construction of the adjacent stormwater pump station, the City proposes to replace the Collins Island Bridge so that it conforms with updated California Building Code standards and at an increased elevation of two to three feet above the existing bridge deck to address anticipated sea level rise ("Project"); WHEREAS, the City prepared a mitigated negative declaration ("MND") in accordance with the California Public Resources Code Section 21000, et seq., the State CEQA Guidelines as set forth in Title 14, Division 6, Chapter 3 of the California Code of Regulations ("CEQA Guidelines"), and City Council Policy K-3 (Implementation Procedures for the California Environmental Quality Act), to address environmental impacts associated with the Project; and WHEREAS, a public meeting was held by the City Council on October 22, 2024, in the Council Chambers located at City Hall, 100 Civic Center Drive, Newport Beach, California. A notice of time, place and purpose of the meeting was given in accordance with Government Code Section 54950 et seq. ("Ralph Brown Act") and Public Resources Code Section 21092. Evidence, both written and oral, was presented to, and considered by, the City Council at this hearing. 20-5 Resolution No. 2024- Page 2 of 4 NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council hereby adopts the MND (SCH#22024070802) including the Initial Study, Response to Comments, Errata and Mitigation Monitoring and Reporting Program ("Final MND") which is attached hereto as Exhibit "A," and incorporated herein by reference. The City Council's approval of the Final MND is made after thorough consideration of the Project's MND, public testimony and written submissions of all interested persons desiring to be heard, and the following facts and findings: 1. The Final MND was prepared for the Project pursuant CEQA, the CEQA Guidelines, and City Council Policy K-3 (Implementation Procedures for the California Environmental Quality Act). 2. The City caused to be prepared an Initial Study, a preliminary analysis to determine the relative environmental impacts associated with the Project. The Initial Study identified potentially significant effects; however, modest project revisions would avoid or reduce those effects. Therefore, an MND was prepared in compliance with CEQA, State CEQA Guidelines and City Council Policy K-3. 3. Notice of availability of the draft MND was provided and the draft MND was made available for public review for a thirty day comment period beginning on July 23, 2024, and ending August 21, 2024. Notice of Availability of the draft MND was given in accordance with CEQA, State CEQA Guidelines and City Council Policy K-3. Two comment letters were received during the thirty day public review period. 4. Although not required pursuant to CEQA, the City provided written responses to the two comment letters. The comments and responses to comments were considered by the City Council while considering the approval of the Project. The comments and responses to comments do not represent significant new information to warrant recirculation of the draft MND. 5. The documents and all related materials, which constitute the record upon which this decision was based, including the Final MND attached as Exhibit "A," are on file with the Public Works Department, City Hall, 100 Civic Center Drive, Newport Beach, California. 20-6 Resolution No. 2024- Page 3 of 4 6. On the basis of the entire environmental review record of the Project, the mitigation measures will have a less than significant impact on the environment and there are no known substantial adverse effects on human beings that would be caused. Additionally, there are no long-term environmental goals that are compromised by the Project. The mitigation measures identified by the MND and incorporated in the Mitigation Monitoring and Reporting Program are feasible and will reduce potential environmental impacts to a less than significant level. Section 2: The City Council directs the Public Works Director to incorporate the mitigation measures contained in the Mitigation Monitoring and Reporting Program included in the Final MND in the plans and specifications for the Project. Section 3: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. 20-7 Resolution No. 2024- Page 4 of 4 Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
