TITLE: Fire Station No. 8 HVAC Rehabilitation — Reject All Bids for Contract
No. 9373-1 (24F02)
ABSTRACT:
The City of Newport Beach recently solicited three proposers for informal bids for the
Fire Station No. 8 Heating Ventilation and Air Conditioning (HVAC) Rehabilitation project
and received one bid. The single bid received is significantly higher than the engineer's
estimate. Staff recommends the City Council reject all bids and re -advertise to provide an
opportunity to receive more competitive bids.
RECOMMENDATIONS:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA guidelines, because
this action will not result in a physical change to the environment, directly or indirectly;
b) Reject all bids received for Contract No. 9373-1; and
c) Direct staff to re -advertise the Fire Station No. 8 HVAC Rehabilitation project.
DISCUSSION:
As part of the Facilities Maintenance Master Plan (FMMP) program, staff identified
Fire Station No. 8, located at 6502 Ridge Park Road, as needing replacement of the
existing HVAC equipment. Two condensing units and two forced air furnaces that are
original to the building are near the end of their service life after over 30 years of service.
Staff developed contract documents accordingly and advertised the project for informal
bids to three contractors that have successfully completed similar projects for the City.
On September 19, 2024, the City Clerk opened and read the following bids for this project:

The bid of $135,382.00 submitted by F.M. Thomas Air Conditioning is approximately
349% higher than the engineer's estimate of $38,800. The engineer's estimate was
provided by an on -call mechanical engineer and was based on recent bids from similar
sized projects.
Staff recommends putting the project out to bid on the public bidding platform and allowing
all available contractors to bid on the project. It is anticipated that the wider audience of
bidders will result in more competitive bids.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Environmental review will occur as appropriate and will be presented to the City Council
at that time. Staff recommends the City Council find this action is not subject to the
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change to the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has
no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
