Attn: Darin Tietgen 27 Orchard Lake Forest, CA 92630 Application No.  Conditional Use Permit No. UP2017-015 (PA2017-120) Address 2743 East Coast Highway Please be advised that after reviewing the subject application, your submittal has been deemed incomplete and further information is required before we are able to proceed with the application process. The following documentation is required to complete the application: 1. Submit a project description and justification for required findings. The project description should include a detailed description of business operations and existing conditions onsite. The description should address all work proposed to take place, including any additions, remodels, and/or change in operating characteristics. Required findings for a conditional use permit are as follows (See Newport Beach Municipal Code Section 20.52.020): a. The use is consistent with the General Plan and any applicable specific plan; b. The use is allowed within the applicable zoning district and complies with all other applicable provisions of this Zoning Code and Municipal Code; c. The design, location, size, and operating characteristics of the use are compatible with the allowed uses in the vicinity; d. The site is physically suitable in terms of design, location, shape, size, operating characteristics, and the provision of public and emergency vehicle (e.g., fire and medical) access and public services and utilities; and e. Operation of the use at the location proposed would not be detrimental to the harmonious and orderly growth of the City, nor endanger, jeopardize, or otherwise constitute a hazard to the public convenience, health, interest, Document1 Page 2 safety, or general welfare of persons residing or working in the neighborhood of the proposed use. 2. Outdoor Dining Permit No. OD0007, approved in March 1996, permits up to 184 square feet of outdoor dining. Submitted plans of existing outdoor dining area show more than 184 square feet (approximately over 350 square feet). Verify measurements of existing outdoor area. Ensure all plans, exhibits, project description, and parking study are consistent and correct. 3. Provide an exhibit(s) which shows the existing and proposed gross floor area and net public area. All changes should be clearly identified. 4. Specialty Food Permit No. SF0045, approved in March 1996, permits a maximum of 20 indoor seats. Note that the application seeks to remove this condition. 5. The parking requirement for eating and drinking establishments is 1 per 30-50 square feet of net public area, including outdoor areas exceeding 25% of the interior net public area or 1,000 square feet, whichever is less. In this case, the rate is 1 space per 40 square feet. Outdoor area equal to 25% of net public interior area may be excluded from the parking requirement calculation. 6. Update the submitted parking study to consistent information based on comments above. 7. Submit hard copies and electronic copies of all revised items. Please note that the project plans have been routed to the Building, and Fire for the review and comment on the proposed design. Their review is pending and may result in additional comments. Additionally, the project, including parking study, will be routed to the Public Works Department when the above items have been addressed. Their review may result in additional comments. Upon verification of completion, the application will be processed and scheduled for a Zoning Administrator Hearing.
