Request to penni! the establishment of a specialty food fucility (bage1ry) on property located in the
District.
The Planning Department on March 5, 1996, approved the application subject to the following
conditions:
1. That development shall be in substantial conformance with the approved site plan and floor plan,
except as noted in the following conditions.
2. That maximum seating and/or stand-up counter space for no more than 20 customers shall be
maintained inside the subject specialty food use. Any further increase in the number of seating
and/or stand-up counter space for customers shall be subject to the approval of a use permit.
3. That trash receptacles for patrons shall be conveniently located both inside and outside of the
proposed facility.
4. That at least one parking space for each 250 sq.ft. of gross floor area shall be provided for the
proposed fucility.
5. That the hours of operation shall be limited between the hours of 6:00 arn. and 9:00 p.rn.
6. That no outside paging system shall be utilized in conjunction with this outdoor dining
establishment
7. That should this business be sold or otherwise come under different ownership, any future owners
or assignees shall be notified of the conditions of this approval by either the current owner or the
leasing company.

8. That no on-sale alcoholic beverages shall be permitted on the premises.
9. That no live entertainment or dancing shall be permitted in conjunction with the permitted use.
10. That no temporary "sandwich" signs or similar temporary signs shall be pennitted, either on-site or
off-site, to advertise the specialty food establishment.
I L That kitchen exhaust fans shall be designed to control smoke and odor to the satisfaction of the
Building Department.
12. That where grease may be introduced into the drainage systems, grease interceptors shall be
installed on an fixtures as required by the Unifo.-m Plumbing Code, unless otherv.-ise approved by
the Building Department and the Utilities Department.
13. That the PIanning Department may add to or roodiiY conditions of approval to this specialty food
service penni\, or recommend to the Planning Commission or City Council the revocation of this
permit upon a determination that the operation which is the subject of this approval causes injury,
or is detrimental to the health, safety, peace, morals, comfort, or general welfare of the community.
The Planning Department determined in this case that the proposal would not be detrimental to
persons, property or improvements in the neighborhood and that the specialty food services permit as
approved would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal
Code, and made the following findings:
1. That the proposed specialty food service service is retail in nature, serving main.~. persons residing
or working in the neighborhood, maintains a gross floor area of 2,000 sq .ft. or less, and is not
necessarily a destination point. It is anticipated that the proposed use will have parking demand
characteristics similar to a retail use.
2. That the proposed development is consistent v.i:zh the Land Use Element of the General Plan and
the Local Coastal Program, and is compatible v. i:zh the surrounding land uses.
3. That the required number of off-street parking spaces exist in the common lot for the proposed
specialty food establishment as required by Chapter 20.72 of the Municipal Code.
4. That the approval of Specialty Food SeIVice Pernrit No. 45 will not, under the circumstances of
this case, be detrimental to the health, safety, peace, morals, comfort, and general welfare of the
city.
NOTE: This approval shall expire unless exercised within 24 months from the end of the appeal
period, and cannot be extended.

The decision of the Planning Department may be appealed by the applicant to the Planning
Commission within 14 days of the date of the decision. Any appeal filed shall be accompanied by a
filing fee of$399.00.

Notice is hereby given that Pacific Bagel Partners, L.P. have requested a Modification of the Zoning Ordinance
to allow the establishment of a specialty food facility (bagerly) on property located in the RSC District.
Property located at 2747 East Coast Highway
Specialty Food Permit No. 45 was approved by the City of Newport Beach on Wednesday, March 6, 1996.
Appeal period is 10 days from the date of the specialty food approval.

RE: Denial of a Request for Planning Director Approval of a Temporary Use Permit
Brueggers Bagels, 2743 East Coast Highway, Corona del Mar, CA
Deal' Mr. Gantes:
You have not provided the necessary information to complete the application for a temporary USc
permit for the facility to exceed the permitted number of seats inside the facility or to exceed the
allo\\able outdoor dining area. Therefore, your application for the project located at 2743 East
Coast Highway remains incomplete. Since your temporary use has been operating without
autholization for a duration that exceeds the allowable 90 days, your request for a temporary use
permit has been denied. You are advised to retum the facility to comply with the current approvals
(Specialty Food Permit No. 45 or Accessory Outdoor Dining Permit No.7) by removal of the non-
compliant seats and outdoor dining area within 14 days of the date of this letter.

Dear Mr. Garcia,
In regards to your letter received on December 19, I will address each item.
1. Proposed interior seating plan with tables and chairs -see attached
2. A summary table of the number of interior and exterior tables (with
dimensions) and chairs -We did not have sufficient time to prepare this
report for today's meeting but plan to send it to you by December 23.
3. The specific time period requested -We're requesting 6 months, the amount
of time we feel is necessary, to work with the planning department in working
toward a solution of our business needs (November 28 -May 31,2001).
4. Outdoor dining area calculation to show area in excess of the approved
area -see attached
5. A letter of operation that justification for consideration of the request -
There are several factors that have impacted our business significantly over
the past 18 months, some of which will intensify in the next 12 months that
are of concern, (IE., a significant increase of wages effective January 1, 2001;
a significant increase in all levels of insurance including workers
compensation, medical insurance, property and liability insurance, and
employee practices liability insurance and a significant increase in electricity
and natural gas.)
We have noted declining traffic starting in 1999 and continuing into
2000.
We noted a loss in weekend traffic that appeared to correlate with the
loss of 8 exterior patio tables approximately 12 to 14 months ago.
We have seen and continue to see substantial abuse of our parking lot
by non-Seattle's Best and Bruegger's customers. We are the only
business in the immediate area that has convenient street level parking
lot. (Note: in our recent tracking on 2 different days we noted
approximately 20 -25 % of our parking lot was being used by
Starbucks customers.)
Since we opened in September.of 1996 we have noted an ongoing<
issue of Starbucks customers using our restrooms; we are pleased that
they are planning to add restrooms as a result of the recent "hearing".
The concern presently is that if we remove 18 chairs from the dining room we will
"Devastate" our weekend business. Our weekend business consists primarily of local
residents living within 2 miles of the restaurant.
Our short-term goal is to maintain our present capacity of 38 interior seats and add 100
additional square feet to our exterior patio.
Our long-term goal is to re-evaluate our dining room design (we will discuss), however
still maintaining 38 seats. We are also seeking to expand our exterior patio area to
approximately 540 square feet.
In conclusion, for our business to succeed we need your support. With our operating
costs "SKYROCKETING" we must maintain our current "traffic".

Request to permit the establislunent of a specialty food fucility (bagelry) on property located in the
District.
The Planning Department on March 5, 1996, approved the application subject to the following
conditions:
1. That development shall be in substantial conformance with the approved site plan and floor plan,
except as noted in the following conditions.
2. That maximum seating and/or stand-up counter space for no more than 20 customers shall be
maintained inside the subject specialty food use. Any fi.lrther increase in the number of seating
and/or stand-up counter space for customers shall be subject to the approval of a use permit.
3. That trash receptacles for patrons shall be conveniently located both inside and outside of the
proposed facility.
4. That at least one parlcing space for each 250 sq.ft. of gross floor area shall be provided for the
proposed facility.
5. That the hours of operation shall be limited between the hours of 6:00 am. and 9:00 p.m
6. That no outside paging system shall be utilized in conjunction with this outdoor dining
establishment.
7. That should this business be sold or otherwise come under different ownership, any future owners
or assignees shall be notified of the conditions of this approval by either the current owner or the
leasing company.

8. That no on-sale alcoholic beverages shall be pernitted on the premises.
9. That no live entertainment or dancing shall be pennitted in conjunction with the pennitted use.
10. That no temporary "sandwich" signs or similar temporary signs shall be pennitted, either on-site or
off-site, to advertise the specialty food establisbr.nent.
11. That kitchen exhaust fans shall be designed to control smoke and odor to the satisfaction of the
Building Department.
12. That where grease may be introduced into the drainage systems, grease interceptors shall be
installed on all fixtures as required by the Uniform Plumbing Code, unless otherv.ise approved by
the Building Department and the Utilities Department.
13. That the Planning Department may add to or IDOdifY conditions of approval to this specialty food
service permit, or recommend to the Planning Commission or City Council the revocation of this
pennit upon a determination that the operation ... weh is the subject of this approval causes injury,
or is detrimental to the health, safety, peace, morals, comfort, or general welfare of the community.
The Planning Department detemllned in this case that the proposal would not be detrimental to
persons, property or improvements in the neighborhood and that the specialty food services permit as
approved would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal
Code, and made the following findings:
1. That the proposed specialty food service service is.retail in nature, serving mainly persons residing
. or working in the neighborhood, maintains a gross floor area of 2,000 sq.ft. or less, and is not
necessarily a destination point. It is anticipated that the proposed use will have parlcing demand
characteristics similar to a retail use.
2. That the proposed development is consistent wITh the Land Use Element of the General Plan and
the Loca1 Coastal Program, and is compatible wiIh the surrounding land uses.
3. That the required number of off-street parking spaces exist in the common lot for the proposed
specialty food establishment as required by Chapter" 20.72 of the Municipal Code.
4. That the approval of Specialty Food Service Permit No. 45 will not, under the circumstances of
this case, be detrimental to the health, safety, peace, morals, comfort, and general welfare of the
city.
NOTE: This approval shall expire unless exercised within 24 months from the end of the appeal
period, and cannot be extended.

The decision of the Planning Department may be appealed by the applicant to the Planning
Commission within 14 days of the date of the decision Any appeal filed shall be accompanied by a
filing fee of$399.00.

Dear Mr. Hill:
This report summarizes our findings regarding the trip generation at two existing coffee/
pub facilities located in the City of Newport Beach. The City of Newport Beach was
contacted to discuss the parameters of this study. Coffee houses were selected by the City
of Newport Beach as facilities that were felt to be representative of the proposed
development. The twO facilities selected were Starbucks, which is approximately 1,400
square feet, located at 17th Street and Irvine Boulevard and The Coffee Pub located in
Lido Village, approximately 1,100 square feet .

.E;<i~~ip.g c9.1;!n~were cQnducted at these fadlities on Wednesday, August 11, 1993 and on
Friday, August 13, 1993, between the hours of 7:00 At\{ -9:00 At\f and 4:00 PM -6:00
PM. These counts were conducted by fifteen minute intervals, the inbound and
outbound movements were also recorded separate! y, and the mode of transportation was
classified by car, bicycle or walk. Passby trips were also noted. These passby trips entail
people who are stopping at the establishment on their way somewhere else (i.e. on their
way to work).
