Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov PREPARED BY: Jennifer Farris, Assistant City Clerk - 949-644-3006, jfarris@newportbeachca.gov TITLE: Appointment of a Civil Service Board Member to Fill an Unscheduled Vacancy ABSTRACT: An unscheduled vacancy on the Civil Service Board occurred due to the dismissal of Civil Service Board Member Laura Cowie at the September 10, 2024 City Council meeting. Pursuant to City Charter 710, the nominations to the vacant seat were provided by the majority of the Civil Service Board. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Appoint 1) Micheal Denner or 2) Matthew Parisi (as ranked) to fill the vacancy on the Civil Service Board for a term that expires on June 30, 2027. DISCUSSION: The Civil Service Board consists of five members. Two members are appointed by the City Council from a list provided by the employees in the Classified Service, two members are appointed by the City Council directly, and the fifth member is appointed by the City Council from a list provided by the Civil Service Board members. Laura Cowie served as the Civil Service Board's appointee until she was dismissed at the September 10, 2024 City Council meeting due to having more than three consecutive absences. In compliance with City Council Policy A-2 (Boards, Commissions and Committees) and the Maddy Act, the City Clerk prepared and posted a Notice of Unscheduled Vacancy on September 12, 2024, in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council Chambers, and on the City's website. In addition, the notice was published in the Daily Pilot on Saturday, September 14, 2024. As per the notice, applications were accepted by the City Clerk's Office until noon on September 26, 2024. Following the close of the application period, three applications were received. 22-1 Appointment of a Civil Service Board Member to Fill an Unscheduled Vacancy November 19, 2024 Page 2 The applications were forwarded to the remaining Civil Service Board members who reviewed them and nominated two applicants to move forward, ranked, as follows: 1. Micheal Denner 2. Matthew Parisi Copies of the applications are attached hereto as Attachment A. Appointment Process Pursuant to City Council Policy A-2, the appointment to the Civil Service Board will take place in the following manner: A. The City Council will vote on the appointment simultaneously. The voting will be done by paper ballot and the City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast one vote on the paper ballot. To be appointed, an applicant must receive at least four votes. FISCAL IMPACT: There is no fiscal impact related to this item. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
