Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Kevin Riley, Principal Civil Engineer - 949-644-3329, kriley@newportbeachca.gov TITLE: Resolution No. 2024-87: Supporting an Application by the City of Santa Ana to the Orange County Transportation Authority for Funding Under Measure M2 Regional Traffic Signal Synchronization Program for the Bristol Street Project from SR-22 to Jamboree Road ABSTRACT: The City of Santa Ana requests the City of Newport Beach support its application for the Orange County Transportation Authority (OCTA) Measure M2 Regional Traffic Signal Synchronization Program (RTSSP) for the Bristol Street Project from SR-22 to Jamboree Road. The proposed project will upgrade traffic signal equipment and communication equipment along the 45 signalized intersections on the Bristol Street corridor, of which eight intersections are within Newport Beach. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2024-87, A Resolution of the City Council of the City of Newport Beach, California, Supporting an Application by the City of Santa Ana to the Orange County Transportation Authority for Funding Under Measure M2 Regional Traffic Signal Synchronization Program, for the Bristol Street Project from SR-22 to Jamboree Road. DISCUSSION: As part of the Measure M2 Comprehensive Transportation Funding Program (CTFP), the RTSSP was created to upgrade traffic signal equipment, enhance traffic signal coordination, and reduce travel time delay by funding synchronization projects for multi -jurisdictional traffic signal corridors. Project eligibility requires a City Council resolution supporting the application and implementation of the project. 3-1 Supporting an Application by the City of Santa Ana to the Orange County Transportation Authority for Funding Under Measure M2 Regional Traffic Signal Synchronization Program for the Bristol Street Project from SR-22 to Jamboree Road November 19, 2024 Page 2 OCTA is currently administering the 2024 Call for Projects for the RTSSP. Project applications received by OCTA will be evaluated and scored as part of the competitive program. If successful, the City will be required to provide the necessary local matching funds of at least 20% of Newport Beach's portion of the total project cost. The proposed project will upgrade traffic signal equipment and communication equipment along the Bristol Street corridor; this application does not include a traffic signal synchronization scope since there is an existing effort led by OTCA to coordinate traffic signals countywide. This project includes 45 signalized intersections, of which eight intersections are within Newport Beach. As part of the project, the eight Newport Beach intersections will receive new traffic signal controllers, communication equipment, battery backup systems, Closed Circuit TV cameras, and emergency vehicle preemption. a lZrOTA M I LTA UiTo 6 Should the project application be successful and awarded Measure M2 grant funds, the City of Newport Beach will enter into a cooperative agreement with the City of Santa Ana that will include the required funding for Newport Beach's share of the project. The conceptual cost estimate, including work within Santa Ana, Costa Mesa, Newport Beach, and Caltrans District 12 right-of-way, is approximately $4,218,657. The Newport Beach portion of the scope is estimated to be $540,242; and of that amount, the grant's match requirement is estimated at $108,048 (20%). Funding for the project match will be included in the Fiscal Year 2025-2026 Capital Improvement Program for City Council consideration. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: Attachment A — Resolution No. 2024-87 Attachment B — Location Map 3-2 ATTACHMENT A Resolution No. 2024-87 3-3 RESOLUTION NO.2024 - 87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, SUPPORTING AN APPLICATION BY THE CITY OF SANTA ANA TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR FUNDING UNDER MEASURE M2 REGIONAL TRAFFIC SIGNAL SYNCHRONIZATION PROGRAM, FOR THE BRISTOL STREET PROJECT FROM SR-22 TO JAMBOREE ROAD WHEREAS, pursuant to the Renewed Measure M Transportation Ordinance and Investment Plan ("Measure M2"), approved by the voters on November 7, 2006, the Orange County Transportation Authority ("OCTA") administers several competitive grant programs, as outlined in OCTA Ordinance No. 3, dated July 24, 2006, as amended ("Measure M2 Ordinance"), which are offered to local agencies to assist in funding transportation projects such as street improvements, transit expansion, and environmental mitigation; WHEREAS, to administer the distribution of Measure M2 funds, OCTA adopted the Comprehensive Transportation Funding Program Guidelines ("Guidelines") setting forth the procedures and requirements for selecting projects for Measure M2 funding; WHEREAS, the City of Newport Beach ("City"), in coordination with the City of Santa Ana and the City of Costa Mesa, desires to implement transportation improvements consisting of a multi -jurisdictional traffic signal synchronization project, the Bristol Street Project from SR-22 to Jamboree Road ("Project'); WHEREAS, traffic signal synchronization projects are eligible for Measure M2 funding under Project "P," the Regional Traffic Signal Synchronization Program ("Program"), which targets over two thousand (2000) signalized intersections across Orange County to maintain traffic signal synchronization, improve traffic flow, and reduce congestion across jurisdictions; WHEREAS, the City desires to support the application of the City of Santa Ana for Program funding to support the Project; WHEREAS, as required by the Guidelines, the City has been declared by OCTA to meet the eligibility requirements to receive revenues as part of Measure M2; 3-4 Resolution No. 2024- Page 2 of 3 WHEREAS, as required by the Guidelines, the City adopted a Local Signal Synchronization Plan that is consistent with the countywide Regional Traffic Signal Synchronization Master Plan and is a key component of the City's efforts to synchronize traffic signals across its boundaries; WHEREAS, the City will not use Measure M2 funds to supplant developer fees or other commitments; WHEREAS, by this resolution, the City intends to authorize a formal amendment to its seven-year Capital Improvement Program to add the Project for funding upon approval from OCTA's Board of Directors to fund the Project as part of the Program; WHEREAS, the City must include all projects funded by Measure M2 net revenues in the City's seven-year Capital Improvement Program as part of Measure M2 Ordinance eligibility requirements; and WHEREAS, by this resolution, the City intends, in coordination with the City of Santa Ana and the City of Costa Mesa, to provide twenty percent (20%) matching funds for Project, as required by Guidelines. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby support the application of the City of Santa Ana, and hereby requests OCTA allocate Program funds to support the Project, in the amounts specified in the application. Section 2: The City Council does hereby agree that Program funding shall not be used to supplant developer fees or other commitments. Section 3: The City Council does hereby agree to provide twenty percent (20%) matching funds for the Project, and does hereby authorize a formal amendment to the City's seven-year Capital Improvement Program to add the Project for funding, upon OCTA's Board of Directors approval of the Project for Program funding. Section 4: The City Council does hereby authorize the City Manager, or the City Manager's designee, to act in connection with Program requirements, execute documents, and to provide such additional information as may be required. Section 5: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. 3-5 Resolution No. 2024- Page 3 of 3 Section 6: if any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 7: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 8: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
