Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer - 949-644-3321 tandefur@newportbeachca.gov TITLE: Fiscal Year 2024-25 Restroom Rehabilitation Phase 2 — Award of Contract No. 8905-3 (24F02) ABSTRACT: The City of Newport Beach received construction bids for the Fiscal Year 2024-25 Restroom Rehabilitation Phase 2 project. Staff requests City Council approval to award the construction contract to Empire Design & Build LLC of Irvine. This project rehabilitates four deteriorated restrooms located at Washington Street, Balboa Ferry, 3811 Street, and Irvine Terrace Park with new plumbing fixtures, flooring, doors and roof systems. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(d), Class 1 (restoration or rehabilitation of deteriorated facilities involving negligible or no expansion of existing use) of the CEQA Guidelines, because this project has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Award Contract No. 8905-3 to Empire Design & Build LLC for the total bid price of $920,000.00 for the FY 2024-25 Restroom Rehabilitation Phase 2, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $92,000.00 (approximately 10% of total bid) to cover the cost of unforeseen work not included in the original contract. DISCUSSION: Staff has identified the restrooms at Washington Street, Balboa Ferry, 38t" Street, and Irvine Terrace Park as needing repair as part of the annual Facilities Maintenance Master Plan program. These facilities are between approximately 25-65 years old and are experiencing deterioration due to their age. This project will upgrade the roofing systems to protect the buildings from potential water damage, update flooring, replace deteriorated doors, and update the plumbing fixtures to ensure American with Disabilities Act standards. The apparent low bidder, R&L Group Inc., was deemed non -responsive since its bid contained irregularities and did not conform to the Instructions to Bidders. The second lowest bidder, Empire Design & Build LLC, possesses a California State Contractor's License Classification "B", as required by the project specifications. A review of references for Empire Design & Build LLC shows satisfactory completion of similar contracts for other municipalities. The low bid was approximately 20% below the Engineer's Estimate of $1,144,000. The difference between the low bid and the Engineer's Estimate can be attributed to an improving bidding climate and a large field of bidders. Pursuant to the contract specifications, the contractor will have 90 consecutive working days to complete the project. Work is scheduled to start in January 2024. The project plans and specifications will be available for review at the November 19, 2024 City Council meeting or upon request. FISCAL IMPACT: The adopted Capital Improvement Program budget includes sufficient funding for the award of this contract. It will be expensed to the Facilities Maintenance Master Plan (General Funds) accounts in the Public Works Department, 01201925-25F02 and 57101- 24F02. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (restoration or rehabilitation of deteriorated facilities involving negligible or no expansion of existing use) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
