Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Andy Tran, Principal Civil Engineer - 949-644-3315, atran@newportbeachca.gov TITLE: Superior Avenue Pedestrian/Bicycle Bridge and Parking Lot (Project No. 15T09) — Notice of Completion for Contract No. 8020-6 h\ 33 d:7±Tip 6 On November 29, 2022, the City Council awarded Contract No. 8020-6 for the Superior Avenue Pedestrian/Bicycle Bridge and Sunset View Park Parking Lot project to Reyes Construction, Inc. The project involved construction of a new pedestrian/bicycle bridge across Superior Avenue, expansion of Sunset View Park, and construction of a larger parking lot at the intersection of Superior Avenue and Pacific Coast Highway (PCH). The work is now complete and staff requests City Council acceptance and close out of the contract. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project. DISCUSSION: Overall Contract Cost/Time Summary Awarded Contract Final Total Contract Total Contract Percent Contract Amount Amount Change Amount Cost Change $10,518,759.00 $11,431,428.94 $912,669.94 8.7% Allowed Contract Time + 422 Actual Time Used (Days) 422 Approved Extensions (Days) _ This project included the construction of a new pedestrian/bicycle bridge across Superior Avenue, expansion of Sunset View Park with additional landscaping and grass area, and construction of a larger parking lot at the intersection of Superior Avenue and PCH. 6-1 Superior Avenue Pedestrian/Bicycle Bridge and Parking Lot — Notice of Completion for Contract No. 8020-6 February 25, 2025 Page 2 The new pedestrian/bicycle bridge and larger parking lot have improved pedestrian and cyclist access and safety for visitors to both Sunset Ridge and Sunset View Parks. The contracted work has been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows: Original Bid Amount: $ 10,518,759.00 Actual Cost of Bid Items Constructed: $ 10,473,726.01 Total Change Orders: $ 957,702.93 Final Contract Cost: $ 11,431,428.94 The final total contract amount was $11,431,428.94, which was approximately 8.7% higher than the original bid amount. This cost increase was primarily due to unforeseen poor soil conditions, which required modifications to the retaining wall design and a significant amount of additional earthwork and foundation work. Several other smaller change order items were related to excessive groundwater seepage and unforeseen existing underground utilities. A summary of the project schedule milestones is as follows: Estimated Start of Construction per Annual Baseline Schedule February 27, 2023 Actual Start of Construction Per Notice to Proceed January 23, 2023 Estimated Completion per Annual Baseline Schedule November 30, 2024 Substantial Completion Date Inclusive of Extra Work September 27, 2024 The contract time was extended to account for the additional time needed to complete change order work. In addition, there was a total of 25 inclement weather days, which delayed the project completion date. FISCAL IMPACT: The Superior Avenue Pedestrian/Bicycle Bridge and Sunset View Park Parking Lot project was included within the FY 2022-23 Capital Improvement Program Budget. Funds for the construction contract were expended from the following accounts: Account Description Bicycle Corridor Improvement Program (BCIP) Federal Grant Transportation and Circulation Facilities Financing Plan (FFP): Parks/Community Centers Account Number Amount 13501-980000-15T09 $ 2,349,600.00 14001-980000-15T09 $ 2,943,600.00 56201-980000-15T09 $ 6,138,228.94 Total: $ 11,431,428.94 The BCIP is a funding program administered by the Orange County Transportation Authority for bicycle and pedestrian projects that reduce traffic congestion and improve air quality. The City received Congestion Mitigation and Air Quality federal funds for this project under the BCIP. 6-2 Superior Avenue Pedestrian/Bicycle Bridge and Parking Lot — Notice of Completion for Contract No. 8020-6 February 25, 2025 Page 3 Transportation and Circulation funds are fair share revenues collected from developers for capital improvement projects meeting the circulation element of the City's General Plan. The FFP, funded by the General Fund and development agreement contributions, was created to allow for the construction and rehabilitation of City facilities. ENVIRONMENTAL REVIEW: On November 29, 2022, the City Council found the requirements for environmental review under the California Environmental Quality Act (CEQA) was satisfied by the November 19, 2019 City Council adoption of Resolution No. 2019-102, A Resolution of the City Council of the City of Newport Beach, California, Adopting Mitigated Negative Declaration No. ND2019-002 (SCH# 2019099074) for the Superior Avenue Pedestrian and Bicycle Bridge and Parking Lot Project (PA2019-014), including the Mitigation Monitoring and Reporting Program, pursuant to CEQA Guidelines and City Council Policy K-3. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
