Re. Proposed Ordinance 2025-5 Amendment to
Construction
Honorable Mayor and Council Members:
NBMC Ordinances regarding Timelines for Completion of
I have just learned of the proposed Ordinance to Amend the City's Municipal Codes relating to , Timelines for
Completion of Construction in Single and Two -Unit Residential zones.
This Ordinance proposes to open the door to Extensions to Timelines for up to 2 additional ( or more) Timeline
extensions —all to be granted at the discretion of a single Building Official.
Ordinance No. 2019-8 adopted in 2019 was fundamentally a well constructed and generous ordinance, limiting
Completion Timelines to not more than three years ( increased from prior period of two years).
The exceptional "urgent type" ordinance extended during COVID ( 2022-8) should rightly sunset, as is suggested.
Restoration and activation of the provision of Ordinance 2019-8 makes good sense. We recommend and request that
the Council consider this approach,
rather than opening the door to more protracted construction periods , subject only to the discretion of a "Building
official".
Introducing additional uncertainty into building timelines gives rise to more layering of multiple construction projects in
highly dense residential zones. There are already safety issues associated with impairment of street/alley ingress and
egress.
Our residential communities continue to be increasingly burdened by all of the impacts associated with extensive
construction, particularly as the City has allowed increasing intensification of development.
We respectfully request that the City not approve the proposed new Amendment, and remand staff to a much simpler
and well crafted path established in Ordinance No. 2019-8.
