Dear Ms. Makana Nova,
DART development is pleased to submit this 23 unit townhouse project with
the additions and revisions requested in your Notice of Incomplete Filing
dated April 4th, 2013. The following letter notes our responses in detail and
corresponds by point to that notice.
1. Property Ownership
a. Updated Title Report was submitted by email 11/28/2013 and is
included again in this submittal.
2. Letter of Agency: Letter provided 11/03/2013. Included again with this
submittal.
3. Planned Community Text: Revisions provided in this submittal.
4. Project Plans. Twelve sets of 24 inch by 36 inch revised plans are included
which include:
a. Site Plan
I. Dimensions added to reflect tract map dimensions.
II. Circulation: All parking spaces and drive isles are dimensioned.
III. Per our conversation with David Keely/PW the driveway
approach on Via Malaga is required to be 26’ because of the
guest parking space located next to the drive isle. The driveway
on Via Oporto is acceptable with 24’ width.
IV. Dimensions for all interior drive isles provided.
V. Trash areas: The project proposes a total of 537 SF of trash
areas, which exceeds the required 96 SF. Trash area
calculations are provided on D-3.

b. Fire Flow.
i. Testing for fire flow was performed on December 18, 2012 according to
Newport Beach Guideline B.01. Results were included in the last
submittal and are included again in this re-submittal on C-5.
ii. Note provided under Fire Department Notes on Title sheet.
iii. Fire Sprinklers will be provided with separate utilities for each unit.
Note provided under Fire Department Notes on Title sheet.
iv. A manual fire alarm system per California Fire Code Section 907.2.9.1
will be provided for each R-2 occupancy. Note added under Fire
Department Notes on Title sheet.
c. Public Works Comments:
i through viii: See Responses from C+V at the end of this letter.
ix 8’-2” clearance noted on D-5.
d. Building Division Comments
1) CBC 2010 will be used for this project
2) Exiting for Roof Decks: 250 ft max per Sec. 1016.1 for fully
sprinklered and less than 20 occupant per story = 1 exit required.
3) 3 ADA Units required, 3 ADA Units provided. 1 of each type of unit.
4) Design is compliant with 11A.
5) Accessible route from public sidewalk and accessible parking
shown on site plan. Accessible signage will be clearly noted on plan
check submittal.
6) Sprinkler system NFPA 13R proposed. Each unit will have its
individual riser. See note on Title sheet.
7) No imaginary property lines required. Building justified as one Type
II-B, fully sprinklered, see Title Sheet.
8) We are following the CBC for this project. The upper level element
is limited to a stair penthouse (6’-8” clear height) which is not
counted as a story per CBC Sect. 1509. The pop up in the living
room of the Harbor units is less than 6’-8” in height and does not
count as a story.
9) Landing provided on each side of the door to the roof.
10) All spa edges will be located more than 3’ from the edge of the roof.
11) Egress from roof deck per CBC. Sprinklered R-2 = 250 ft. 1 exit
required for less than 20 occupants. Common Path of travel does
not apply.
12) Mechanical units will comply to sound ratings. Spa weight will be
considered in lateral loading analysis.
13) Mechanical equipment for elevator will be vented. Location tdb.
Proposed model Inclinator XL Gearless Traction-950 complies with
ASTM A17.1. Cut sheet included in this submittal.

14) Floor area of Roof Deck shown on D-7 to D-13.
15) The design of frames will meet the special moment resisting
frames for 3 stories. Plans will be coordinated to accommodate
structure.
16) Detectable warning signs added to site plan (D.W.)
17) Decks will be provided with adequate drainage with overflow drains
or scuppers.
e. General Services/Municipal Operations
i. Existing street trees to be removed. Noted added on
Landscape Plan L-5
ii. 5-6ft cut out with cast iron tree gates noted on L-5
iii. Separate valves per street and 2 bubblers per street tree from
the private irrigation system will be provided. Noted on L-5.
iv. Tree type revised, minimum size noted on L-5.
v. Tree type revised, minimum size noted on L-5.
f. Landscaping. Total Landscaped area listed on Site Plan D-3. Chapter
14.17 (Water-Efficient Landscaping) note added to L-5.
g. Topographic Survey. Existing grade points included on topographic
survey and signed.
h. Height. Elevation points added on D-5.
