TITLE: Resolution No. 2025-16: Creating the Integrated Pest Management
Ad Hoc Advisory Committee
ABSTRACT:
If adopted, Resolution No. 2025-16 would establish the Ad Hoc Integrated Pest
Management Program Review Committee, comprised of three Newport Beach City
Councilmembers to review and make recommendations regarding revisions to the
City of Newport Beach Integrated Pest Management Program.
RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Adopt Resolution No. 2025-12, A Resolution of the City Council of the City of Newport
Beach, California, Creating an Ad Hoc Committee to Review the City's Integrated
Pest Management Program and Make Recommendations to the City Council
Regarding Revisions Thereto; and
c) Confirm the appointments of Mayor Pro Tern Lauren Kleiman, Councilmember
Noah Blom and Councilmember Sara J. Weber to serve on the Ad Hoc Council
Integrated Pest Management Program Review Committee.
DISCUSSION:
At the request of Councilmember Sara J. Weber pursuant to Council Policy A-1, at its
April 15, 2025 meeting, the City Council considered forming an ad hoc committee to
review the City's policy on the use of pesticides and to make recommendations to the
Council. The Council voted 7-0, via a straw poll, in favor of staff returning with an item.
If adopted, Resolution No. 2025-16 would establish the Ad Hoc Integrated Pest
Management Program Review Committee (Committee) consisting of three
councilmembers appointed by the Mayor and confirmed by the entire Council.

The Committee will be responsible for reviewing the City's current Integrated Pest
Management (IPM) Program, which governs the use of pesticides, and submitting
recommendations for potential revisions to the full Council for consideration. The
Committee would be advisory and expire upon making a final recommendation to the
Council or December 31, 2025, whichever is earlier.
Additionally, for the Council's consideration, are the appointments of Mayor Pro Tern
Lauren Kleiman, Councilmember Noah Blom and Councilmember Sara J. Weber to serve
on the Committee.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2025-16
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, CREATING THE
INTEGRATED PEST MANAGEMENT AD HOC ADVISORY
COMMITTEE
WHEREAS, Section 200 of the City of Newport Beach ("City") Charter vests the
City Council with the authority to make and enforce all laws, rules and regulations with
respect to municipal affairs subject only to the restrictions and limitations contained in
the Charter and the State Constitution, and the power to exercise, or act pursuant to
any and all rights, powers, and privileges, or procedures granted or prescribed by any
law of the State of California,
WHEREAS, the City follows an Integrated Pest Management ("IPM") program to
manage pests including, but not limited to, weeds, fungi, insects, rodents, and mollusks,
through the use of a combination of practices and procedures to effectively and
economically manage such pests over the long term with the least possible hazard to
people, property, and the environment;
WHEREAS, the IPM procedures include pest identification, evaluation and
assessment, guidelines for management and prevention, use of management tools, and
monitoring the success and effectiveness of management practices;
WHEREAS, the IPM program prioritizes the use of cultural, organic, and
mechanical management methods first, and use of synthetic pesticides secondarily and
only where practical and cost-effective;
WHEREAS, the City is required by its National Pollutant Discharge Elimination
System ("NPDES") permit to implement and maintain its IPM program and comply with
regulatory reporting requirements; and
WHEREAS, the City Council desires to create the Integrated Pest Management
Ad Hoc Advisory Committee ("Committee") to review the City's IPM program and make
recommendations to the entire City Council regarding revisions thereto.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:

Section 1: The City Council hereby creates the Integrated Pest Management
Ad Hoc Advisory Committee ("Committee"), which shall be comprised of Mayor Pro Tern
Lauren Kleiman, and Councilmembers Sara J. Weber and Noah Blom.
Section 2: The sole purpose and responsibility of the Committee shall be to
review the City's Integrated Pest Management program and make recommendations to
the entire City Council regarding revisions thereto.
Section 3: The Committee shall function as an ad hoc committee and shall not
be subject to the Ralph M. Brown Act codified in California Section 54950 of seq.
Section 4: The Committee shall expire upon making its final recommendations
to the entire City Council at a noticed public meeting of the City Council or December
31, 2026, whichever occurs first.
Section 5: if any section, subsection, sentence, clause or phrase of this
resolution is for any reason held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The
City Council hereby declares that it would have passed this resolution and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 6: The recitals provided in this resolution are true and correct and are
incorporated into the substantive portion of this resolution.
Section 7: The City Council finds the adoption of this resolution is not subject
to the California Environmental Quality Act (" CEQX) pursuant to Sections 15060(c)(2)
(the activity will not result in a direct or reasonably foreseeable indirect physical change
in the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6,
Chapter 3, because it has no potential for resulting in physical change to the
environment, directly or indirectly.

Dear Newport Beach Officials,
I hope this message finds you well. I'm reaching out with deep concern and a heartfelt plea
regarding the ongoing use of synthetic chemical herbicides and pesticides in our parks,
sidewalks, and public spaces.
As a member of this beautiful community, I'm troubled that these chemicals — many of
which are linked to serious health risks — are being used in places where children play,

families gather, and neighbors walk daily. Research has shown that exposure to these
substances can increase the risk of cancer, disrupt hormone function, impair neurological
development in children, and contribute to respiratory and reproductive issues. This isn't
just about environmental impact — it's about public health.
In light of this, I respectfully urge the City of Newport Beach to pause all chemical spraying
and consider safer, non -toxic alternatives for landscape and pest management. Other
cities across the country have made this transition successfully, proving that healthier
options are both viable and effective.
I also encourage the City to consider forming a resident advisory committee to allow for
greater community input on decisions that affect our shared spaces and well-being.

prioritize health, sustainability, and transparency.
We all want Newport Beach to continue being a safe, thriving place to live. I believe this is

Hi Kevin,
Many neighbors have been asking when the spray of the Cool Power herbicide will happen
at Sunset Ridge Park and if signs will be put out, as you mentioned, 24 hours in advance.
We want to make sure that our kids/dogs are not on the grass the day of the spray, seeing
as this substitute is also not that great and poses toxic risks.
I have a few follow up questions for some clarification:
1. When you spray the field, do you spray the entire field or just the weed itself?

2. Are signs also required after the area is sprayed to alert people that may not have seen
the tiny warning sign that something toxic has been sprayed in the area?
3. 1 was sent a screenshot of the weekly chemical application record, can you please send
me a direct link or tell me where this entire record can be reviewed on the city website.
4. 1 noticed on the screenshot list that improper (or abbreviated) names of products are
being used on this list. Is there a reason that the incorrect product name "Speedzone" vs
the proper name "Speedzone Southern EW" was not used on this list? It is very important
that the correct product names are used for 100% transparency of the danger and that the
correct SIDS can be reviewed.
5. Who is the Environmental Engineer on staff for the Parks Department, who makes the
decision on what products are being used?
6. Have you seen what other cities are doing in our area for weed

Hi Kevin,
It looks like the SIDS that you sent is not the same product name that was advertised as
being used on the sign (Speedzone Southern EW) at Sunset Ridge Park (see pic). I went
directly to the manufacturers website and found the most current SIDS for Speedzone
Southern EW, which has the same information as the link that I sent over to you (and City
Council) previously.
Here's that most updated SIDS for the correct product:

It states under section 2 Hazards Identification: Carcinogenicity Category 1A
Also, in Emergency Overview: It states "May cause cancer"
It also states under section 11 that the "trade secret" is a Group 1 for IARC which I
already sent you over that information.
I must say I've never seen a city worker continue to try so hard to justify the use of a
product that could potentially hurt children/dogs so that a baseball can bounce better...
This product should be discontinued for use in all parks in Newport Beach. I will continue
to spread the information to all my friends that have kids/dogs that play on these
fields/parks.

Thanks for sending the information over, I will look it over. I appreciate you updating the
weed spray to Cool Power that will be used at Sunset Ridge Park. I strongly urge you to
stop any upcoming use of Speedzone Southern EW on any fields where children and
dogs are playing in Newport Beach.
The SDS for the herbicide being used is assigned classification IA by the
International Agency for Research on Cancer (IARC). This means that the herbicide is
a recognized human carcinogen (see attached IARC document). This should not be
used on any fields/parks that kids/dogs are playing in.

program. As I mentioned in our conversation, the treatment of broadleaf weeds in our fields is
critical for safety concerns, rather than aesthetics, including: 1.) bees attracted to clover and
other flowers and athletes that are allergic to bee stings, 2.) tripping over uneven areas of
clover, other weeds vs. grass, and 3.) bad hops on uneven grass, infested with clover and other
weeds. Additionally, the City and our athletic users have invested 10,000's of dollars annually
on ensuring a high quality sports field which includes superior playability.
did mention in our conversation that we have tested other broadleaf -type products, including
organics, with poor results. Speedzone offers the best results at controlling broadleaf

B lo.pdf. . We have seen fair results in using this product. The treatment has been rescheduled
for Wednesday. Also, the acreage will be adjusted as well, as it should only be approximately
two acres.
Please understand that all products that we apply are approved for use by the County and State,
and California is the most restrictive State in the Union regarding pesticide use regulations. We are
inspected and reviewed by these regulatory agencies on a regular basis and have been found to be
within the guidelines. In fact, our program goes above and beyond the minimum requirements and
was noted by the County Agricultural Commissioners as a high quality, model program. We look to
these regulatory agencies as a means to set standards for many of our various programs and
policies. When these standards change and are updated, we change our programs to follow.
The City's IPM program currently operates in the following order in our effort to control weeds and
unwanted plants. First, we work to maintain good plant health by using cultural and organic
methods of soil health (which keeps weed growth to a minimum). We next use human or
mechanical weed removal methods when feasible, then lastly, we use very minimal amount of
synthetic pesticides applications. We have found that using a smaller amount of synthetic

herbicides (like Coolpower) to control weeds is more effective and efficient, and may in fact be safer
and less toxic overall than using a larger amount, with more frequent applications, of an organic
chemical herbicide.
We have had a lot of review and discussion of this topic over the many years. If you would like to
learn more about the City's Organic First Integrated Pest Management program there is a good

Dear City of Newport Beach Officials,
I hope this message finds you well. I am writing as a concerned resident of Newport
Beach regarding the recent Notice of Application posted at Sunset Ridge Park (4850
West Coast Hwy) announcing the use of SpeedZone Southern EW on Tuesday, April
15, 2025, between 6:00 a.m. and 9:00 a.m., covering approximately 4.91 acres of
the park.
While we understand the importance of maintaining our public green spaces, many
residents are alarmed and upset by the decision to spray chemical herbicides —
particularly one like SpeedZone Southern EW, which contains ingredients that have
been linked to cancer in dogs, even after the product has dried. This raises serious
concerns, especially for families who walk their pets and children who play on this
grass shortly after such treatments.
The idea that our beloved neighborhood park could pose health risks to our pets,
children, and ourselves is deeply troubling. As a community, we do not find it
acceptable that these chemicals are being applied in a public recreational area
without broader notice, discussion, or exploration of safer alternatives.
I spoke directly to Kevin Pekar, he thinks that the tripping hazard for this weed is a
greater risk than spraying our fields with toxic chemicals that are linked to cancer.
He even mentioned on our call that there are safer alternatives and got very
defensive when I asked why they're not being used. He also claims that I need to
come up with alternatives for him. All safe alternatives 100% need to be looked at

Hoc Committee to review the City's policy on the use of pesticides and make
recommendations to the City Council.
As an environmental engineer, who specializes in soil and groundwater remediation
(including treating pesticides), this is a top priority for me to help bring awareness of this
issue to my neighbors/friends in the community. I plan on staying very involved with this
process.

It looks like other neighboring cities (Irvine, SJC, Laguna, Costa Mesa - to name a few)
have done a great job on prioritizing public health by eliminating toxic pesticides in their
city and are way ahead of Newport Beach. There is a great

we can also add our city on this growing list in the near future to ensure that the health

regarding the recent Notice of Application posted at Sunset Ridge Park (4850 West Coast Hwy)
announcing the use of SpeedZone Southern EW on Tuesday, April 15, 2025, between 6:00 a.m. and 9:00
a.m., covering approximately 4.91 acres of the park.
While we understand the importance of maintaining our public green spaces, many residents are
alarmed and upset by the decision to spray chemical herbicides —particularly one like SpeedZone
Southern EW, which contains ingredients that have been linked to cancer in dogs, even after the product
has dried. This also concerns me as a mother, because my children play and run around the grass with

my dog as well. This raises serious concerns, especially for families who walk their pets and children who
play on this grass shortly after such treatments.
The idea that our beloved neighborhood park could pose health risks to our pets, children, and ourselves
is deeply troubling. As a community, we do not find it acceptable that these chemicals are being applied
in a public recreational area without broader notice, discussion, or exploration of safer alternatives.
We respectfully ask for more transparency and answers to the following:

I am writing to express deep concern and urgent frustration over the continued spraying of toxic

on city property. Decisions that impact our health and environment should not be made solely by city
employees without meaningful community involvement. We propose the creation of a resident advisory
committee — one that includes local voices, promotes transparency, and allows for public feedback
before any chemical applications or landscape maintenance decisions are made. Many of us would be
willing to participate and collaborate to find safe, sustainable solutions.
We demand that the City of Newport Beach immediately halt all spraying of toxic chemical herbicides
and pesticides in our community and adopt safe, non -toxic alternatives for landscaping and pest control.
Cities across the country have already transitioned successfully to organic, eco-conscious maintenance
programs — and Newport Beach can do the same.

I'd like to point out that the SDS for the herbicide being used is assigned classification 1A by the
International Agency for Research on Cancer (IARC).

Dear Newport Beach Officials,
I am writing to express deep concern and urgent frustration over the continued spraying of
toxic chemical herbicides and pesticides in our community. These chemicals are known to be
hazardous to human health, and their use in our parks, sidewalks, and public spaces is entirely
unacceptable.

serious health effects. These include, but are not limited to:
• Increased cancer risks (including non -Hodgkin lymphoma, leukemia, colon and prostate
cancer)
• Endocrine disruption

• Reproductive harm
• Asthma and other chronic respiratory conditions
• Skin and eye irritation
• Gut microbiome disruption
We are witnessing a troubling rise in cancer rates and chronic illnesses nationwide, and the

Organization has even classified some commonly used herbicides as "probably carcinogenic to
humans."
The residents of Newport Beach deserve to live in a safe, healthy environment free from hidden
chemical threats. Our public spaces should promote wellness — not pose a risk to people
simply enjoying the outdoors.
As taxpayers and residents, we believe we should have more input on the products and
methods used on city property. Decisions that impact our health and environment should not
be made solely by city employees without meaningful community involvement. We propose
the creation of a resident advisory committee — one that includes local voices, promotes
transparency, and allows for public feedback before any chemical applications or landscape
maintenance decisions are made. Many of us would be willing to participate and collaborate to
find safe, sustainable solutions.
We demand that the City of Newport Beach immediately halt all spraying of toxic chemical
herbicides and pesticides in our community and adopt safe, non -toxic alternatives for
landscaping and pest control. Cities across the country have already transitioned successfully to
organic, eco-conscious maintenance programs — and Newport Beach can do the same.

Dear Newport Beach Officials,
I am writing to express deep concern and urgent frustration over the continued spraying of
toxic chemical herbicides and pesticides in our community. These chemicals are known to
be hazardous to human health, and their use in our parks, sidewalks, and public spaces is
entirely unacceptable.
Scientific research has consistently linked synthetic herbicides and pesticides to a wide
range of serious health effects. These include, but are not limited to:
• Increased cancer risks (including non -Hodgkin lymphoma, leukemia, colon and prostate
cancer)
• Endocrine disruption
• Neurological damage and developmental delays in children
• Reproductive harm
• Asthma and other chronic respiratory conditions
• Skin and eye irritation
• Gut microbiome disruption
We are witnessing a troubling rise in cancer rates and chronic illnesses nationwide, and
the association with prolonged chemical exposure is well -documented. The World Health
Organization has even classified some commonly used herbicides as "probably
carcinogenic to humans."
The residents of Newport Beach deserve to live in a safe, healthy environment free from
hidden chemical threats. Our public spaces should promote wellness — not pose a risk to
people simply enjoying the outdoors.
As taxpayers and residents, we believe we should have more input on the products and
methods used on city property. Decisions that impact our health and environment should
not be made solely by city employees without meaningful community involvement. We
propose the creation of a resident advisory committee — one that includes local voices,
promotes transparency, and allows for public feedback before any chemical applications
or landscape maintenance decisions are made. Many of us would be willing to participate
and collaborate to find safe, sustainable solutions.
We demand that the City of Newport Beach immediately halt all spraying of toxic chemical
herbicides and pesticides in our community and adopt safe, non -toxic alternatives for
Landscaping and pest control. Cities across the country have already transitioned
successfully to organic, eco-conscious maintenance programs — and Newport Beach can
do the same.
We are not asking —we are insisting— on change. Our health and the well-being of future

Dear Newport Beach Officials,
I am writing to express deep concern and urgent frustration over the continued spraying of
toxic chemical herbicides and pesticides in our community. These chemicals are known to be
hazardous to human health and their use in our parks, sidewalks, and public spaces is entirely
unacceptable.

Scientific research has consistently linked synthetic herbicides and pesticides to a wide range of
serious health effects. These include, but are not limited to:
• Increased cancer risks (including non -Hodgkin lymphoma, leukemia, colon and prostate
cancer)
• Endocrine disruption
• Neurological damage and developmental delays in children
• Reproductive harm
• Asthma and other chronic respiratory conditions
• Skin and eye irritation
• Gut microbiome disruption
We are witnessing a troubling rise in cancer rates and chronic illnesses nationwide and the
association with prolonged chemical exposure is well -documented. The World Health
Organization has even classified some commonly used herbicides as "probably carcinogenic to
humans."
The residents of Newport Beach deserve to live in a safe, healthy environment free from hidden
chemical threats. Our public spaces should promote wellness — not pose a risk to people
simply enjoying the outdoors.
As taxpayers and residents, we believe we should have more input on the products and
methods used on city property. Decisions that impact our health and environment should not
be made solely by city employees without meaningful community involvement. We propose
the creation of a resident advisory committee — one that includes local voices, promotes
transparency, and allows for public feedback before any chemical applications or landscape
maintenance decisions are made. Many of us would be willing to participate and collaborate to
find safe, sustainable solutions.
We demand that the City of Newport Beach immediately halt all spraying of toxic chemical
herbicides and pesticides in our community and adopt safe, non -toxic alternatives for
landscaping and pest control. Cities across the country have already transitioned successfully to
organic, eco-conscious maintenance programs — and Newport Beach can do the same.
We are not asking — we are insisting — on change. Our health and the well-being of future
generations depend on it.
