Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov PREPARED BY: Jennifer Farris, Assistant City Clerk - 949-644-3006, jfarris@newportbeachca.gov TITLE: Confirmation of Appointments to the Ad Hoc Committee on Utilization of Lower Castaways and Aquatic Center Site Options ABSTRACT: The Ad Hoc Committee on Utilization of Lower Castaways and Aquatic Center Site Options was created by Resolution No. 2025-23 at the May 13, 2025 City Council meeting. As directed by the resolution, except as otherwise required by State law, the Mayor (or his/her designee) shall have the discretion to determine the process for selecting members and shall not be required to form an "ad -hoc appointments committee" or comply with the procedural or timing requirements set forth in City Council Policy A-2. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Confirm Mayor Joe Stapleton's appointments of himself, Councilmember Noah Blom, Councilmember Michelle Barto, Harbor Commissioner Rudy Svrcek, Parks, Beaches and Recreation Commissioner Keira Kirby, Planning Commissioner Jonathan Langford, and Laird Hayes, as the citizen member, to the Ad Hoc Committee on the Utilization of Lower Castaways and Aquatic Center Site Options. DISCUSSION: At the May 13, 2025 City Council meeting, the City Council adopted Resolution No. 2025-23 which created the Ad Hoc Committee on Utilization of Lower Castaways and Aquatic Center Site Options Committee. The Committee shall consist of seven members comprised of three Councilmembers, one Harbor Commissioner, one Parks, Beaches, and Recreation Commissioner, one Planning Commissioner, and one citizen member. To fill the citizen member vacancy and pursuant to the Maddy Act, the City Clerk prepared and posted a Notice of Vacancy on Thursday, May 15, 2025, in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council Chambers, and on the City's webpage. In addition, the Notice of Vacancy was published in the Daily Pilot on Saturday, May 17, 2025. Applications were accepted by the City Clerk's Office until noon on Thursday, May 22, 2025. Upon closure of the application period, only one applicant was interested in the vacant citizen member seat. 15-1 Confirmation of Appointments to the Ad Hoc Committee on Utilization of Lower Castaways and Aquatic Center Site Options June 10, 2025 Page 2 A copy of the application is attached hereto as Attachment A. FISCAL IMPACT: There is no fiscal impact related to this item. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
