Please be advised that after reviewing the subject applications, your submittal is
incomplete and further information is required before we are able to proceed with the
application process.
The following documentation is required to proceed:
Site Development Review
SD1. Project Justification. Please provide justification addressing each required
finding in Newport Beach Municipal Code (NBMC) Section 20.52.080(F) (Site
Development Reviews – Findings and Decision) as well as those found in NBMC
Section 20.30.060(D)(9) (Exceptions to Height Limits – Landmark Buildings).
SD2. Additional Exhibits. Although not necessarily required, please consider
submitting a materials board to indicate the type and quality of materials to be used
as exterior treatment of the building.
Coastal Development Permit
CD1. Project Justification. Please provide justification addressing each required
finding in NBMC Section 21.52.015(F) (Coastal Development Permits – Findings and
Decision).
CD2. Public Noticing Requirements. A Notice of Filing is required to be posted on-
site to indicate an application for a coastal development permit has been filed and is
currently in process. Please complete and return the attached notice form. The City

will assist in transferring the contents to indestructible paper for posting on-site. The
applicant is responsible for maintaining the sign in satisfactory condition.
CD3. Plans. Please submit the following plan documents for review to assist in
making the required findings.
Construction erosion control plan.
o Provide a temporary/construction erosion control plan in compliance
with Building Division standards and requirements.
Preliminary grading and draining plan.
o Provide a preliminary grading and drainage plan designed to be
compliance with NBMC Chapter 15.10 (Excavation and Grading Code)
requirements.
Cross sections.
Demolition plan.
Stamped and signed topographic survey.
Conditional Use Permit
UP1. Project Justification. Please provide justification addressing each required
finding in NBMC Section 20.52.020(F) (Conditional and Minor Use Permits –
Findings and Decision).
General Requirements and Comments
GEN1. Project Review Requests (PRRs). Please review the attached PRRs, which
have been received from each reviewing department except for the Police
Department. Provide responses to address each comment and address corrections
as necessary.
GEN2. Plans. Please revise elevation plans to demonstrate the proposed height
from established grade in compliance with NBMC Section 20.30.050 (Grade
Establishment).
GEN3. Signage. If signage is intended to be included in this approval, please provide
dimensioned drawings showing more detail for each of the proposed signs.
GEN4. Project Description. Please clarify the following from the submitted
narrative.
Rooftop deck.
o Confirm operation of the rooftop deck is requested until midnight daily.
o Will there be any live entertainment and/or amplified sound on the
rooftop deck? If so, what are the proposed hours?
o Are any sound attenuation measures proposed for the rooftop deck?

Event space.
o What sound attenuation measures are being taken with the
reconstruction of the theater? Please expand the description to provide
details.
o The description states “we are seeking maximum flexibility on event
timing” and further references “summer day time restrictions.” There
are, however, no noted hours requested for the event space. Please
clarify.
Box Office Bistro.
o When an event is occurring at the theater, will the café be closed and
serving eventgoers only, or will it also be open to the general public?
Conditional use permit (CUP).
o Please be advised, the CUP is required to allow the sales and service
of alcohol in conjunction with late hours, and to allow the earlier
opening hour that is outside of the 8 a.m. to 12 a.m. operating provision
in NBMC Section 20.38.070 (Landmark Structures).
Site development review (SDR).
o The major SDR is required to allow an increase in height consistent
with NBMC Section 20.30.060(D)(9).
Coastal development permit (CDP).
o The CDP is required to allow reconstruction of the existing building with
an increase in height by more than 10 percent of the existing height.
Balboa Village Design Guidelines
o The project description and justification narrative should address the
Balboa Village Design Guidelines, approved October 2014. Please
review the document and expand the narrative accordingly.
As noted above, the Police Department PRR is still pending. Additional information may
be requested to address any comments or concerns raised by said review.
Upon verification of completion, the application will be processed and scheduled for a
Planning Commission Hearing. Should you have any questions regarding submittal
