This approval is based on the findings and subject to the conditions of approval in the attached Zoning Administrator resolution. The City’s appeal period ended on May 26, 2022, and action became final on May 27, 2022. The applicant proposes to relocate the 1,000-square-foot temporary outdoor dining area and to install a TMPLT: 12/01/17 temporary raised wooden platform in that new location to provide a leveled seating surface. All other operatonal characteristics will remain the same and the temporary use, including temporary improvements, would be allowed for a one-year term. A larger temporarily expanded area was previously authorized through Emergency Temporary Use Permit No. UP2020-143 and Emergency Coastal Development Permit No. CD2020-128 (PA2020-246). There are no permanent improvements or permanent alterations to the existing operation authorized through this approval. All development will occur on private property. Coastal Commission Appeal Determination: Appealable to the Coastal Commission. The subject property is located within the Appeals Jurisdiction of the California Coastal Commission. The City’s final action is appealable to the Coastal Commission. Appeals to the Coastal Commission shall be filed directly to the Coastal Commission at the South Coast District Office in Long Beach. XX Not Appealable to the Coastal Commission. Subject Property is not located within the Appeals Jurisdiction and therefore not appealable to the California Coastal Commission.
