TITLE: Concrete Replacement Program Fiscal Year 2024-25 — Notice of
Completion for Contract No. 9715-1 (25R06)
ABSTRACT:
On November 19, 2024, the City Council awarded Contract No. 9715-1 for the
Concrete Replacement Program Fiscal Year 2024-25 project to Towo Enterprise, Inc. The
project replaced deteriorated concrete sidewalks, driveways, curbs and gutters, and
access ramps in the Spyglass Hill, Newport Hills, Harbor View, and Seawind
communities, in addition to various City of Newport Beach parks in the nearby area. The
work is now complete and staff requests City Council acceptance and close out of the
contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project.

This project included distributing construction notices to affected residents and
businesses; setting up traffic control; surveying; adjusting utility boxes to grade; tree root
pruning; tree removal and replacement; and removing and replacing various types of
concrete hardscaping in the Spyglass Hill, Newport Hills, Harbor View, and
Seawind communities and at various City parks in the nearby area. Refer to the attached
location map to see the project area.

The contracted work has been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final total contract amount was $1,636,108.75, which was approximately 3.1 % higher
than the original bid amount. This minor cost increase was primarily due to adding more
concrete replacement work to improve the condition of public hardscaping within the
project area. In addition, thicker than anticipated concrete panels were found at
City parks, which also contributed to the increased costs.

Additional time was given to the contractor to complete the work due to rain delays and
staff adding change order work to the project. The contractor was able to complete all the
proposed improvements, including the change order work, within the time allotted.
FISCAL IMPACT:
The Concrete Replacement Program FY 2024-25 was included within the FY 2024-25
Capital Improvement Program Budget. Funds for the construction contract were
expended from the following accounts:

The Neighborhood Enhancement Fund is used for projects that enhance neighborhood
aesthetics and functionality and is funded from General Fund surplus funds. The Parks
Maintenance Master Plan (PMMP) funds a variety of capital repair and maintenance for
all city parks in effort to keep these facilities in good condition. The PMMP is funded by
the General Fund.

ENVIRONMENTAL REVIEW:
On November 19, 2024, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance
of existing public facilities involving negligible or no expansion of use) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
