NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on Tuesday, July 22, 2025, at 4:00 p.m., or soon thereafter as the matter
shall be heard, a public hearing will be conducted in the City Council Chambers at 100 Civic Center Drive,
Newport Beach. The City Council of the City of Newport Beach will consider the following matter:
Municipal Code Amendments — The formal adoption of an amendment to Title 21 (Local Coastal Program
Implementation Plan) of the Newport Beach Municipal Code (NBMC) as part of a comprehensive update of the
NBMC for clean-up and streamlining purposes. This amendment is consistent with the City Council's adoption
of Resolution No. 2023-76 at its November 14, 2023, meeting and Ordinance No. 2023-22 at its November 28,
2023, meeting. Since the California Coastal Commission approved the proposed amendment with suggested
modifications at its meeting on May 7, 2025, a new public hearing is required to consider incorporating the
suggested modifications. In summary, the changes would:
• Delete Chapter 21.34 (Conversion or Demolition of Affordable Housing) as those requirements are
provided in State law so local regulations are unnecessary and the City does not meet the applicability
criteria of the regulations;
• Correct, update and/or clarify references to State law throughout;
• Change references from "Building Director" or "Planning Director" to "Community Development
Director"; and
• Clarify the definition of "Code" to mean the Newport Beach Municipal Code.
The action is exempt from environmental review under the California Environmental Quality Act (CEQA)
pursuant to Section 15060(c)(2) and Section 15060(c)(3) of the State CEQA (California Environmental
Quality Act) guidelines.
All interested parties may appear and present testimony in regard to this matter. If you challenge this project in
court, you may be limited to raising only those issues you raised at the public hearing or in written
correspondence delivered to the City, at, or prior to, the public hearing. Administrative procedures for appeals
are provided in the Newport Beach Municipal Code Chapter 21.64 (Appeals and Calls for Review). The matter
may be continued to a specific future meeting date, and if such an action occurs additional public notice of the
continuance will not be provided. Prior to the public hearing the agenda, staff report, and documents may be
reviewed at the City Clerk's Office, 100 Civic Center Drive, Newport Beach, California, 92660 or at the City of
Newport Beach website at www.newportbeachca.gov. Individuals not able to attend the meeting may contact
the Planning Division or access the City's website after the meeting to review the action on this application.
