ORDINANCE SUMMARY
NOTICE IS HEREBY GIVEN that on September 26, 2023, the City Council of the City of Newport
Beach, California, adopted an Ordinance entitled:
ORDINANCE NO. 2023-14
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH,
CALIFORNIA, GRANTING A NON-EXCLUSIVE FRANCHISE AGREEMENT FOR
COMMERCIAL SOLID WASTE AND DIVERTIBLE MATERIALS HANDLING SERVICES
WITHIN THE CITY OF NEWPORT BEACH
The Ordinance grants a non-exclusive commercial solid waste franchise agreement to
Robert's Waste & Recycling until November 8, 2027.
This Ordinance was adopted by the City Council of the City of Newport Beach, California,
at a regular meeting thereof on the 26th day of September, 2023, by the following vote:
AYES: Mayor Noah Blom, Mayor Pro Tern Will O'Neill Councilmember
Brad Avery, Councilmember Robyn Grant, Councilmember Lauren Kleiman,
Councilmember Joe Stapleton Councilmember Erik Weigand
NAYS: None
The Ordinance shall become final and effective thirty (30) days after adoption

NOTICE IS HEREBY GIVEN that on Tuesday, October 10, 2023, at 4:00 p.m., or soon thereafter as the
matter shall be heard, a public hearing will be conducted in the City Council Chambers at 100 Civic
Center Drive, Newport Beach. The City Council of the City of Newport Beach will consider the follow-
ing application:
Newport Village Planned Community Development Plan Amendment (PA2023-0122) —A request to
amend the Newport Village Planned Community (PC-27) Development Plan to modify the definitions
and the allowed uses of the area designated asArea5 (Retail), commonly known as the Corona del Mar
Plaza Shopping CenteL The following list highlights the requested changes:
• Within definitions, amend "Gross Floor Area" and "Restaurant" to be consistent with the defini-
tions provided in Chapter 20.70.020 (Definitions) of the Newport Beach Municipal Code (NBMC);
• Update subsection A (Permitted Uses) to allow the same uses of the General Commercial (CC)
Zoning District, subject to the same permitting requirements, as provided in Table 2-5 (Allowed
Uses and Permit Requirements) of Chapter 20.20 (Commercial Zoning Districts land Uses and
Permit Requirements)of the NBMC;
• Strike and remove the entirety of Subsection B {"Site Plan Review Required");
• Strike and remove the entirety of Subsection C {"Uses Requiring a Use Permit"); and
• Revise the Development Standards subsection to incorporate the update to the definition of Grass
FloorArea.
The amendment is not a project subject to the California Environmental Quality Act (CEQA) in accor-
dance with Section 21065 of the California Public Resources Code and Sections 15060(c)(2), 15060(c)
(3), and 15378 of the California Code of Regulations Title 14, Division 6, Chapter 3 (CFQA Guidelines).
The proposed action is also exempt pursuant to CLQA Guidelines Section 15061(b)(3), the general rule
that CEQA applies only to projects, which have the potential forcausing asignificant effect on the envi-
ronment The Amendment would update definitions and allowed uses for consistency with the NBMC.
Any future development project, in accordance with the updated allowed uses, will be subject to subse-
quent action in orderto implement and does not authorize new development that would directly result
in physical change to the environment.
NOTICE IS HEREBY FURTHER GIVEN that on September 21, 2023, by a vote of (7-0), the Planning
Commission of the City of Newport Beach recommended thatihe City Council adopt the NewporiVillage
Planned Community Development Plan Amendment (PA2023-0122).
All interested parties may appear and present testimony in regard to this application. It you challenge
this project in court, you may be limited to raising only those issues you raised at the public hearing
or in written correspondence delivered to the City, at, or prior to, the public hearing. Administrative
procedmesfor appeals are provided in the Newport Beach Municipal Code Chapter20.64.The annlica-
tion may be continued to a specific future meeting date and if such an action occurs additional public
notice of the continuance will not be provided. Prior to the public hearing the agenda, staff report,
and documents may be reviewed at the City Clerk's Office, 100 Civic Center Drive, Newport Beach,
California, 92660 or at the City of Newport Beach website at www.newportbeachca.gov. Individuals
not able to attend the meeting may contact the Planning Division oraccess the City's website afterthe
meeting to review the action on this application.
