C Newport Beach, CA 92663 Re: Earl’s Landing Mixed Use Project 2751 West Coast Highway, Newport Beach 2801 West Coast Highway, Newport Beach Dear Ms. Brown: It was a pleasure talking to you earlier today regarding the above project. Please allow this letter to confirm that the applicant for the above project remains Earl’s Partners, LLC, however, there is currently pending with the California Secretary of State, an amendment to the Articles of Organization of Earl’s Partners, LLC to change its name to GP’s Landing, LLC. Once the name change has been effected, I will notify you and provide you with a copy of the amendment. Also, as I discussed with you, the ownership of Earl’s Partners, LLC has changed in the past couple of weeks; Tod Ridgeway and Ron Soderling are no longer partners and the sole remaining partner is GEP Enterprises / Gary Primm. Mr. Primm, members of his team and I will be meeting in the coming weeks with the project architect and engineers to evaluate the mixed used project as presently designed. As I mentioned, I will also be meeting with you and other members of the City staff to understand how the City views the project from the stand point of consistency with the General Plan, Zoning ordinances, and the City’s Coastal Land Use Plan. As a result of these meetings, the applicant may choose to move forward with the current design; redesign the project; or withdraw the project entirely. Because of the uncertainty with respect to this matter, I requested and you agreed to a sixty (60) day extension Janet Johnson Brown July 3, 2012 Page 2 relating to the expiration of the application under Subsection 20.50.060.A.4 of the City’s zoning code, thus until September 6, 2012, at which point we hope to be able to have made a decision regarding the pending application.
