RE: Pier Permit No. 115-320: 316, 318, 320 Buena Vista (joint owners) (“Pier 320”)
Pier Permit No. 115-322: 322 Buena Vista (“Pier 322”)

I am in receipt of the applications requesting the above-referenced permits for Pier 320 and Pier 322 to
be transferred to Mr. John C. Morrissey, Trustee of the SNC Trust, having purchased the upland property
located at 320 Buena Vista (“Property”). The Property is a result of a merger of two separate lots having
the addresses of 320 Buena Vista and 322 Buena Vista, and each lot had a single pier, Pier 320 and Pier
322, respectively.
Newport Beach Municipal Code section 17.35.020.A.7 limits each parcel or lot to a single pier: “In single-
unit and two-unit residential districts, only a single pier and slip shall be permitted bayward of each parcel
or lot.”
Accordingly, as the Property is a single lot, only one of the pier permit transfer applications may be
approved. You stated a preference for transfer of Pier 320 with the caveat that if your appeal of a denial
and/or request for a variance to have use of both piers is unsuccessful, you “reserve the option to
surrender” your interest in Pier 320 and request a transfer of the permit for Pier 322.
Public Works has conducted an inspection of Pier 320, and has determined that it meets City
standards.
Based on the foregoing:
Application for transfer of permit for Pier 320 is APPROVED.
Application for transfer of permit for Pier 322 is DENIED.
If you choose to proceed with an appeal and/or variance request, please refer to the applicable forms
and fees located on the City’s website.
